I have reviewed the complaint of Ms [redacted] and it is clearly without merit.Ms [redacted] 's vehicle was damaged in December of 2014.The vehicle was towed to ADL Riverport Auto Salvage, Inc.(misidentified in the complaint as “All Riverport”)We viewed the damages and found damage to the transmission This I reported to Mrand Ms [redacted] when they came to the lot to determine the extent of the damage.At that time, the [redacted] s advised me that they had only liability insurance and they could not afford to have the vehicle repaired on their income and savingsThey further advised that there was a lien on the title for their finance companyUltimately, they decided to leave the vehicle to the finance company.Upon removal of the drivetrain, as required by ordinance, it was determined that the entire faceplate of the engine was rendered inoperableEffectively, the entire engine was damaged and useful for only salvage partsAs a result of my original discussions with the [redacted] s, I requested the finance company to review the extent of the damageAfter their review, the finance company decided that it did not want to pay for the repair of the vehicle and told me to take the vehicle assigned for the value of the tow and storage that existed at that timeAfter the original discussions with the [redacted] s, all communication was with the finance companyIt is my understanding that the [redacted] s defaulted upon their payments to the finance company after the wreck, thereby entitling the finance company to repossess in place, which it hasEven if the finance company had failed to repossess, ADL Riverport Salvage, Inchas a garageman's lien upon the vehicle for storage, which continues at a rate of $per day.Ms [redacted] has continued to harass me about the vehicle, culminating in this complaint, since she abandoned and defaulted upon payment for the vehicle to her finance company and its subsequent abandonment to my companyOnly after she found that the finance company had abandoned the vehicle for towing and storage expenses did she commence her frivolous claims for return of the vehicle, without payment of the towing and storage feesShe obviously is not satisfied with the decision of her finance company, but we have taken all of the actions that we have been authorized to do and after Ms [redacted] abandoned and defaulted to the finance company, she had no further authority or say in the matterFinally, Ms [redacted] 's personal comments about the manner in which I run my company, when she clearly has no idea what the transaction consisted of, are not only out of line, but, frankly, none of her business.her business [redacted]

Riverport salvage reported that the vehcile was transferred but I had to pay out of pocket for that myself and that was not the agreement, the agreement was they (riverport salvage) was going to have it transferred out of my name within a weekHe came to pick up
the vehicle in MarchI had to pay the taxed which was $and also pay to have a duplicate title and also for the transfera total of $I want to be reimbursed

I have documentation showing the payment plan Mr*** set up with us in writing. His statements are untrue. He continuously gave us information stating he was in the process of transferring vehicle out of our name and would send documentation through the mail so that process can begin. The payments were not defaulted after the accident. This man and business gives information and does not do good business. At the time my husband and I went into the salvage yard he clearly stated the only damage was to the front and the transmission and engine were fine - thus the payment plan. We told him we would work on getting payments to him. Regarding the issue of harassment, this is also a statement. I was never able to obtain straight answer from Mr*** regarding the status he would always refer to his title clerk, *** ***, as handling the paperwork

Effectively, the entire engine was damaged and useful for only salvage parts. As a result of my original discussions with the [redacted]s, I requested the finance company to review the extent of the damage. After their review, the finance company decided that it did not want to pay for the repair of the vehicle and told me to take the vehicle assigned for the value of the tow and storage that existed at that time. After the original discussions with the [redacted]s, all communication was with the finance company. It is my understanding that the [redacted]s defaulted upon their payments to the finance company after the wreck, thereby entitling the finance company to repossess in place, which it has. Even if the finance company had failed to repossess, ADL Riverport Salvage, Inc. has a garageman's lien upon the vehicle for storage, which continues at a rate of $25.00 per day.Ms. [redacted] has continued to harass me about the vehicle, culminating in this complaint, since she abandoned and defaulted upon payment for the vehicle to her finance company and its subsequent abandonment to my company. Only after she found that the finance company had abandoned the vehicle for towing and storage expenses did she commence her frivolous claims for return of the vehicle, without payment of the towing and storage fees.
