Adams Telephone Co-Op operates under Co-operative statutes and bylaws. From time to ttime, and at the direction of the Board of Directors, capital credit refunds are made to members and previous members for their patronage with the company in previous years. The most recent capital credit... refund was for patronage for the year 1991. In 1991 Mr. [redacted] and his wife [redacted] held a joint membership. The capital credits refunds must be paid to the members as they are listed in the year for the capital credit refund. In this case it was 1991 and the [redacted] membership was " [redacted] and [redacted] ." The refund check must be written the same way.Unless the divorced person can produce a court order that grants the capital credits to either the husband or wife, then the capital refunds check will be made to both parties if they held the joint membership during the year of the capital credit refund. All of this has been explained to Mr. [redacted] .

Customer is an Internet customer of Adams being served over DSL provisioned through copper facilities. Customer's residence is between...

15,000 - 18,000 facility feet from the Central Office serving customer. DSL on a copper line has limitations on the amount of data (or signal) that can be sent through it dependent on the distance that the data is being sent. Thus, a DSL customer on a copper line living 1,000 feet from the Central Office will have a better/faster Internet experience than a customer living 14,000 feet from the Central Office. The best speed customer can expect is up to 5 Mbps. All carriers using copper facility have this issue. Our advertising materials and website state "speeds up to 20 Mbps" due t0 the fact speeds vary based on where a customer lives compared to the Central Office. The advertising is correct and not "deceptive". This has been explained to customer.

Complaint: [redacted]
I am rejecting this response because:
... March 30, 2017   To Whom it May Concern: Re: Adams Co-op- Request for dividend check either be put solely in existing members name or two checks with the amount equally divided between divorced members.   The following is in response to the letter the Revdex.com received from Adams Co-op:         The information provided in the September 27, 2016 online version of the Adams co-op by laws: https://[redacted]/sites/adamsec/files/PDFS/Bylaws- does not clearly address joint membership in regards to divorce.      In my particular case, my ex-wife left the co-op and took her name off in May 2012 She was on the joint account for 23 years and I continue to be the only remaining member on the account- a total of 27 years at this time.  FYI: Her name has been wrong the entire time she was on the joint account- which we attempted to rectify more than once- but without success.      Our divorce decree does not address the Adams co-op or dividends- which the By-laws (from my understanding) do NOT state  is a requirement.  But I was informed by [redacted] the CEO at Adams their lawyer- Hubert Staff stated this was a requirement to ensure the dividend check came in my name , the only remaining member at the co-op.  I am being penalized by the loose interpretation of the Bylaws simply because of a No Fault divorce.  She willingly left the co-op:  I did not.      I have read the Bylaws many times and do not see where a divorced member is not entitled to receive a check in his name only when there is a dissolution of a joint membership due to divorce. The least I should receive is half of the dividend I have earned.  I made this point very clear to [redacted]- the CEO at Adams.      I do not accept the interpretation of the By laws according to Hubert Staff and would like this issue resolved by receiving at least my half or all of the dividends in my name only – since my ex-wife forfeited her rights when she left this residence in May 2012.
Sincerely,
[redacted]
