First of all to keep the record straight, I was not hired to "Sound Proof" your (** ***'s) basement which is the first of many inaccuracies but however to acoustically treat his existing ceiling to upgrade his existing inadequate STC Rating of ceiling, to reduce the home theater noise and drum noise ( Drum Set) from transmitting into the upper living space through the ceiling and making it an unfeasible living situation above
I was also contracted to construct an acoustic STC rated wall to divide the stair well and home theater portion of the space from the remainder of the basement and the upstairs living space
If I was contracted to "Sound Proof" the space, then in fact all walls and ceiling would have been treated as well in the entire basement and the application to "Sound Proof" would have been much different and much more costly. The contract was acoustically treat existing ceiling and upgrade STC rating and construct an STC rated wall, "Sound Proofing" is incorrect and the contract is specific and reflects that. So this is the first of *** *** Inaccuracies
In the contract it states the project would be complete in 7-days also specified in contract. Yes, that part is accurate for the original contract to be complete in 7-days. What *** *** fails to disclose in his complaint is that the day before us completing the original contract work, I showed him where we were and what we needed to do to complete the work as I did after each day’s work so he knew what was being done (Photos always taken). We then discussed the possibility of additional work he wanted done, (i.eOak veneer panels on all walls with fabricated wood columns, trim work , running new wiring in walls and ceiling to all speaker locations,, modify existing closet door jamb and install new solid doors, insulate existing bathroom wall which had no insulation, not conducive to acoustics/sound, construct an additional SqFt of acoustic wall at bathroom wall subsequent to insulating it, pull forward all outlets switches, high hat lighting etc. To facilitate the job completion (Clearly not in my contract and specified) and supply doors, when also clearly not in my contract. Not only does this require additional money but also additional time. Does it not require addition time? Does it not require additional compensation? Yes it does! It is common sense and *** *** did know it would take an additional week to complete the extra work which he agreed to do and compensate me for as well. Now with additional work to be done we encountered Major snow storms which is a fact (We can verify weather history) and it's on on record and an immediate family member of mine passed away at the same time which I did not attend the funeral and rushed and barely made it to the wake so I can be at the ***'s working. With all this being said and accurate, by the last day on the job I was 95% complete with original contract and 95% complete with additional work and needed only day now to completeAnd with a death in the family and major storms at the same time, we still only had days’ worth of work to complete the total job including extra work. Not bad at all considering the opposition
The most important point to this is that nowhere in my contract is there or was there ever, penalty clauses for scheduling or liquidated damages for exceeding any schedule and there was no firm schedule at all. He clearly knew what needed to be completed and how long it would take. Another inaccuracy on *** *** part
As for his claim for showing up late! We never anywhere stated in any agreement a start and completing time dailyContractors normally service more than client at once and must give all of them the equal attention unless otherwise specified in advance We had a hour drive to *** *** house each way totaling hours a day in travel alone and still put in Full Days work or accomplished what was on "our" schedule each day! to bring us into next shiftWe even worked at times days straight!
The Next inaccuracy was the claim of not being prepared with materials. This is almost funny when in fact according to our contract *** *** was to supply all general construction materials for the job and I would supply all acoustic material which I did. So if there was any lack of material supplied it was not on our part. In addition *** *** did not have a garage or an area to store any materials on site and the work area was just too small to store material in and work at same time. We may have been able to store materials outside normally as an alternative last resort but there was Feet of snow the entire job and materials would have been destroyed to say the least another inaccuracy by *** ***
Next inaccuracy is his claim of being sloppy and unprofessional, this is so inaccurate to say the least, we are clean, courteous professionals and cleaned his place spotless after each shift. I have over Photos verifying this is true as well as testimony from people working on job. We protected his floors from entry of the house all the way to basement work area and cleaned thoroughly after each shift. Photos do not lie!
A Scam Artist is the next issue. *** *** was always clear on what we were doing and I made it a point to show him after each shift what was done and how thorough it was done. I even went the extra yard for him in every aspect, he was well aware of the quality of work. That being said why would I show him how and what was done after each work shift if I was not delivering what I said I was? This is an outright lie. Why would he not bring it to my attention while I was showing him? He had every opportunity to speak up. On the contrary he seemed to be very pleased with the work
Next inaccuracy is his claim that I boast performing work of my trade for celebrities’ home's, NY Rangers Practice Facility at Madison Square Garden, Heliport in NYC, etc. This is totally accurate and can be 100% confirmed. I am confident of that, not that I need to prove anything to him at this point. If *** *** had done good prior due diligence he would have discovered this to be accurate as well
The next inaccuracy claim is that we left this basement a mess and that he had to have someone fix or finish my work. This is so untrue and inaccurate. I have over photos and videos of the way we left his place and the top notch workmanship on our partI'm sure he had a friend or fellow contractor come in and obviously say " Oh I can do better than That " or " Oh these guys don't know what they are doing" Common place among homeowners and contractors related or doing other work for them If he had let us finish the last day it would have been complete with no problem. All we had left was to stain, paint, and complete some wood trim and a small punch list of items to complete cleanup and go home ! . Days work for my Crew. If *** *** chose to hire someone or say he had to in order to complete our work he is inaccurate and lying and it is just an attempt to try not to pay us what is due us. If he alters any of our work it will only work against him in future litigation
We did a complete thorough job acoustically and aestheticallyAs I stated we have over photos of what we did, how well we did it and the quality of suchPhotos do not lie
The problem with *** *** is people like himself never get away from the computer screen ever and do not know what is like to be a man, roll up your sleeves and put in a hard day’s work to make a living.
Contractors have a bad name and strikes against them as soon as they walk in the door. People need to understand contractors are humans and this is how we make our living. If I was so bad *** ***, why did you hire me? You cannot watch *** one night and compare your knowledge to people’s knowledge who have been doing this for a living for over years. I am confident in the work I performed, the manner it was performed and the results
*** *** clearly is wrong, inaccurate and unreasonable to say the least because he could not have what he wanted when he wanted it. The real world does not work that way because we live in an imperfect world and we don’t always get our way when we jump up and down
My pursuit for money owed me will never cease until I am compensated for my hard work. I will pursue every legal option to be compensated (ieMechanics liens, small claims court or whatever is necessary to recover compensation for work completed to date which is 95% of the contract until you stopped us. I will be relentless in my pursuit for my money and to clear my name. I am confident in my stand pointI am confident in my pursuit and I am confident emerging victorious in any litigation necessary

ANOTHER HOME BEING DESTROYED BY THOMAS COMIZIO

We are being swindled by Thomas Comizio - we are currently trying to get this person evicted from our home (through the courts) due to non payment of rent. He is also destroying our home by vandalism.

All of the other comments are true. I had the same experience with Tom. He stole my security deposit ($1000) and never did any work on my wall. It's been over a year now and he still has not refunded the deposit. He should be thrown in jail for what he's done to his clients. He is a thief. Do not hire!

We hired Thomas Comizio to do soundproof work for my neighbor and myself. He/Acousteffex is a total fraud. He brings lots pictures of his presumed previous works. These alleged works include heliport, sport arenas, commercial buildings. He is liar and a scam. Avoid this scam. Please do you research before hiring anyone. I made a big mistake, by trusting a site that recommended him.

Thomas Comizio is a scam Artist. I would like to point out that he has declared bankruptcy more than 3 three times. His claims for bankruptcy have been rejected. His business keeps changing names - ADT enterprises, American Acoustics, Acoustifexx. He claims to be licensed but never was! He has more lawsuits against him than you could possibly imagine. He has vandalized homes. He was born April 6, 1961 and his social security number is 053-54-5634. I hope this helps you.

Review: [redacted] d/b/a **ousteffex, was hired to sound proof our basement, which included many architectural details. What was to be a 7-10 day job turned into 3 weeks and was never completed. He would repeatedly show up late, leave early, be unprepared with materials, or not show up at all. Inclement weather was one of his many excuses. His work is sloppy and lacking any professional performance. He is a complete scam artist who will promise you what you want and perform the very least. He will claim he has done work in homes of famous & well known public figures, which we are sure are completes lies. Our basement is a complete mess & now we are forced to pay someone not only to finish the work [redacted] was hired **D overpaid for, but also to repair and/or replace a good amount of the work that he actually did. [redacted] has hired an attorney to try and recoup money he feels we owe him for work he "never" completed. We have video & photos of the mess he left in our basement to clearly dispute any and all claims he has against us. This man should not be allowed to do business under "any" name or in anyone's home!Desired Settlement: We would like a refund on materials we purchased, that as per our contract with [redacted], he was to purchase. We would also like a refund on work that we paid for that was never completed or poorly done. Our refund request is in the amount of $1500.00. Although we know [redacted] is not an honorable man, we are honest people who did not deserve to be cheated like this. We believed in him & what he promised us. Shame on him.
