filed by *** *** *** of *** *** *** ***, Oakton Virginia:The complaint states that Adkins Landscapes effort included installing mulch, pruning, stump removal, cleanup and hardscape installation, whereas in fact the signed contract only stipulated cleanup and mulchingIt did not include purchase or installation of stones, stump removal or pruning.The contract did not stipulate a day completion timeIn fact, the contract is not specific as to the duration of the effortWe tried to accommodate the customer's needs within our existing spring schedule, which is a very busy time.Our crew did not "just sit down on the street”The customer interfered with our workers' progress and called to complain multiple times that work was not being done properlyWhen this occurred the crew was told to stop until the situation could be assessed by a supervisorIn all instances these complaints were trivial and easily resolved, or so we thoughtFor example, we were blamed for plant damage that was in fact caused by deer eating young sprouts in a bed of Hosta.After mulch was installed in all areas a small quantity remainedThe customer asked that it be placed in an area that infringed on a neighboring property, which we refused to doFollowing installation a major windstorm occurred causing more debris to fall into the yardThese are the sticks the customer is referring toThe customer demanded the new debris to be removed as part of the original effortWe advised that this was an additional effort, and at this point the homeowner demanded we leave the premises and stated we would receive no payment for our workIt should also be noted that the customer also confiscated our equipment, but we were able to recover it thanks to the Fairfax County Police DepartmentI'm George, the owner of Adkins LandscapesI take umbrage and strongly object to the allegations the homeowner has placed against meIn fact I have never personally met this individualI take personal pride in the quality of our work and demeanor of our workers, and never before have they had to deal with such animosity and duplicityI stand behind our record of service and our many satisfied customers which have helped make Adkins Landscapes the quality company it is today.Thank you for allowing me the opportunity to retort..George B

I am rejecting this response because: there is no resolution offered. I completed the work myself. I stand by everything I stated in my original complaint and will not repeat that information again. Adkins Landscaping was paid more than they should have been paid. No weeding was accomplished and that was $500 of the $1500 contract.  So, of the remaining $1000, they were paid $750 for a job poorly done, and one which they abandoned by refusing to complete the work.  10 yards of mulch remained to be distributed on my yard of the 35 yards delivered.  That is 29% of the work. So, assuming everything was done correctly, and it was not, Adkins should have received only $710.  However, the work was poorly done and I had to move about 10 yards off where it had been placed and redistribute it to areas that were bare.   So, even then, $420 (42% of the work) would have been too much to pay.  I paid Adkins $750 and he cashed the check. George, the other owner, threatened me with a lien if I did not pay Adkins in full even though the work was not complete. By the way, Adkins has all of his tools.  I called the police because George had threatened me with physical harm and I was frightened for my safety.  Good thing I called the police because when the police arrived, George had returned to my home and had brought another man with him - and then the police spoke with George and the Fairfax policeman came to my door.  All I need is a letter from Adkins showing they have been paid in full for any and all work accomplished at my address.  With that letter, I can resolve any lien Adkins Landscaping might place against my property.  And, a promise not to file a lien would be nice. I don't want any money back, just the "Paid in Full" letter as a resolution.
