Review: On Saturday June 8th 2013, Action Garden Center of New Berlin, WI delivered 4 yards of top soil to our new home. After they left and we started moving the dirt to our backyard, where we had set up two raised beds. As we began to fill the raised beds we started noticing larger rocks, a plastic barrette, candy bar wrappers, and pieces of glass.

We collected the debris as we found it and when we were done filling the raised beds we thought that we had found it all. However, with all the rain we have been having we are seeing more of this material surfacing to the top and we have been picking out rocks and glass pieces out of garden ever since.

This has us concerned because we have a 2-year-old son and the garden was supposed to be a family project and now we don’t feel it is safe to let him dig in the dirt with us. We also have some of the dirt in the yard around the raised beds that spilled on to the grass when we were filling them. We are worried about letting our son play out in the backyard barefoot near the garden for fear that he might get cut by the glass that we keep finding in the dirt.

Today, June 29, 2013 after finding a wire brush and more amber and clear colored glass pieces both in and around the raised beds, my husband went to the Action Garden Center to discuss our concerns with them. He calmly explained what was happening, they’re response was to look out at their pile, that it couldn’t be their dirt. The woman there said they get their dirt from a supplier and have never had any complaints.

My husband explained that their dirt was the only dirty we were using in the raised beds and that we had several witnesses that could verify that indeed the glass was coming from the dirt they supplied us. He even showed her some of the glass that we were finding. My husband says that he did raise he voice a little in frustration when expressing our concerns about having our son run around the backyard in the sprinkler, worrying about whether or not gets too close to the garden. But then he calmed down. All she keep saying was that it was impossible and that he was making it up.

He calmly asked if she would please put it in writing that they were not going to issue us a refund and do not believe our claims. After this she responded by threatening to call the police if he did not leave. Our major concern is that what started as a fun family project is now a nightmare because of the glass we’ve been finding in and around the raised beds. We don’t want to see any other families go through this because of contaminated dirt.Desired Settlement: We would appreciate an apology and perhaps a refund. But more importantly would like the company to actually look into the issue and talk to their suppler to make sure this does not happen to anyone else.
