Review: Action Fence provided me with a quote for $1452.53 for a 6' tall fence (which I signed and returned on May 28), collected my 50% down payment ($726.27), and scheduled fence installation for Friday, June 27. On Friday morning, workers arrived, tore down the existing fence, and began installing a 4' fence. When my husband brought the height error to their attention, they returned to the shop to get materials for the 6' fence. Shortly thereafter, the installers received a phone call from [redacted], the owner of the business, to stop work, pack up and leave the site.

When I got in contact with the office, they explained that they couldn't find a contract for $1452.53 in their system, and the project would cost more $1600. Despite repeated requests to speak with [redacted] (owner) or another representative of the company who is authorized to make decisions, all communication has gone through the office administrator, [redacted].

On Friday, Monday and Tuesday (today), I asked that they 1) honor the existing contract or 2) refund the 50% down payment so we could hire a different company.

On Monday, [redacted] accused me of altering the numbers in their contract from $1600+ to $1452.53.

Today, Action Fence informed me that they cannot complete the job for the $1452.53, and also refuse to refund my full down payment, stating that I am responsible for the costs of labor to tear down the existing fence, so they will refund the down payment less costs of labor (cost not specified - hinted that it may be around $200).

It's my understanding of the law that by billing me the 50% down payment, as well as arriving to do the job, the company agreed to the contract I signed and returned to them on May 28 - regardless of whether or not they can find the original paperwork in their system - and since they are the ones who left the job site and are refusing to honor that contract, I am not responsible for any charges the company incurred.

Because [redacted] called his crew off the site after they had demolished our old fence, we were left without any fence at all, so my husband had to purchase and install temporary fencing, as well as haul away the materials from the old fence.

I have contacted our credit card company to dispute the $726.27 charge.Desired Settlement: I would like the full $726.27 refunded to my credit card, and no additional charge for removal of the existing fence.

I’m sorry, we issued her a credit on her credit card for the full amount $726.27. Although we did take down and discarded her existing fence at no charge now.
