We are working to resolve this matter with [redacted]. We did tell her that there MAY BE a few items left in the back but we would have to take a look. She came in the other day and looked at a few unclaimed items that we dug out to see if they were hers and they were not. It is near impossible...

to keep track of unmarked items, that is why we provide tape and markers to the consignors. When this was explained to [redacted] she said she was unaware that she needed to mark her items. We would like to resolve this item so Ms [redacted] doesn't feel she has been wronged however it seems she may have a skewed perception of the value of her items and how much she is owed. Some of the items that  she states she was not paid for I have found that she was paid and signed the payment receipt for these items.As I explained to her that we did a multiple of choice of items off table then did rest of table for one money which means we sold everything that was left for one price. When she returned the day after the auction she saw that some of her items were left on the table and figured they did not sell, Jonnie explained to her that it is common for buyers to come back to pick up items the next business day as they ran out of room in their vehicles or even walked or rode a bike to the sale. She felt that this was odd and did not agree with us. Even though we feel we have tried to work with her to explain the receipts of items sold we even tried to offer her $40 to try and make her happy and she declined stating that was not enough. We have sold 36 lots of hers which includes a rest of table for one money which implies more than 1 item. [redacted] was upset after the first sale stating she wanted her stuff on one of the 1st few tables to be sold and we explained to her that those tables are decided by quality of merchandise and our regular consignors always get priority. If this is a problem she is more than welcome to take her items with her. This is when she took items with her.I am afraid that we will not be able to come to a reasonable resolution no matter how hard we try. We will still offer her to take a look in our storage area to see if she sees any of her items and if she does she can take them, if not we will leave the offer of $40 on the table to make her happy. We feel that $40 is above and beyond as we have done nothing wrong to require a payment on top of what she has already been paid for. We have a very good name in our community and realize that sometimes you have to do a little extra to make someone happy so that is why we are offering this payment.

Review: I'm not sure if this falls under this heading. I took items into Actionhouse auction LLC to have them auctioned off. After [redacted] explained how the auction was run, we placed our property in his care under contract. This contract said they would sell the items for 3 constitutive sales. then after the 3rd sale, we could pick up our property that was not sold or opt to have them donated. After the 1st sale we sold only 2 items,and on the next sale we were told they sold all the items. so we left more property for him to sell filling another 2 tables. This was all done on the same day that we picked up our cash. After getting home we went thru the consignor settlement. It shows that we sold only 16 items, when we went back to talk to [redacted] he told us that he couldn't control how much items sold for. So we asked why it showed only 16 items sold on this statement. He looked in his computer and told me that 44 pieces of our property sold, so I asked for a copy of his statement and he told me he couldn't do that. An older female employee overheard the conversation and stated maybe it was in the back room. This left around 30 pieces of property unaccounted for like, [Ex.] 13 pieces of Avon crystal and other high dollar items. After the 1st auction of the second consignment we stopped in to see what had sold. At this time I removed 3 tins and a circle of friends figurine. We went back after the next auction to get paid. At that time we asked where our remaining items were. They told us they were in the back room. We asked for them back and they refused saying they were to busy to get them and for us to come back the next day which was auction day at 5 pm and they would have them ready for us . When I returned the next day they again told me that they didn't have time to get the stuff from the back room. Then [redacted] the auctioneer told me "I don't want your damn stuff take it" But no one would go get it for me. They told me they would call me when it is ready to pick up. Upon reading the last the consignment settlement sheet it says there is no more inventory remaining on this auction. So why did [redacted] and [redacted] tell me that my property was boxed up in the back room.Desired Settlement: I want the rest of my property back from the last auction they told me was in their back room or fair compensation. I also want a more than a reasonable explanation for the 30 or so items missing from the 1st auction consignment settlement along with fair compensation .The property not listed on the consignment settlement are 13 pieces of Avon crystal, 1 Crosby silver plated footed bowl w/lid and glass insert, 1 blue carnival glass humidor, 1 Abington fan planter, 1 1985 H.J. Hummel plate, 1 Time out plate in container with certificate. and other misc. items. They breached the contract when they boxed the items after the second sale.
