Dear Revdex.com,I have since decided to move forward with repairs of the vehicle from a third party and will be seeking compensation for the costs associated with the repairs of the Subaru Outback in small claims court.Please note:1) I relied upon Advanced Auto Sales communication to me that the vehicle was a, "very clean car inside and out and runs great." as well as the claims that, "Every car sold receives a comprehensive mechanical and safety inspection so that you will enjoy years of reliable service.” posted on their website, as well as a pre-purchase inspection and test drive in my decision to purchase the vehicle.2) Although the vehicle passed MA inspection, that fact does not speak to the performance of the vehicle I understood to be purchasingI believed I was purchasing an All Wheel Drive vehicle and it has yet to function properly as advertised by the seller and manufacturer.3) It was communicated to me by Advanced Auto Sales, when pointing out the symptoms I was experiencing with the vehicle, that all makes and models of this kinds perform the similarlyHowever the following day, it was discovered there was a "faulty duty selenoid." 4) At NO time was work order presented to me as requested prior to ordering partsNO authorization was given to me to proceed with repairing the car, verbal or in writing.5) The fact that the dealer claims work was done prior to me taking possession of the vehicle should hold no bearing on any further uncured cost to the dealer, as that work was agreed upon by both parties PRIOR to signing the Used Vehicle Purchase Contract

Dear Revdex.com,I apologies for the late second response I was away for personal family reasons.As you can see, we have been cooperative from day and these are the responses we receive.At no point have we refused to do the repairs.We already ordered the parts and have them on hand.We where more then willing to perform the repairs however she refused after she dropped the car off and we ordered the parts.We are still willing to do the repairs with a more cooperative customer.We do not give any authorizations for Lani to do the work at any other shop.If Lani chooses to go ahead with any unauthorized work she will be doing so at her own expense.Thank You,***

Dear Revdex.com, As stated in my previous correspondence, I will no longer discuss my grievances through the Revdex.com and will pursue other methods of seeking compensation for damages caused by Advanced Auto Sales & Repair under MGL 93A Section 9.

Dear Revdex.com,Please find our response.*** *** Came to us on 1/27/to view a *** *** Limited with 131,miles.*** took the car to *** *** (a *** dealer of her own choosing) for an inspection before she purchased the car.After the inspection, she requested to replace the
Timing Belt, Head Gaskets both sides and a valve cover gasket (All Preemptive maintenance) before she takes possession of the car.We did all of the above work as *** requested, work valued at over $2000.00.*** Picked up the car on Saturday 1/30/2016On Sunday 1/31/*** contacted us that she went to NTB and performed an alignment.*** stated that NTB told here the car needs a new differential and transmission due to a minor shutter when she turns the wheel all the way and that she was going to return the car immediately.From her first contact, *** began to make accusations and reference Mass law.We promptly and cooperatively answered her and asked to bring the car to us to inspect so we may have an educated conversation with her on what is happening with the car.On Monday 2/1/*** contacted us again stating that she decided she was going ahead with the registration of the car and that she is going to take the car to IRA *** for further inspection.That same day Monday 2/1/*** took the car for a state inspection at an inspection station of her choosing (*** *** *** ** ***) where the car passed all emission and safety inspection. On Tuesday 2/2/*** contacted us with a report from IRA ***s' finding a failure with the *** *** in the transfer case that is causing the shudder when the steering wheel is turned all the way and recommended repairs.The report also states that they performed a full safety and emission inspection and the car passed every one.At the same time, along with the report *** proceeded with more reference of *** and threats even though we have been fully cooperative and responsive.Promptly we responded to *** that we received her report.The report did not include any mechanics notes or tests performed at IRA *** in regards to the *** *** so we requested them, the same vague information that there is a failure was provided again with no notes. Again we made another request to bring in the car to inspect as it is our right to inspect the vehicle and perform repairs.We need to inspect the car because in a day period *** stated that its the transmission, then differential, and finally a transfer case that is causing the problem.We spend the following days fully cooperative, fully responsive, going back and forth urging *** over times to bring in the car so we can inspect it as it is our right to do so.In those days *** again referenced more *** and more threats even though we where prompt to answer her every contact and had been fully cooperative. Finally on Tuesday 2/9/2016, days after the initial contact, *** brought the car to us at 3:45PM. We test drove the car with *** however the car was driving perfectly because *** could not describe the exact situation that causes the car to shudder to replicate the shuddering.*** told us she is leaving the car for repairs and rented a car on her own accord.*** Stated that she will have the rental car for a full days so we can take our time to finish the repairs.*** also stated that it was inconvenient for her to bring the car before that day 2/9/2016.The car had cases of Dog food and what appeared to be gardening items in the back that she took with her.On Wednesday 2/10/we performed a diagnostic on the car, confirmed a faulty *** *** that is causing a shudder when the steering wheel is turned all the and the car is reversing.We where able to replicated the problem, the car shudders when the steering wheel is turned all the way and the car is reversing.We ordered $worth of parts, all the parts that where recommended by *** even though its only the *** *** that is faulty.We contacted *** to give her an update of when the parts are expected to come in and when we will have the repairs finished by as discussed when she dropped of the car.During the conversation *** all of a sudden was not comfortable with repairing the car any more, she needed time to think about it, this is after we had placed an order for the parts.*** then refused for us to perform any repairs after the parts arrived referencing more *** and more threats of lawsuits.so we respectfully asked her take the car if she does not want us to repair it.CONCLUSIONWe allowed *** to take the car for a pre purchase inspection at a *** dealer of her choosing. We replaced the timing belt, head gasket, valve cover gasket based on her request prior to finalizing the purchase. The car passed state inspection first time at a place of her choosing.The car passed times, on separate inspections for safety and emission conducted by *** at places of her choosing, of which are *** Dealers.At no point did we deny the existence of a problem.At no point did we refuse to repair the problem.We have cooperated with her at every point. We promptly responded to all her contacts every day of the week at all hours of the day.We urged her over times to bring the car to us.It took her days to bring the car to us because it was inconvenient for her to do so.We ordered the parts to fix the problem.We have the right to repair the car.We have been threatened by *** at every point in our communications when we have done nothing wrong and have been fully cooperative.
