Initial Business Response / [redacted] (1000, 8, 2014/12/23) */ Lewis Tuttle and Sons Ltd [redacted] on [redacted] (XXX)XXX-XXXX [redacted] (XXX) XXX-XXXX [redacted] December 16, As pertaining to case # [redacted] Without prejudice On October 10, Mr [redacted] and his wife first came into Lewis Tuttle & Sons Ltd and they asked if Mr [redacted] could come by their place and inspect the parts he had for the chimney and give advice on where the best place would be to install stove, where to cut hole in wall, etcThey asked how soon Mr [redacted] could come by and was informed by an employee that Mr [redacted] was out and they could leave their name and number and Mr [redacted] would call them when he couldThey asked what the fee would be and the employee told them that Mr [redacted] did all inspections, estimates, etc and he would inform them when he spoke to them what the charge would be as the employee is only familiar with the retail aspect of the businessThey said that was fine and left the store Some time later Mr [redacted] returned and I was inHe asked if I, [redacted] could come to his residence at [redacted] to see where he could place his prefab chimney on the back wall outside and also to see if he had the proper parts or if he had all the parts to do the job I told Mr [redacted] what my fee was and that it was payable upon inspectionI also told him I was very busy and may be able to do it early the following week but I called him that afternoon and told him I was free to come up now if he wantedHe said that was O.KSo I went to his residenceUpon my arrival I went into the basement area and he showed me the stove he had and the chimney parts, he needed extra chimney partsAll parts were purchase elsewhere I explained to him at the store of the Visual inspection fee and how it worksIf we do a visual inspection and he does the work the inspection fee will be applied to the labor, less the HST He didn't purchase any parts and didn't get Lewis Tuttle & Sons Ltd to do the labor I, [redacted] wrote up the visual inspection fee in his basement where Mr [redacted] signed it and then paid me in cashI then gave him a copy and kept a copy for myself WETT inspection was never mentioned until after I was paidIt was impossible to do that type of inspection as nothing had yet been installed it was still in boxes Mr [redacted] said I had robbed him and refused to give him his money back1, [redacted] felt I did Mr [redacted] no wrongHe had the right before he left my place of business and the fee was discussed to refuse the inspection or my servicesHe had the right to say before I came to his residence that he didn't need an inspection or when I actually came to his residence that he didn't need anything done at allBut Mr [redacted] didn't do that I, [redacted] of Lewis Tuttle & Sons Ltd did a visual inspection only as Mr [redacted] says in his complaint # XXXXX I have been in business for approximately years and [redacted] with very few complaintsI did not ask for money just as I arrived as Mr [redacted] statesWe talked about position of stove, parts he had and parts he neededThe last thing we did approximately minutes before I left was write up the visual inspection slip and Mr [redacted] signed it, counted out the money and paid me Some days later Mr [redacted] wife called the store and left a message with my employee and I returned her call and she said I should refund the money No money will be refunded as I, [redacted] of Lewis Tuttle & Sons Ltd provided my services as to the chimney matters, stove, inspection and transportation Please find enclosed a copy of the visual inspection only copy with Mr [redacted] signature [redacted] & Sons Ltd
