Dear MsOrtiz:
Please note that we stand by our first response
(attached). *** *** has received a handsome settlement on his loss
and decided to use the monies for other purposes. *** ***’s loss
involved plumbing and he used the funds to replace his roof and other areas
that were not in the scope of damages.
After receiving the settlement*** *** asked for more
money and Nationwide had declined. *** *** hired a contractor
to perform these alleged repairs to his home but doesn’t seem to have the
required proof that he actually paid them, by either forwarding cancelled
checks or bank statements to his insurance carrier. This is not the job
of the public adjuster to provide this information, it is the homeowner’s job
to provide proof that the repairs were made. It seems that
Nationwide is further investigating *** ***’s claims as they do not seem
reasonable. Also, please note that per *** ***’s previous
statements, he filed a complaint with the NJ Insurance Department who found in
our favor.
With regards to my letter disputing the insurance carrier’s
initial estimate of 8-14, this point is moot because at the time of the
writing, we were unsure of what the actual costs of repairs would be. Mr
Borowsky seemed to find a contractor to complete these repairs for far less
than what we had recovered for him through his insurance carrier. He
replaced his roof, as stated earlier, things that were not part of his plumbing
loss. In order to recover his depreciation, he just has to prove to
his insurance company that he made these alleged repairs and payments.
These are not our responsibility and this will be our last
response.
If you would like to confirm this, please contact MrRyan
Hunter, Nationwide Insurance Company, 215-837-
Sincerely
Paul F

I am rejecting this response because: I am putting this matter behind me.

Thank you for giving us the opportunity to reply.

Please note that we are in complete disagreement with Mr.
Borowsky’s statements stating that he has only been contact three times in
eight months.   This is not true.   My office has been in
contact with him...

continuously via email and telephone with my office staff.
Please see the attachments which show that my office has been in contact
continually throughout this claim process.   I have also made contact
with the insurance company and his accusations that he is owed additional funds
for areas of dispute.

He has been in contact with the insurance company and they
are not willing to release any more funds to [redacted].

On May 24, 2015 [redacted] contacted our office for help with
a plumbing leak from his second floor bathroom which affected a small area of
rug in his bedroom as well as his living room, kitchen and utility
room.   [redacted] contacted [redacted] who performed
emergency services and dried out the property and were paid their invoice of $4,939.63
for their emergency service work.  The insurance company adjuster did in
fact delay the process as the adjuster handling the case was removed to help
with the 6-23-15 storm that struck the South Jersey area and the area was
deemed a catastrophe by Governor Christie.

Settlement from the insurance company for the plumbing loss
building portion was $30,139.26, less $2,500 deductible, less $2,291.52
depreciation for an actual cash value payment of $25,347.74 and $4,939.63
payment to Seaboard for the restoration services.   It took quite
some time for the insurance company to reply and provide us with an estimate
and in the meantime, [redacted] stated that he noticed mold in his home and
contacted [redacted].   [redacted] responded with testing and did mold
remediation in the amount of $4,861.30.    Also [redacted] stated
that there was also other areas of damage and water infiltration that were
unrelated to [redacted]’s plumbing loss.   [redacted] had a roof
leak which was contributing to the mold and water damage in his
home.   This is a total and complete separate claim and cause of
loss.  [redacted] had [redacted] replace his roof in the amount of
$3,225.01.  He also removed all the carpeting on the second floor and
wants replacement for the entire second floor including the hallway and
bedrooms that were not affected.   Please note the insurance company
is only liable for the master bedroom carpet as a 3’ section of carpet was wet
and removed by [redacted].   The insurance company allowed
for replacement of the entire bedroom carpet.    [redacted] wants
payment for this and also the refinishing of this floor which the insurance
company is not extending coverage to the entire second floor.   [redacted] is requesting additional money when it appears, in fact, he was
overpaid on this loss.  It appears he only spent approximately $18,000 to
complete all of this when the total loss was $30,139.26 on the
building.     In order to recover the $2,291.52
depreciation the insurance company withheld, the insured must spend more than
the replacement cost of $30,139.26.

[redacted]’s demands are unfounded.  Please see the
attached communications (see link below) with [redacted] and the insurance
company which is self explanatory.

At this
juncture, we will be withdrawing our representation and forwarding our notice
to the insurance company and [redacted].

Please
feel free to contact [redacted] at [redacted] Insurance Company – [redacted]

Thank you.

Do not use this adjustment firm. They do not complete their work as signed by contract. Still fighting with my insurance company 3 years later. The owner Paul Y[redacted] never speaks to you and always avoids calls. He kept saying it was the insurance companies adjustment firm, come to find out it was him not responding they showed me the correspondence. Once Paul Y[redacted] received my initial work check they took their percentage and could not get a hold of the owner again.

Review: I have a home that got water damage from a toilet. The company is an insurance adjuster they had someone come in rip the home apart, all walls taken out I have the pictures of this. My home was gutted. I got a check for 12,582.27 to repair my entire home. The company they hired was paid 15,634.37. Action adjustment got paid 4,194.00. They spent more money gutting my home then I got to repair it, It cost me an extra 30,000 to have someone finish my home. I never got any phone calls back, he just hit and ran. I'm an elderly women who he very clearly took advantage of.Desired Settlement: I would like this never to happen to anyone again it is criminal. I want the money I spent to fix my home given to me. He clearly called in his own demo crew and ripped me off.
