The project was in an existing home with imperfections in the project area that affected the outcomeDue to this there were minor issues during the projectHowever, this did not come up until a third party "a professional" commentedIf not for this "professional" the issues could have been addressed in the standard way in which a construction project is typically handledWe were not allowed to work on a punch list or bring in another third party to assess and correct the issuesThe issues could have been corrected if given the opportunityThere were boxes of material left over that could have been used as well to help offset any material costsI have come to find out that the owner actually had the color changed and thus one of the underlying issues I feel that the tile had to be removed entirely according to the ownerThe granite was cut for the vanity area before we started working on the project and preceded meThe [redacted] s was told that we will do our best to reuse the granite and we did provide them with some options if we could not get the granite to workThese options did not cost any further moneyWhich brings me back to the underlying issue of the color changeAs for the agreed upon moneyTAS agreed to reimburse Ms [redacted] for the work thus putting TAS Design out of a little over $in labor costsLabor that was completed and providedIn the agreement Mrs [redacted] agreed to pay the subcontractor for the glass shower installation but on two separate occasions told the sub contractor that she would pay them that day but has not done so to dateWe withheld the money from the agreed upon amount to confirm that the sub contractor will be paidMrs [redacted] has been told that she will receive the rest of the payment when the subcontractor has been paid or we will pay the subcontractor from the money withheldAs Mrs [redacted] 's husband stated when I informed him of this he said "the accounting is the same" and this should not be a problem

I have reviewed the response offer made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.MrSetliff is not telling the truthHe was hired for a remodeling job and his work was poor to say the leastI have nearly pictures proving it and some are attachedThe estimates I received all stated it would require more labor to "fix" his poor work since atleast 50% of the tile had to be taken out and replacedI did not invite him back into my home to fix this because it was obvious he did not know what he was doing regarding bathroom tile installationThere were not boxes left over as he statedI have boxes of the shower tiles and box of the floor tilesClearly, this would not have been enough to "fix it" as MrSetliff statedMrSetliff agreed and I have an email to prove it, to meet me at and refund 50% of my tile costs since he ruined it and $I paid him for laborInstead, he took the money he owed me and paid off a $overdue bill with *** ***He then gave my husband supposedly, $in money orders in a sealed envelopeWe have not opened the envelope and do not know what is in itI have spoken to the owner of *** *** and she is aware I have filed with the Revdex.com and DPOR regarding this matterI have agreed to pay *** *** $1883.64 pending the outcome of this caseAgain, the owner and I are in contactThis issue is null and voidYes, I did change the color of the tiles in the bathroom shower and floorI went with a cheaper grade since I have lost so much money due to MrSetliff's negligenceSecond, every time I look at the mess he made, I was always reminded the living hell I have been through with him and his poor workThe bottom line is I can change whatever color I want toIt's my houseMrSetliff's comment was about me changing the color is irrelevantI have had to pay out of pocket for labor and new materials due to MrSetliff's negligence and poor work performanceI am requesting the $labor cost back, $for 50% of the tiles he ruined that I paid for and $to fix the hole in my wall that MrSetliff left while tearing out my shower tilesThis case is currently under investigation by the Department of Professional and Occupational Regulation and I have no further comments at this time

In the agreement Mrs. [redacted] agreed to pay the subcontractor for the glass shower installation but on two separate occasions told the sub contractor that she would pay them that day but has not done so to date. We withheld the money from the agreed upon amount to confirm that the sub contractor will be paid. Mrs. [redacted] has been told that she will receive the rest of the payment when the subcontractor has been paid or we will pay the subcontractor from the money withheld. As Mrs. [redacted]'s husband stated when I informed him of this he said "the accounting is the same" and this should not be a problem.
