time of sale. The vehicle had passed VA Safety & Federal Emissions inspection both done at independent shops. The customer stated that there was an accident involving the vehicle purchased from our dealership prior to any of these issues arising. At the point in time all liability of any damage or maintenance is not part of any warranty expressed or implied by our warranty. Supporting documentation regarding the VA Safety Inspection & Federal Emissions test is available upon request.

 Complaint: [redacted]
I am rejecting this response because:The statement made by the representative at Action Automotive is false. This was the worst experience dealing with any business period. Have them show you in writing where I stated the information. They really need to Get it together.  The whole conversation and meeting with them for me to get the vehicle was not professional. I am the consumer.  I deserve more respect than what they are giving me. As a matter of fact, Diego the sales rep lied on the  application to get it to go through.  Their customers service is the worst!!!!! But karma is real.

In response to [redacted]'s complaint,
He had taken the vehicle through MD inspection prior to purchase of the vehicle. VA dealer do not cover the cost of other state inspection's of vehicles, but MD is known for having higher standards than VA since the inspection is only completed only one...

time during ownership. [redacted] made a concern about the tires, which we agreed in writing to cover the cost of one rear tire once it was needed to be changed. Also [redacted] recently had to perform recommended maintenance, which is not covered by any dealership, including new [redacted] vehicles. We practice business in an ethical manner and satisfaction of our customers is a priority. We are willing to comply with our agreement of covering the cost of one rear tire.

Review: Visited the dealership on or about 3/19/13 and my fiance was verbally given all of the details of a 2006 Dodge Magnum. I asked many questions about the vehicle as it was supposedly located on a different lot and could not be retrieved until the following Monday. I was told there had been no accidents and no issues with the functioning of the car aside from "it's a 2006 not a brand new car so it won't look brand new", we were told that there were a few minor fixes that needed to be done before the car was brought over to the lot in [redacted] but that we would be contacted Monday with a loaner car until the minor fixes were performed and the car would be ready Tuesday or Wednesday. On Tuesday I was contacted and advised the car was ready but later told it wouldn't be ready until probably Wednesday because the part that was installed required a certain amount of drive testing before it was road ready. On Wednesday we went to see the car for the first time and drive it home after purchasing the car. When we got there, I asked more questions regarding accidents and was advised no. The contract for purchase had not been prepared so we were given temporary tags to drive from the lot. I personally drove the car and noted several issues. The first issue being the sound of scraping underneath the car at the lowest of speeds almost like the car was about to fall to the ground. The second being the windshield wipers not working until placed in the highest speed. The third being the broken lift gate of the hatch which is extremely heavy to lift and hold if the intent is to either put something in or taking something out of the hatch. Another issue being a loose driver seat that drops down when sat in. Another issue of major importance was the lack of working air conditioning, and there were minor issues as well. This being the first time driving the car and essentially what one would consider a "test drive" in a sense, we notified the owner/salesman the very next day. He, [redacted], I believe to be his name advised that this was no problem and that he will have the issues fixed, he asked that we allow him until after the 1st of April as he only had one mechanic available to fix the problems until that time. It was not until the 25th of March that the contract was available and we met again to review the loan documents and purchase the car. At that time, I asked [redacted], the individual writing up the contract documents about the repairs and he assured me that it was no problem stating "if you mentioned it to [redacted] it's cool and you're telling us about it now so we'll get you taken care of", still I wrote down all of the issues that had been discussed and signed and dated my notice for reference to what issues were brought to their attention and repairs agreed upon prior to the car purchase. I gave it to [redacted] and asked that he make a copy for both of us to have. The problem is this, my fiance in conversation with a coworker that had knowledge of vehicles mentioned the troubles with the car and suggested the shocks could be the issue. Upon contact with [redacted] he was told this and stated that it's not the shocks. Finally on April 27th our schedules and the mechanics at Action allowed for the vehicle to be seen. Low and behold, the mechanic returned with "the shocks need to be replaced" as well as other issues. The agreement was explained to him and he notified [redacted] only to be told he would not fix the issues, it would be our expense. I would like to know how a company can knowingly sell a vehicle and use such a tactic as to say yes we'll take care of issues before a car is purchased and then refuse to fix any of the issues once the purchase is complete. Upon learning this I attempted to contact [redacted] on Sunday 4/28/13 and left a message on the wireless number he provided and next called the dealership where I reached [redacted] and asked my question how are they not fixing the issues that they agreed to fix before we bought the car and his response was "you have to take that up with [redacted], he spoke to [redacted] (my fiance), he handles all of that". It is Tuesday 4/30/13 and I have yet to receive a return call from [redacted]. I believe this to have been very deceptive selling practices, failure of agreement and failure to provide repairs as agreed. This issue deals heavily with ethics.Desired Settlement: I only want the repairs done to the car that were brought to [redacted] and [redacted]'s attention prior to the purchase of the car as stated in my complaint. I would've never purchased a car with financing that needed any of these types of issues fixed had they not agreed to take care of fixing them once their mechanic staff was available. Had they said we will not fix the issues you have discussed with us prior to purchasing the car, we would've had the option and I would've left and never given buying the car another thought.

Subject: RE: Response to Complaint #[redacted] Car Sale for [redacted]

To: [redacted]

One the following complaint that was addressed by [redacted] (The co-signer on this deal) we had financed the deal with [redacted] Dealer Services, and at the time of sale when the negotiating was done between [redacted] (The main buyer on this deal) & [redacted] (Owner of Action Automotive Preowned Sales) and it was understood that because [redacted] was family of one of our contractor's that he would get the vehicle at a very generous discount below market price. Also it was addressed at the time of delivery that the only implied warranty on the vehicle was a 30 day or 1,000 mile Powetrain only warranty, which covered 50% parts and 50% labor. When [redacted] addressed these "issues" (which are maintenance items) it was made clear that [redacted] would be the ultimate decision maker, because the vehicle did pass Virginia state inspection and it also passed emissions. None of the maintenance items addressed by [redacted] affect the drive-ability of the vehicle and therefore our dealership is willing to honor our implied warranty, which [redacted] has a copy of in her possession. We have also offered [redacted] a substantial discount on parts and labor for any of the service items that he feels necessary. Please let us know if you require any additional information or copies of the Buyer's Guide signed by [redacted].
