In response to [redacted] complaint; On 6/18/ [redacted] stopped by the front desk of Active Fitness at 7:35am stating the he tore his rotator cuff and needed to freeze his account and left a note for our sales manager Jimmy to call him at [redacted] On 6/22/at 2:30pm Jimmy called [redacted] and left him a message to please call him back.On 7/20/Jimmy called [redacted] back again after receiving a message that he called again about wanting to freeze hi a account however he had to leave a message due to no answerDue to the inconvenience that [redacted] experienced upon attempting to freeze his account I would be happy to back date his notice to cancel to the 1st visit that he wanted to freeze his account which was 6/18/By putting in his notice to cancel back to 6/18/this would make his last payment due on 7/25/which means his account will be cancelled effective todaySo again to confirm that [redacted] membership is now terminated and his last payment was already paid on 7/25/If you should need any additional information please let me know

I apologize however I have been out of the office with the flu for the past days and I saw this complaint over the weekend for the 1st time [redacted] is not stating the facts of what actually took place in reagards to his membership so here is what happened [redacted] joined with Paul on December 21, Last visit was October Credit card returned NSF starting in November Sent him a letter January 25, about the balance He called on January 30, I spoke with him, he says he cancelled in October on his last visit I explained to him that he wouldn't have been able to cancel then since his year commitment wasn't even up yetInsist that he cancelled, checked there are no scans and he said he doesn't have any paperwork showing it was cancelled Explained to him how cancelled works (they must come in or send a certified letter) Offered to waive all the fees and just have him pay (X for past due and X for day notice) He said he wasn't paying and that he wanted a refund for the last year that he didn't use I double checked today nothing in the scans except for his contract and the letter sent to him when he went past due

I belonged to Active fitness in At the end of I canceled my membership Since December I have been getting billed without my knowledge One this date I received a bill from asking for additional fees due to my credit cards expiration date changing, they were unable to automatically withdraw money from my account They are advising me that they do not have any paperwork from my account It is on record that my last day at the gym was in October I feel that I should, 1) not be required to make this month payment of $also I should be reimbursed for all the fees I paid during the year when I had already canceled my membership which is an additional $ Thanks for your attention to this matter

I have tried to "freeze" my membership by making six separate visits to Active Fitness only to be told each time that a manager was not available and that the employee had no authority to do so At one point, I was told by an employee that the manager would freeze the account when he arrived the next dayThe account was never suspended and was continued to be billedFrustrated, I went in yesterday to cancel my membership and was again told that no manager was presentI've heard from ex employees that this is a tactic employed by the owner to deter people from canceling their memberships

I am rejecting this response because:
I was charged for an entire year without being a member.  I undestand I am not going to get a refund for all fees paid, but to continue billing me after they were advised my membership had been canceled is where there is a problem.  Charging me over $100 while not being a member does not sit well with me but that money is gone.  I am looking for a reasonable solution and charging me $50+ is not reasonable. I can see if I had other issues or failed to make payments during my time there, but there were no issues with my previous account.    Just looking for reasonable solution.

with Paul on December 21, 2014.  Last visit was October 6 2015.    Credit card returned NSF starting in November 2016.  Sent him a letter January 25, 2017 about the balance.   He called on January 30, 2017.  I spoke with him, he says he cancelled in October 2015 on his last visit.  I explained to him that he wouldn't have been able to cancel then since his 1 year commitment wasn't even up yet. Insist that he cancelled, checked there are no scans and he said he doesn't have any paperwork showing it was cancelled.  Explained to him how cancelled works (they must come in or send a certified letter).  Offered to waive all the fees and just have him pay 58.45  (11.69 X 3 for past due and 11.69 X 2 for 60 day notice).  He said he wasn't paying and that he wanted a refund for the last year that he didn't use.   I double checked today nothing in the scans except for his contract and the letter sent to him when he went past due.
