Southwest Missouri Bank has reviewed the customer's account and the dates debit items were presented to the bank for payment. We find all insufficient check charges were appropriate. Deposits were not made before the items were presented for...

payment. The most recent insufficient items the customer stated in his complaint were received for payment on 9/30/2016 when the balance was not sufficient to pay them. Their deposit came in on 10/03/2016 and the bank did pay the insufficient items, and did not send them back, due to seeing the deposit pending. Insufficient charges were applied on 10/03/2016, though, for two insufficient items. We encourage the customer to come into the bank and we would be happy to sit with them and review their transactions to show the dates items are being presented. Fees are posted on insufficient items the day after they were originally presented to the bank.

Review: I am complaining because I am not being given a refund for a $100 deposit.

On November ** around 5:30pm I went to Valley Stream Acura to inquiry about leasing an Acura RDX 2016. We were assisted by Howard K[redacted] a Sales person. When we were talking about the price Howard assured me that the price his financial manager was the lowest price I can get for this car. He assured me that ALL Acura's offer the same price because it is set by the "Corporate" office. I said he could not give me a better price because it is simply not given by Acura. In addition, I asked for free oil changes, since I got them with my previous car (Mercedes). He told me that Acura does not offer. After going back and forth several times he gave me one. I agreed to the credit agreement because I believed that it was the lowest and best deal that any dealer can give me.

The next morning, less than 12 hours later, I went into another Acura dealer, Island Acura. They immediately offered me the same car, same color, same 'tech" package for less money. In addition, they were giving me a few free oil changes without even asking for it.

The sales person at Island Acura, John, called Valley Stream Acura around 10am and told them that I was cancelling the deal and I was going to pick up my $100 deposit. On my way to Valley Stream I called and was told the money was in the safe and I have to pick it up on Monday when the manager is working. On Monday, I called Howard to tell him I was on my way and he said I WILL NOT get my deposit back and anyway they sent the money to "corporate". I asked for a manager and was transfered to Tony in the Finance Department but the call went to voice mail. I called several times and my husband also called several times only to be hung up on or transfered to voice messages.

I am requesting my deposit back of $100.00. Their credit agreement was not as promised I received a lower price at another dealership within a few miles of each other.Desired Settlement: I want my deposit back of $100.00

Review: On October [redacted], my wife and I placed a $500 deposit with Acura of Valley Stream (Dealership) towards the lease of an 2015 Acura MDX AWD with Tech Package, Auto Starter and Running Boards. The lease was supposed to be financed by Acura Financial Services and was predicated on a $12,500 up front credit for a trade-in vehicle, 35 payments of $255 and "no other fees" (direct quote from salesperson). On October [redacted], my wife and I visited the dealership to complete the transaction. However, we were informed that the lease could no longer be financed by Acura and was now being financed by some [redacted] that I hadn't heard of. Additionally, we were informed that there was a $400 "turn in fee" at the end of the lease. The dealership positioned the first issue as "irrelevant" and the second issue as something "everybody knows", and "not material". I pointed out that the counter-party on the lease was very important to me from the beginning of negotiations. I knew from discussions with several other Acura representatives that Acura Financial Services offers significant flexibility with respect to termination of the lease early and by waiving between up to $750 of damages at the time of the lease expiry - both factors were important to me since this is the first time I have leased a car. On the second issue, I pointed out that I had never leased a car before, but had been upfront and asked very detailed questions about the economics of the transaction and was definitively told that there were no hidden fees. The dealership had NO reason to believe that I was familiar with the concept of a turn in fee (which as I understand it is a new concept for Acura as well). Further, I pointed out that the $400 being charged represented almost 5% of the cash payments we had negotiated on the deal, so I believed it was material. We indicated that we were not comfortable consummating the deal at this juncture, but that we would think about it and return if we were willing to move forward. We explained that we were under a fair amount of pressure to return home since our 8 years old and 6 years old kids were going to be dropped off by their school bus and no one was home to receive them. The manager and salesperson then turned belligerent. Started yelling at us in an attempt to intimidate us. When all else failed, they refused to return our old car's license plate which they had transferred to the new car without our approval. They aggressively pushed us to drive off to pick up our kids in the new car which now had our license plates. I was only able to retrieve our license plates and leave the dealership after the manager heard me call the cops. As I was leaving, I was told that the dealer had no intention of returning my $500. despite the fact that they were not able to deliver me a lease that we had agreed upon. The dealer's initial argument was that I was not living up to our agreement - in fact they threatened to sue me to force me agree to their terms. In reality, the agreement signed at the time of placing my deposit clearly states that "If I do not accept the credit terms when presented, I may cancel this order and my deposit will be refunded". Please also note that the dealer has not incurred any damages as part of this transaction. Had they been up front about the fees and the Leasing company, and given me time to consider the risks of such a deal, we might have been able to reach an agreement. However, they chose to try to bully us physically and have since continued to harass us by illegally retaining our deposit.Desired Settlement: 1. I would like my $500 deposit returned which has been illegally retained by Acura counter to the terms of our agreement

2. I would like Acura of Valley Stream censured for highly deceptive marketing and selective disclosure around their leases, and extremely aggressive and boorish intimidatory and predatory tactics to pressure consumers into accepting a sub optimal deal
