Last fall I switched propane suppliers (from *** to ADR Fuel Co.). *** was bought out by *** last year. ADR had a much better price. ADR Fuel is owned and operated by *** out of Tontogany. I purchased 1,100 gals. at $1.29 for a total of $1,521.88 incl. sales tax (this was pre-buy to guarantee the price for the 2017-18 heating season). I always purchased more than my projected use to protect the price, assuming any remaining balance would be refunded upon request. Normal industry procedure is the $1.29 would be good thru March 31. You could not carry over the gals. at that price after 3/31(propane prices vary a lot from year to year). Any remaining balance in the account as of 4/1 would revert to a cash balance. Pre-buy is only available for a couple of months prior to the heating season. I ended the current heating season with a cash balance in my account $846.72 and *** will not refund this money. I have a copy of the Invoice for the $1,521.88 pre-pay from ADR Fuel (there never was a contract or any other documentation) and I paid with my check #***, dated 9/8/2017. Let me give you the whole story in chronological order.
In July of last year *** (*** subsidiary) offered pre-buy for $2.19. That was up from $1.49 the prior year. I found out that ADR was offering it at $1.29. ADR's invoice clearly shows it was 'Pre Buy'. I told *** that I would no longer be their customer and requested a refund of the cash balance in my account ($578.40). *** sent me a check for that amount on 7/6/17.
I received my first delivery of 370 gals. from ADR on 12/15/17.
Then on 3/16/18 *** delivered 196.30 gals. by mistake. I was disgusted to get a ticket for the delivery and at a price of $2.19. I did not order it and told them I was not paying for it, just come and pump it out. It turned out my underground tank was not equipped with the proper plumbing to pump out. They ended up apologizing for the error and giving me the propane.
Then on 4/3/18 ADR filled my tank, but it only required 118 gals.
That leaves me with a cash balance in my account of $846.72. I tried to contact *** several times by email and by phone. I have a copy of an email dated May 1, 2018. On May 29 I managed to get him on his cell phone. Very disappointing call. He said they do not offer refunds. He said I contracted for 1,100 gals. of propane for the heating season and did not take it. I told him that was not my fault that *** had made a delivery by mistake. Further, that the industry practice was to convert the balance in the account to dollars at the end of the heating season. I told him that he could not just confiscate my money - I was due the $846.72 refund. If he did not comply, then I would take legal action to retrieve my funds. I think I stand on firm ground morally and legally in demanding a refund.

Refund Want a refund of the balance in my account, $846.72. Will be moving in a month and will be on natural gas so can not accept future delivery of propane gallons. Don't want to cause Mr. trouble or be forced to file legal action against him. This is *** with ADR fuel. I am contacting you in regards to the dispute with ***. Mr. was only a customer this past winter, for which he pre purchased 1100 gallons of propane from us. We delivered 684 gallons to him throughout the heating season. Toward the end of winter we received a voicemail from Mr. in which he told us that his previous propane provider had filled his tank without his consent, and that he wanted us to refund him for his contracted winter gas. However this is against our policies. Our customers are expected to understand their propane usage and pre purchase accordingly. In our opinion the fault lies with either Mr. for not effectively communicating with his previous provider, or his provider for not discontinuing service for Mr.. I have been purchasing propane from various suppliers using the "Pre-Buy" option for many years. All have followed generally accepted industry practice for "Pre-Buy". You purchase a given number of gallons in the summer at a fixed price, and then you draw down the gallons during the heating season. At the end of the heating season (3/31) the account switches back to dollars (original purchase price X gallons not delivered). Balance in the account is refundable upon request. If you run out of gallons during the heating season you have to pay current delivery price. That is the reason I pointed out the way ***, one of the largest propane distributors in the USA, handled it during the previous season. ADR Fuel neither verbally nor in writing disclosed that their policy deviated from generally accepted industry practice. Further they did not deliver 684 gallons to me as stated in ADR's response. They delivered 488 gallons (on 12/15 370 gallons and on 4/3 118 gallons). 612 gallons were not delivered and when converted back into dollars is $846.72 incl. sales tax. I filed in Sandusky County Court No. 2 - Woodville (Small Claims) on June 27, 2018 to recover the balance in my account plus court costs. The hearing will be held at 10:15 AM on 7/23/2018. When I tried to contact ADR Fuel to resolve this situation, they simply ignored me.
