To Whom It May Concern;The complaint filed by customer ID #is totally falseThe true facts are as follows:1.? The? sod installed on MSID #yard was pristine and beautifulThe sod contractor actually took pictures of the sod on day of installation which verify this fact The sod for her yard was delivered on the same load on? the truck? that delivered sod for two adjoining lots on the same day.? The adjoining lots were watered and both have healthy green sodBoth MsID #and her real estate agent were notified that she needed to water her sod immediatelyHer purchase contract specifically states that the buyer is responsible to water the sod immediately upon installation and gives specific instructionsThey were notified on the day the sod was laid and the following dayShe ignored all notices? and the? contract? and allowed? her sod to die from lack of water.? In view of the documentation we have to confirm the sod was alive when laid, it is difficult to believe any of Ms [redacted] ’s stories about her neighbors.? ? 2.? The grading of MsID #yard actually exceeds grade standards in the City of Kansas City code for yard gradesMS [redacted] attempted to get the City to reverse their approval? of the? grade and rule that the grade did not meet code standards, even though? it passed? inspections and a final occupancy permit was issued.? She was so aggressive that the codes employee referred the matter to the Inspections Supervisor, who then personally inspected the grade, made measurements and took picturesThe Supervisor reported that “there is NO violation of the code in reference to the grade that abuts the patioI measured the worst spot and the grade only drops 18” at three feet outCode allows a 30” drop of the grade at feet out before a guardrail is required”The report is in? the City? records.? We have received multiple awards from the HBA of Kansas City for homes on the citywide Parade of HomesThe awards include “Pick of the Parade” and? “ American Dream Award" and "Distinctive Plan and Design"? MsID #alsotried, without? success, to? have us? expelled from the HBA.4.? It has been an unpleasant experience building a custom home for MsID # 12225746, Throughout the process she sent me continuous texts and telephone messages criticizing me and our work in vulgar and slanderous languageI have saved many of those messages in anticipation of conflicts at a later timeIt became so bad that I blocked her calls and texts and told? her that? I do not accept his response because he is giving statements The sod I'm not even worried about It's the grading and the way he left my backyard When I purchased the lot he told me it was going to be a flat yard with a slight slope like my neighbor behind me It's not!!!!!!! I paid extra for a larger patio and asked if it not flat let me know He responded with , it will work My realtor was there every time we spoke She even told him and *** *** now this is going to be flat My realtor still tells them, you said it was going to be flat They lied obviously! Because he put $in escrow for a wall If he knew it was going to be flat why would he put that money in escrow! I can not use my yard for family or entertainingSomeone will roll down the hill or fall and hit the wall if they come off the patio My granddaughter already did I did call the city inspectors not to change his findings but to ask why and how it passed I asked Carl Spahn if he would want that backyard and he responded with noBut he doesn't live there Mr ***t, *** *** and Mr Spahn said to tell people to be careful and put a railing around my patio That's unacceptable!!!!! It's his mistake on not grading right the first timeIt may have passed code but that is not what I was told I asked him what if I put a deck on instead He responded with I'll take out the patio but I will not put a deck on I paid extra for that patio I asked to speak to the supervisor because I wanted answers I was not rude just asked questionsThat's my right! So was so wrong of Mr ***t to even state that I was aggressive He is not going to attack my integrity or character I have every text message that I sent him Yes, I said I was going to contact my attorney and I did But he recommended that we try to work it out first before I take action I did not threaten him I just told him the truth about contacting my attorney He made major mistakes that I had to compromise on 1- He did not extend the back of my house and did not tell me until I spoke about it being small He then offered to make my wall bigger in the basement to compensate for that mistake I agreed!!!!! He put the faucet in the wrong place outsideHe added another one but did not disconnect the other faucet like he said he would Still waiting!!!!! The backyard......a nightmare My yard is the topic of conversation with all the neighbors He has even gotten in arguments with neighbors over my yard They are upset because they have to look at it everyday I know at least families that I spoke with that have had complaints and disagreements with Mr ***t He may have acclimates and awards but what about character I contacted landscaping companies and they said this is unacceptable that he left this the way he did It will cost alot of money to fix it Money I don't have! I don't want money or beautification I just want it fixed right So I can use my yard and not just look out door and window I am truly disappointed that he would attack my character like he did I spent $15,extra on this house I have every signed up grade and check stub for proof I recieved nothing for free I paid for everything I did not try to get him expelled from the HBA I just called them to help me out but they were the ones who told me to contact the Revdex.com and the Attorney General Also to contact a mediator Not do destroy his reputation I am a hard working woman, mother and grandmother I just want my house to be what I thought the finished product would be I don't deserve to be put through this with deformation of character How can so many in this sub division be so wrong and *** ***t, homes always be right???????
