be no long-term contract, the information was not relayed to the front desk. The sales person mentioned in the complaint is no longer under our employ. The front desk person who received the call suspended the client's contract immediately and no fees were charged to the client's account. Mr. [redacted]'s wife has a history of signing two other contracts and terminating them before the finish date with no charge to her. It is our desire to no longer do business with the [redacted] family.

Review: In September of 2014, my wife ,[redacted] contacted Adamsons Peak Performance to enroll in an exercise program. She originally spoke to a male named [redacted]. She specifically said she only wanted to enroll for a few months and did not want to enter into a long term contract. He assured her that he would set her up on a month to month at a total of $99.00 per month. She attended the program 3 days a week for 30 minute sessions for approx. 2 months, paying her $99.00 per month each month. In mid October as she was leaving the facility after her 6 a.m. class, she was stopped at the front desk and asked to fill out her personal information on a form. Not having her glasses with her she had the young man working the counter help her read it and fill in the blanks. She asked what she was signing and was told it was just extending her membership which she assumed it was extending it to the next month.A copy of what she filled out was not offered to her at that time. As of the first of December, she felt she wasn't getting the results she was hoping for and decided to change gyms. When she notified Adamsons of her intent, she was told she had a 12 month contract and that they could not let her out of it. She informed them that she did not sign a 12 month contract and wished to cancel. Their response was basically "to bad, we have a signed contract" I contacted Adamsons on 12-10-2014 and asked to speak to [redacted] and was told he no longer works there. After a conversation with [redacted] at Adamsons, I asked to speak to a manager and was told I could not. I then asked to speak to the owner and was told I could not. I then asked to have the owner contact me and was told he would not call me.Desired Settlement: I was told by [redacted] that she would cancel the contract but that I would have to pay the next months dues of $99.00 plus a $50.00 termination fee. I told her that was unacceptable and wanted to speak to her boss and was told I could not. I then asked to speak to [redacted], the owner and was told I could not. I am asking for a straight cancel of the contract that was not properly disclosed, and for a refund of any moneys charged to my bank account after today's date of 12-10-2014

Response:

I have reviewed the response made by the business in reference to my concern, and find that this resolution is satisfactory to me. Although not all of the content of their response is true we will take their response as a permanent cancellation of any contracts signed and will not be billed for anymore services.
