To who it may concern,The complainant in this case has chosen to use language that is inaccurate and offensive to Adlife, and its President. It is said that the dogs with the loudest barks are the ones that are most afraid. A routine audit of images in our photography
library has determined that usage of our images far exceeds the number of licenses that have been lawfully purchased As a contributor to stock photo sites, Adlife has not been provided with a list of customers that have lawfully purchased the right to use images in its photography library The complainant in this case was sent an Infringement Notice for an image that appeared on a website they owned that was operational on October 21, Subsequent to our notice, the website was taken down, an act we do not consider to be a convenient coincidence to the complainant The initial contact with this complainant stated that proof of proper licensing would help us determine if an infringement had taken place To date, this complainant has not provided proof of proper licensing for the image in question, nor do we have any record of his contacting us to discuss his options for obtaining the proof he so adamantly professes he possesses This complaint to your organization is our first record of contact with this individual In every instance to date where proof of licensing has been provided, Adlife has closed the file In every instance where proof of proper licensing has not been provided, Adlife will exercise the rights granted to it by the U.SCopyright Office to defend its ownership of an image and seek damages for its unlawful use If this complainant has in fact purchased the licensing for the lawful use of our image, the documentation of that purchase is easily attainable; in fact it would have taken less time to prove the image was lawfully purchased than it did to file this complaint with your organization The Infringement Program Adlife is in the midst of administering has been developed with the assistance of several attorneys, all of whom have confirmed its legality and approved the method of contact to possible infringing parties. Should this complainant wish to contact us at *** we will willingly provide the information needed to assist them in obtaining their proof of lawful purchase. If this complainant has in fact used the image unlawfully, Adlife is willing to discuss a settlement offer commensurate with the offender’s means and abilities

Dear Revdex.com representativeI find Adlife's response inaccurateIt makes incorrect statements of facts.One example is the 2nd sentence in their response that incorrectly states "It is said that the dogs with the loudest barks are the ones that are most afraid." I did "not" make that statementI quoted one of the postings online that best describes these casesI made sure that the quote does "not" include such emotionally worded contentI double checked myoriginal Revdex.com complaint statement, and do not find the words "dog" or "bark".I did include a few internet links as evidence for Revdex.com to see that this is not an isolated incidentThis is widespread issue, reported by others on the web. I decided "not" to engage on Blog discussionsInstead asked for Revdex.com to help resolve this issue.Again, we have no commercial website using Adlife pictures, and have never had any income directly nor indirectly related to such websites.Adlife should produce specific evidence of why they feel my wife knowingly and willingly used and profited from Adlife picturesAlso justification of how they came up with their $8,figurePleasesee the copy of the invoice, attachedIf you Google "Adlife $8,000" You will see more of such invoices.They should stop harassing us with inaccurate invoices sent using the US mail.Revdex.com:

I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # [redacted]. 
First, Revdex.com please note that in the company's initial response, 2nd sentence, the company wasactually referring to me as a consumer contacting Revdex.com using the word "dog" and my complaint as "barking". That probably needs addressing by Revdex.com.Second, regarding Adlife's allegations of infringement, I am requesting the following:1) A comprehensive list of any and all images for which Adlife alleges copyright infringement by my wife.2) Copies of Certificates of Copyright Registrations for each Image, together with copies of the corresponding Deposits with the U.S. Copyright Office3) A list of all licenses granted between 1999-2003 for each Image.Contrary to the Adlife's 1st response to Revdex.com that I had not contacted them earlier, please note that I did call them using a "landline", and left a message with my "Cell" number to get back to me. Adlife called me on my "landline" couple of hours later and we did discuss this.

Adlife Marketing is in the midst of an internal audit to verify proper licensing of our extensive prepared foods photos library. Adlife, as a contributor to stock photo sites, has not been provided with the list of who proper licensing has been granted to.  Our investigation has determined that...

usage of our images far exceeds what we can determine to be proper licensed usage.  The process and methods Adlife uses to contact possible infringing parties has been developed and approved for use by its attorneys.  The complainant in this case was notified of our inquiry into the proper licensing of our images.  Further investigation into the history of communications with the complainant has determined that proper licensing is in fact present in this case.  The fact that the existence of proper licensing in this case was not forwarded to the appropriate individual was an oversight.  Adlife apologizes for the oversight and has closed its inquiry file on this case. The complainant, like hundreds of other companies and organizations, will no longer receive any communications on this matter.

It is the position of the courts that the Digital Millennium Copyright Act is in place to allow for the protection of intellectual property rights.  The evidence in this instance shows the complainant owned a website that displayed an image owned and copyrighted by Adlife.  The retraction of the website from publication subsequent to receiving our inquiry with respect to the licensing of the image does not negate the potential liability of infringement upon those copyright protections.  If the complainant lawfully purchased licensing we simply ask for confirmation of that purchase.  If the complainant unlawfully displayed the image on their website than there is the chance an infringement has taken place.  This is not the venue for the adjudication of this matter.  The complainant has been provided with the necessary contact information to discuss and resolve this matter directly with the Adlife Licensing Department.
