To whom it may concern,
This is in response to Ms ***’s complaint that Acura of Lynnwood is responsible for damaging her Acura RL passenger seat leather during the Takata airbag recall performed on her vehicle on September 20,
When Ms***
re-entered the service department immediately after her service work was done, she was very angry and vocal, stating that “someone ripped my passenger side seat leather and tried to cover it up with an umbrella.”
I immediately went down to speak with her, examined the damage, where I noticed an umbrella in the passenger area, and then I immediately went into my shop and spoke with my lead technician to better understand the exact process of the Takata airbag recall
The procedure involves removing the glove box and lowering it to the floorboard area, which means there is absolutely no room for some to be seated in the passenger seatTo do this procedure, the technician opens the car door and then sits on the door frameThe tools used in this procedure are necessarily smallA heavy tool is not required to make the repair
The Takata airbag recall encompasses millions of Acuras and we perform multiple recalls a dayMy staff is very well trained and practiced in performing this procedure
The technician that performed the work mentioned that he had noticed a towel had been draped across the seat, and he managed to complete the recall without moving the towel
Her vehicle went through our complimentary detail after the service was performedThis involves vacuuming the floor and seats, and washing the exteriorThe detail staff is well trained in this service and perform dozens every dayPersonal items are not touched or are very minimally moved to complete the vacuumThe vacuum used is an industrial-type with a very long flexible plastic hose that connects to a large stationary vacuum several yards away
After speaking with my lead technician about the exact procedure performed on her vehicle, and the technician that performed the service, I then spoke to the detailer that was responsible for vacuuming her carHe stated that he noticed the rip in the seat when he moved the towel to properly vacuum the seatThe detailers do not carry sharp or heavy objects as they are unnecessary to completing the task
These conversations took about minutes, not the minutes as stated by Ms***, and I came to the conclusion that we could not have caused this problem
I informed Ms*** that we are not responsible for the damage
Ms*** kept telling me that something quite heavy had to have been set on her seat to cause this rip
To reiterate, the tools necessary for this job are quite small and lightweight and in no way could have caused a rip in a seat
As an Acura dealership, we are highly aware of how our tools could potentially damage a customer’s vehicle, and we take steps to insure that this doesn’t happenWe service dozens of vehicles a day, so this practice is central to our work
She requested to speak with my General ManagerUnfortunately he was not in the office at that time so we scheduled her to come back and speak with him and also have a professional interior installer come and give us an estimate for repairs, which we were considering as a one time gesture of goodwill to a first time customer
On September 21, 2016, the interior professional came to the conclusion that the leather seat had become very dry and friable due to age and everyday wear and tear and that state could not possibly have occurred during a one-hour trip through our shop
The tear, in fact, appeared to old damage due to the lack of fraying, a sign of new damage in a leather seat
The friable nature of the seat precluded any further repair attempts
I called Ms*** to make her aware situation
She requested a 9am meeting the following day with both myself and the General Manager
Ms *** then failed to make the appointment she requested, and also failed to callAt 10am, an hour past the set appointment, the General Manager had another appointment and had to leave
Ms *** arrived at 10.45am and was very upset that the General Manager was not available and she was also unwilling to reschedule another appointmentShe left the lot after saying that I would be hearing more from her
In conclusion: Acura of Lynnwood did not damage her seat
We did not attempt to cover her rip with an umbrella
We did find towels in the trunk of her car when it was here.
Employees recall seeing the rip while here in service
A professional interior specialist stated that the leather is falling apart due to age and the rip does not appear to be recent, and no further repairs could be attempted due to the poor condition of the leather
Ms *** failed to make an appointment she specifically set with the General Manger to discuss the issue further
She declined to set another appointment
We feel this matter has been followed appropriately and there is nothing more we are responsible for, and consider the matter closed

Complaint: ***I am rejecting this response because:
June 29,
To Whom It May Concern:In response to MrRobert L***'s letter of June 21, 2016, I would like to point out the fact that his letter is full of inaccuracies and innuendo MrL*** has also made inaccurate statements in his previous correspondences, which I would also like to address on a point by point basis.MrL*** stated the last time my car had been serviced by Acura of Lynnwood prior to May 14, was March 9, This is, in fact, incorrect My car was serviced by Acura of Lynnwood on April 23, for an oil change, after which it began leaking oil, which as I stated before, it had never done I initially did not notice this, as I had been doing work in my garage and had been parking the car in my driveway Once the work in the garage had been completed and the car was back in the garage, I noticed oil spots on my driveway May 14, was when I took the car back to Acura of Lynnwood to complain about the leak I was told at this time that the reason the car was leaking was because the threads on my oil pan had been stripped, and “someone” had put in an aftermarket oil plug At this point, I took the car to Bret's Incorporated to have them look at the problem Bret contacted me and expressed surprise that there was an aftermarket plug installed, as he had done all of my oil changes and other maintenance for years prior to me taking the car to the dealership on April 23, 2016, using only OEM parts. He told me he would contact MrL***, who he has known for about years in his capacity in the parts department of the dealership, to discuss the matter MrL*** denied any responsibility on the part of Acura of Lynnwood At this point I authorized Bret to replace the ruined oil pan.On another point, MrL*** states that in a conversation with MrBret H***, he was told by Bret that my car had not been at Bret's Incsince This is a complete fabrication Unfortunately for MrL***, I have attached a letter disputing this statement from MrH*** himself As I correctly stated earlier during this process, MrH***, and no one else, has done all maintenance and repairs on my car for years, contrary to what MrL*** implied The letter from MrH*** also documents the events up to and including this complaint with the Revdex.com MrL*** also falsely claims that MrH*** confirmed to him that the oil pan he (Bret) installed was aftermarket Again, unfortunately for MrL***, I have attached a copy of the receipt for the repair with the part number, which is clearly an OEM part I would like to say here that MrH***'s reputation is his livelihood He states on his website, and has told me himself, he uses only genuine OEM parts If this was not the case, and he used aftermarket parts, he would not enjoy the excellent reputation that he does MrL***, on the other hand, is merely an employee at a dealership; he gets a paycheck regardless of his personal reputation.Ironically, on Monday of this week, as I was talking to Bret about this complaint, he told me that someone in the parts department at Acura of Lynnwood called him to ask if he had a part for an older Acura Legend, which the dealership did not have in stock, and which MrH*** was able to sell to the dealership This seems to also contradict MrL***'s claim that Bret uses aftermarket parts, if as he claims, the dealership uses only OEM parts Why would they call MrH*** looking to buy a part otherwise? In conclusion, contrary to MrL***'s statement that he considers this matter closed, it is not I am outraged that MrL*** has publicly implied that I am trying to "force us (Acura of Lynnwood) into paying for an oil pan that we had nothing to do with" I am only attempting to get Acura of Lynnwood to admit their culpability in this situation It appears that I may have to escalate this in order to get satisfaction
Sincerely,

To Whom It May Concern,
RE: *** *** Acura TL
Mr*** brought his Acura TL to Acura of Lynnwood on May 14, At that time we performed an oil change as he requestedThe vehicle had 95,miles on the odometer
He is claiming
Acura of Lynnwood stripped out his oil drain at this time, causing his vehicle to have an oil leak
Prior to this visit, the last time this vehicle had been serviced by Acura of Lynnwood was March 9, at 72,miles on the odometer
Assuming Mr*** kept a regular service schedule, his vehicle had at least four oil changes during that time
I do not know where Mr*** had those oil changes performed but it was not with Acura of Lynnwood
The Acura has an aluminum oil panAluminum is a soft metalOvertightening the drain bolt leads to stripped out threadsThere are specific torque specifications for the oil drain bolt specifically to prevent the exact problem Mr*** has encountered with his vehicleAdditionally, the factory bolt is aluminum, as steel bolts damage the oil drain threads
Acura of Lynnwood performs hundreds of oil changes on Acuras every monthOur technicians are trained and certified by AcuraIn addition to this training, our technicians use a specific toque wrench which does not allow the overtightening of drain bolts
It is not uncommon for aftermarket shops to not know the specific torque specifications and over torque the oil drain bolt, and then install a larger aftermarket steel bolt and washer to disguise the damage done to the drain pan
I was told by Bret’s Independent that this vehicle came to their shop with an aftermarket oil drain bolt
We are an Acura dealer and do not use aftermarket products, and as an Acura dealer we know not to use a steel bolt on a factory oil pan
The damage to Mr***’s TL did not occur at Acura of Lynnwood or from the oil change service Acura of Lynnwood recently performed

To Whom This May Concern,To follow up with Mr*** concern in not negotiating the price of the carBefore entering into the business office where Mr*** signed different documents that stated the price he signed the cover sheet of the deal jacket where the sales price, tax, doc fee, and liscFee is all clearly labeledAs for the fuel efficiency of the car that can vary depending on your driving habits. As of now Acura of Lynnwood considers this to be a closed caseThank You,BJ G***

Complaint: ***I am rejecting this response because:
As I mentioned on my complaint, Mr.Mike lied to me about the mileage and gas efficiency of Acura TLI also had mentioned that we did some negotiation onto sales price and I offered my price as they asked me "How much you wanna pay"? I do not agree with MrBJ's responsesMy first concern was sales price not the monthly payments! Everybody wants to negotiate onto sales price first!! When customer gets what He/She offered, then both party can move forward.which is I have mentioned on my complaint.Mr.BJ's statement is 100% falsethey underestimated me as a non-native english speaker immigrant and took advantage of it.They gave me so much mentally pressure to make me buy that car. There is a conflict between the actual deal we had made and the documents they preparedThey did not disclosed me sales price was changed once we made final dealIf they couldn't sell the car the price I offered ,why they said "deal is done you gonna take new car home tonight"???
MrBJ is not responding to my issuehe is giving lont statement focusing on "extended Warranty and GAP Insurance"; which is not my issue. He is just trying to hide fraudulent business deal they made.Since I bought that car I am not happy at all!!I am having mentally so frustrated If they dont wanna resolve the issue through the Revdex.com I will file a lawsuit on Supreme Courtat the end I hope Revdex.com will do their best to resolve this issue
Thank you
Sincerely,*** ***

On May 30th, 2015, [redacted] came in to Acura of Lynnwood to purchase a car. After spending time with Mike looking at options, Mr [redacted] wanted to test drive a 2012 Acura TL that was on the showroom floor. After the test drive Mr [redacted] made an offer on the car, and there was some negotiating as to...

price and down payment, as well as possible trade-in of his Honda Accord. Mr [redacted]’s main concern throughout this process was his monthly payment, which he wanted to be between $350-$380. His trade-in had several issues, including an oil leak and damage, and he didn’t like the assessed value and opted out of trading it in. A price was agreed upon for the 2012 TL, and Mr [redacted] went into the finance office to complete all the necessary paperwork. He was presented all the protection products we offer at that time, and he chose to purchase an extended warranty and gap insurance, which were added onto the agreed upon price of the vehicle. Mr [redacted] signed all the paperwork, which states the purchase price of the vehicle as well as all the products he decided to purchase. When he left Acura of Lynnwood he was happy with his car, as well as the deal that had been struck.A couple weeks later Mr [redacted] returned to Acura of Lynnwood, he wanted to cancel the extended warranty and gap insurance that he had purchased. We cancelled those products. That cancellation has been processed. Since Mr [redacted] financed the car through a bank, the refund does not go to him personally, but rather it is refunded to the bank as the bank is the owner of the loan, which supplied the money for the purchase of Mr [redacted]’s vehicle. That money was refunded to the bank. That refunded money is deducted from the principal value of the loan and does not change his monthly payment terms, which is a legal document with the lending bank. Mr [redacted] wanted to go over the paperwork again, and I was more than happy to do that. We pulled out all the original documents, as well as the copies, and reviewed everything. All the documents he signed stated the purchase price plus his products and still kept him in his monthly payment range, which had been his main concern during the negotiation.I am not clear on Mr [redacted]’s dissatisfaction with his experience at Acura of Lynnwood, nor why he has contacted the Revdex.com, nor what he needs resolved.

Complaint: [redacted]I am rejecting this response because:Bret, who is my independent Acura ceritfied mechanic and owner of Bret's Inc, said he has not seen anything quite like the botched job on the oil pan. Bret's has done all my oil changes for years before Acura of Lynnwood and only uses certified OEM parts.   Bret told me he talked to the service manager of Acura of Lynnwood who he has known for 25 years and could not believe Acura of Lynnwood stripped the oil pan so obviously.  Bret documented the the threadless oil pan. So Acura of Lynnwood does not stand behind their work.   The car has NEVER leaked until after Acura of Lynnwood did the oil change.  it seems impossible that this is a coincidence.  The logical conclusion is that if Bret had stripped the threads, the car would have leaked after he did the oil change, and not until AFTER Acura of Lynnwood worked on the car.  Furthermore, if Acura of Lynnwood had noticed the threads were stripped, why did they not mention this when I picked up the car?

To Whom It May Concern

I would like to address that Bret’s Independent and Bret himself have no Acura certifications or qualifications, which is why they are an independent shop. Their technicians do not have any formal factory training, they learn while they work on customer’s cars. This would be no different than a backyard technician. Our technicians, however, have gone through schooling as well as factory training. Because of this, we stand behind all of our work completed by our certified technicians and have upmost confidence in them.
Referring to Mr. [redacted]’s statement of his relationship with Bret’s Independent as to “have completed all his oil changes over the years,” would be inaccurate. Mr. [redacted] stated that we have had a 25 year relationship with Bret which is true. So I visited Bret’s and was told that Mr. [redacted] has not been into his establishment since 2012 for an oil change.
Therefore, it is obvious that he has gone elsewhere for his oil changes and services. Going back to my original statement, he should have had 4 oil changes during this time. This problem obviously occurred somewhere else and he came here trying to force us into paying for an oil pan we had nothing to do with. He stated there was a problem with it and never even gave us a chance to do anything about it before he had it repaired at Bret’s.
Going back to Mr. [redacted]’s statement of Bret’s Independent “only using OEM parts” is also inaccurate. The new oil pan installed is in fact an aftermarket part confirmed by Bret as well. By finding so many false statements made about this situation, I can see in no way that Acura of Lynnwood is liable for any reimbursement and consider this matter closed.

Respectfully
