** *** adopted *** back on Oct 14, and from that day until Dec 3 he communicated to me via emails that I still have that *** was doing great, he even sent pictures of ***Then on Dec 3 he contacted saying that *** was aggressive towards people and other dogs which we never saw during his stay at my vets where he was being boardedI did inform him that *** wasn’t good with small dogs but fine with big ones*** *** said that *** bit him so I told him to bring him back to me and that I would evaluate him and if he was people aggressive that I would have to put him downHe wasn’t willing to bring him back to me because he couldn’t afford the time off to drive him back so he turned him over the local animal shelter which against the contact that he signed
*** was determined by my vet that he was 2yrs old see email below along with the rabies certificate attachedThe one other paper work that I gave him showed that we gave him the other vaccines that he needed but the vet tech printed the vaccination info using the record of the last Saint they there and forgot to change the age from to 2yrs oldI told *** *** this but he didn’t want to listen and I told him that per our contact he had a week grace period to return him to get a refundSo based on the info I have provided I will not be refunding his adoption fee

*** came into my clinic on 8/1/14. I examined him and found him to be about years old. When he came in he had some skin problems related to fleas. We treated the fleas, put him on antibiotics and it all cleared up. When he left our clinic he was in good health and appeared to be a normal, happy boy

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.[redacted] doesn't have her facts right and I totally disagree with her statements.  I have copies of emails proving otherwise.

Review: I adopted what I believed to be a 2 year old Saint Bernard male dog named [redacted] from this organization in Oct 2014. I signed a contract that stated he was 2 years old and there was also a clause in the contract stating that there was a 2 week return period should something come up.Well fast-forward up to present and when my vet saw [redacted] she immediately said he was not 2 years old and said he was more like 5-5 1/2 years of age. She repeated herself multiple times. Once I got home I began to review [redacted]'s paperwork that [redacted] provided me along with the contract and noticed that there was a paper from [redacted] vet stating that [redacted] was 7 years of age and his birthday was 09-11-2007. When I reached out to [redacted] she told me that she would not refund me my $400 as per the two week return policy clause in the contract and also stated in an email that the age listed on the vet paper was a type-o. [redacted] also started becoming agressive with my neighbors and other dogs and my landlord told me that I would have to return him. [redacted] told me that if I brought him to her then she can't re-home him and would euthanize him at her vet in Tustin, CA. I asked her what my alternative would be and she said I could take him at my expense to be put down here in Bakersfield. Either of these were not acceptable to me.I mailed [redacted] a certified letter on 12/10/2014 explaining that I want my $400 back because a contract is either valid in full or it's deemed null and void. I went on to tell her that type-o or not this paper should not have been in the supporting documentation provided to me when I signed the contract. Because this paper contradicted the age of the dog in the contract I feel that I should receive my money back.Desired Settlement: I would like my $400 adoption fee returned to me.
