Advanced modular homes promised delivery of my house in eight weeks after my deposit of $25,000. It has been well over four months since I’ve given them that deposit. From the beginning advanced modular homes i.e. Roy F have not met one due date that they have promised me although they have taken the money requested at the time of that promise .

I did order a house for *** on 7-30-19 with *** I did ask the factory sales rep. at that time what was about the production time he did tell me that at that time is was about 8 weeks. I am a independent builder of *** modular homes, the factory reports nothing to me until the house is ready for delivery unless their is a problem or a change order. I don't know anything that going on in the factor. I don't make promises as stated by *** I only repeated to *** what I was told by the factory sales rep at that time Ed has been to the factory a number of times to see the progress of his home on the production line. Ed asked about delivery of his house the factory rep. told me that he did not make the delivery or set dates the only person that does that is ***s I have no delivery dates for delivery or set of any modular home in my contract as we were told only *** himself sets delivery dates and set dates and that weather permitting. as of now today ***s has set a delivery / set date of 1-6/7-20 weather permitting. ***s did tell me just weeks ago the problem was the factory had 9 order come into the factory at once Bill told me that the only fair way for him to handle that was to build them and deliver them in the order was received. Which I never new about until about two weeks ago I did try to get ***s house delivered & set on 12-19-19 but ***s said no their was a house that came off the production line about two weeks before his and would be delivered first. then with the holidays the factory & crane have road restrictions and cur-fews for heave construction equipment and wide loads.

Asking for more time is exactly why Advanced custom modular homes (Roy Fowler) and myself are in this position. I need Roy F to reply to my request of settling this matter with the offer that I have made. If his company accepts my offer we can close this case. If not we will proceed under the recommendation That the Revdex.com suggests.

I, Roy F, of Advanced Custom Homes, 870 Hoosick Rd, Troy NY, have been working with *** for months designing and pricing out his new modular home. We agreed on a price for his new modular home and I drew up a contract with a scope of work describing what I would be responsible for so there would be no mistakes.

I told Ed that I put everything in writing or a change order will be written after the contract has been signed by both parties. After his bank closing, I received a check from *** to order his house on July 8, 2019 for $23,235.00. I wrote a check to *** Modular Homes to order ***’s house. At that time, I asked my sales representative at *** Homes how far out was production and the sales representative’s reply was about 8 weeks. I only repeated to *** what I was told. I never made any promises or dates. I have been in business much too long to commit to dates. In the construction field there are too many variables.

From the time I turn in a deposit check to the factory to order a customer’s modular home, I am not notified of production status unless there is a problem or a change order. *** & I did do a Change Order for a Farmers Sink.

*** is fully aware of the process. As time went by we found out that ***’s house wasn’t going onto the production line until September 16, 2019. *** did complain a lot and ***s offered to return ***’s deposit. *** decided to have his house go onto the production line and at that time he knew that his house wouldn’t be coming off the production line until the middle of November, if everything went OK.

*** visited the factory during the production process and he also sent me pictures of his house.

Once ***’s house came off the production line it is again up to ***s to schedule delivery of the home to the site, schedule the set crew, and the crane. Ed didn’t like the time frame that ***s had open with the set crew & crane and *** told us to keep the house. ***s spoke to the set crew/crane company and they moved another customer’s house around to create an earlier opening for ***’s house set. Ed told us to keep the house; he didn’t want it. Ed lost that delivery date.

The house ended up being delivered and set on January 6, 2020. I gave the option of finishing/completing all finish work on the modular home to him or his own contractors because Ed stated he had contractors he used in the past and he liked their work and wanted to hire them himself. *** agreed with that and I signed a letter turning over the responsibility of completely finishing the modular home to ***. *** was credited back $14,000.00 from the contract price.

Bottom line, *** ordered a modular home from Advanced Custom Homes and the house was ordered and delivered. There are no dates in the contract for delivery. It is the responsibility of the customer to provide housing and storage for their personal items during construction of their new home.

To whom it may concern, Roy F was NEVER told by *** or anyone in his business that my house would be 8-9 weeks from when I gave Roy F my deposit. Roy F of advanced custom modulars made that time frame up to get me to give him my deposit. This false information from Roy F is advanced custom modular homes cost me additional money and led to other problems on my end. If I had been given truthful information from Roy F of advanced custom modular homes I would not have ordered my house from him. my proof that discredits Roy F of advanced custom modular homes is that he gave me information that was not true. It was a lie to get my deposit. No one from *** stick built modular homes have Roy that information. If they did Roy F would be able to provide an e-mail or other proof.

I am experiencing the same thing as ***. I put a deposit on a new home for myself in Brunswick NY in June 2019 and was told that my home would be ready in Sept 2019 but that never happened because the builder had problems getting permits from the town. Then we were told by the builder that we would be closing in December 2019 and that didn’t happen, then it was to be finished by the end of February 2020 and that’s not going to happen either.
I also have incurred expenses due to the delay in construction of my new home. This has been a hardship on us staying in a basement with no kitchen, paying for storage of our personal things, living out of cardboard boxes for about 8 months. My builder hasn’t paid for any of my expenses for storage, etc. while they are building my home. It is my responsibility and I wouldn’t expect the builder or anyone else to pay for my expenses during this time. I know it is the homeowner’s responsibility to pay their own expenses while their home is being built, not trying to pass their expenses onto someone else.

Roy F latest response tells the entire story. First, I did not give Roy F the $23,000. check until he promised me in front of my witness Dina *** that the house would be off-line in 8-9 weeks from the day I gave him the check. Otherwise I would not have given him the check, and he knows that. I would have stick built because it was early enough in the summer (July) for a construction team to start and get the shell up before winter. Second, Roy did not credit me $14,000. Roy was never given the $14,000. from my bank because he never did the work. Roy never got the permits from the town for the driveway, I did. Roy never got the permits for the building of the house, I did. Roy never got the permits for the septic, I did. These items were supposed to be done by Roy F per the contract, it is public record that I applied for and received these permits because Roy was not doing it. Roy waived the $14,000. because he stated in a phone call to me that he could not promise a start date on finishing the site work because he couldn't find contractors. I hired all of the contractors myself and had the work finished in a month. I have supplied numerous facts and documentation on how Roy F has been dishonest and very misleading throughout this whole process. Roy F only defense is that he did not put on paper a promised delivery Date. But the documents that I have given and the public records from my bank and the Town of Brunswick show my story to be 100% factual and that Roy has been dishonest and misleading this entire process. This type of poor business from Roy F has cost me Thousands of dollars and created more stress than anyone could have anticipated because of his dishonesty. Thank you, Edward J. King
