I don't know how to respond to Advanced Exteriors fabricated story with only bits of truth which were then twisted to justify their actions or lack of Unfortunately am unable to attach any files or pics using my tablet but I assure you I have all the proof needed to support my claim and to disprove their ridiculous lie filled claimMy claim is legit and very warranted against this company and the complaint shall not be removed or unpostedFurthermore I have contacted a lawyer which he agrees I am in the right and I plan to pursue this legallyMy original remedy to this complaint still standsAll I want is for warranty repair due to either improper application and/or a faulty product that cracks and blisters and doesn't do much of what it is claimed to do"Never paint again", ha, that's all I had to doAnd just honor the contract and stop trying to get more money from me.
Also I need to mention that someone from Advanced Exteriors tainted some of the left over paint they left me so the color wouldn't match and I could not do my own painting, pretty low and unprofessionalI will need extra paint out of all this too because I am sure I will need it

We love our windows they clean very easy easy to take care of and all the installers were wonderful and good The salesman Stephen J*** was very helpful and kind

They did not solicit me, I solicited them because of a friend referral who was very pleased with their workMy crew leader *** and *** were very professional, respectful, and so hardworkingI was impressed with how hard they workedMy house looks beautifulI would say it was probably one of the hardest situations they have ever had to deal with because I live on a hillside where they needed at least four stories of scaffoldingI would definitely recommend this company

The contract I have on handBut in order to get you a copy I will need more than days
Also the original contract amount and services have changed since the contract was signedAdvanced Exteriors has not updated or amended the contract at all*** from Advanced Exteriors took
notes on everything and that is all he has to go byThey don't have computers and have poor record keepingAnd as I stated before we had renegotiated the final payment over the phone so there is no renegotiated contract or record of that except my notes.
The point is the extra charges he wants to us to pay that we have invoice saying no charge forSo the arguement is not the contract but the final invoice and his tack on charges to get warranty repair.
How do you want copies, via email or postal mail?

Took time off work since Advanced Exteriors requires both husband and wife be present The day of the appointment, the owner called and said he was running late Later when he was going to be so late that my wife had to leave he used a variety of reasons to cancel the appointment Now they say they will not come to our neighborhood because it is unsafe This was with approval with the Rhino Shield product maker They have decided which neighborhoods to chose and which to discriminate I later found that the secretly record their conversations with customers in violation of California criminal law Read their Yelp reviews, many bad reviews with the same themes Not sure why the Revdex.com would support them

San Diego, CA 92123-SUBJECT: Response to Complaint - ID #***
To Whom It May Concern:
*** *** President of Advanced Exteriors, called your office in regards to this case and has requested that a mark not be posted against Advanced ExteriorsThis customer was not entitled to any warranty work because his balance has not been paid in full as of this dateThe customer has done deceptive practices with Advanced Exteriors' employeesAdvanced Exteriors should not be harmed by the Revdex.com by posting this invalid complaintWe were requested by one of your employees to put this in writing for management of the Revdex.com.The following is our response to the complaint involving contract disputes:
The contract was signed on 6-22-for $9,Work was completed on or about 9-1-The following payments were received:
$1,on 7-10-- check #***
$1,on 7-27-- check #***
$1,on 8-11-- check #***
The remaining balance was then $5,which the customer refused to payIn addition, he wanted a credit for the poly rock he decided not to put on his house, which had a value of $We made him a one time offer that if he would pay the balance, we would give him a $1,credit for the poly rockThis left a balance due of $4,We received a check for $4,on 3-16-The balance remaining was $
When the customer requested service on 5-2-12, *** *** inspected his house and learned that he had quite a bit of extra work that was done by Advanced ExteriorsThe customer made a secret deal with our employee to do this additional work and pay him 'under the table'This extra work consisted of:
o Installing 48' of foam around window and garage door - $
Fill the drip edge with cement - S
o Wood Removal - $
Wrap stucco - $
o Disposal of materials - $
At that time, *** *** told the customer that he would have to pay for the additional work that was done on his house, which was estimated at $2,This was in addition to the original contractUpon further investigation and discussing the 'under the table' work with our employee, we learned that he actually provided $2,in additional labor and materials. The customer had called the office and confused an Office Assistant that the work performed was done at 'no charge'An invoice was then sent out on 2-17-showing 'no charge' for the additional work and a $1,500 credit for the poly rockThis was inaccurateMr***, upon going out to the customer's house on 6-2-12, told the customer that he owed $2,plus $and no additional service work would be done until the balance was paid in full
The problems that the customer had called about (i.e., cracking in the trim around his windows) were not covered under warranty because it is a window problem and not a coating problemThe customer had new windows installed on his house
The customer, we believe, was deceptive with Advanced Exteriors and paid employees to perform work outside the scope of the original contract with Advanced ExteriorsThese monies should have been paid directly to Advanced Exteriors and not paid to our employeeThe customer also called our office and confused our employees as to what he was and was not financially responsible forWork done but not approved by Advanced Exteriors or paid for by the customer violates and voids the warranty.
Mr*** went to the customer's house and explained to him what was and was not covered under warranty and what was due to Advanced ExteriorsTo this date, we have never received full payment for work doneNo additional work will be done on the customer's home until full payment has been receivedEven though the warranty has been voided, we are willing to provide service work as a courtesy once full payment has been received.
The check that he claims that he sent for $was never cashed by Advanced ExteriorsIf he has proof that this check was cashed, we would appreciate a copy of this for our records
Advanced Exteriors has been patient and courteous with the customer but our patience has run out and it is our intention to file a lien on his property as well as taking any legal action the law provides to recover monies owed.
Respectfully,
*** ***
Office Manager

In short, I hired this company to paint my home with their patented 25-year warranty ceramic-coatingI was less than satisfied with the actual service in direct relation to the high cost, however, my complaint is not regarding the actual serviceApproximately months after the service was completed, the company solicited me for a review of my experienceI emailed the owner directly and informed him that I was not satisfied with the value received, and that I would write an honest review online sharing my experienceI posted an honest and subjective review specifically pertaining to my perceived value of this service on *** and *** List
The basis of my complaint is specifically in regards to what happened nextThe day after my reviews were published, the owner of the company arrived to my home uninvitedMy wife told him I was not homeHe then arrived at my place of work, where he pleaded his case and requested that I remove my reviewI told him my review was justified

The reason we have been so successful, over a 50 year period, is because we...

hire the best employees and use the number one product available in coatings.
The Crew Leader who worked this particular job, has been with the company for over ten years and has done hundreds of jobs with customers giving him the highest praises and saying he is one of the hardest workers they have ever seen. The crew also has a reputation with the company and our customers of being one of the hardest working crews in the business and with one of the highest rate of satisfaction from our customers.
The Crew Leader and his crew started the job on 9.21.2015 and finished on 10.12.2015. We were working on the home for a total of 15 work days. The customer had stated that to the Supervisor, sometime after the job had started, that The Crew Leader said he would be done with the prep in a couple days and he was not satisfied. At that point we got the attention of the President of the company, [redacted], who went out to the job with the Supervisor to see the customers concern. This supervisor has been in the painting business for a very long time. He is a retired union certified painter with 40 years plus experience. After walking around the job, [redacted] saw that the crew was still in the middle of doing the prep work and had informed the customer that there was a misunderstanding of when he was to be done with the prep. After listening to the customer and reviewing the job with him, it was clear to us that the customer did not have a clear understanding of the procedure and steps necessary to do this kind of work in order to meet the obligations of the contract, and factory procedures. This particular customer was asking us to caulk areas that would trap water and cause wood rot and mold. He was also expecting restoration type work (I believe he works for a restoration company). His contract does not call for restoration type of work. Nonetheless any concerns that the customer had, were addressed to meet the requirements of the contract and [redacted] requirements.
We have a completion certificate, signed by the customer for each four steps in the [redacted] installation; 1.Trenching and Hydro-Blasting 2. Preparation Steps 3. Primer Application 4. Final and Clean-Up Completion. In each box it states: ALL WORK HAS BEEN SATISFACTORILY COMPLETED ACCORDING TO THE TERMS AND CONDITIONS OF MY CONTACT. The crew leader also stated to the company that at the final signing of the completion certificate, [redacted] stated that he was happy with the work and that nothing else was needed to be done and his wife had stated that the home looked “incredible”. The customer even stated in his [redacted] review that he expected “flawlessness”, I don't know exactly what that statement means to its entirety but I do know over 50 years, we have had thousands of satisfied customers and if/when we make a mistake, we have been known to go above and beyond contractual obligations. The company has been in business 50 years plus, it is a multi-million dollar business per year with thousands of homes completed and all customers have signed a completion certificate of satisfaction.
After reading this customer's review, I decided to re inspect the house to see what this customer was concerned about. After multiple phone calls and emails that were not returned from the customer, I drove to his house, inspected from the street, then rang the doorbell and spoke with the wife. requested permission from the wife to inspect the entire home. After she granted permission, I observed that the prep work and the coating met expectations of the contract and the home was in great condition which left me confused in regards to this customers review. The only problem on this home that I observed was on the front where they installed new driveway pavers and ruined the coating 5 inches from the ground on the wall.
At our office, we have hundreds of letters that consist of gratitude for meeting and/or exceeding customers' expectations. The Crew Leader, in over 10 years and hundreds of home, has yet to have a dissatisfied customer.
This particular customer had stated to the Crew leader, towards the completion of his home, that he could have had a friend do the job for half the price. It seems the customer had forgot the difference being the crews experience in preparing a home for the [redacted] installation and the fact that the [redacted] Coating is an exclusive product for Advanced Exteriors, that is independently tested, tough enough to last 25 years plus and is 8–10 times thicker then regular paint.

Our large 1920's era 3 story Spanish style house badly needed stucco repairs and house painting. We selected Advanced Exteriors, the Rhino Shield agent here in San Diego. They were expensive and took longer than expected but we blame both on the poor condition of our house - there were no hidden or add-on costs. In retrospect, we don't regret the time or money. Excellent work by skilled, meticulous workers. Extremely personable management, office and frontline workers. Very pleased with the outcome. Advanced Exteriors is highly recommended.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. The response by the business is a "cut and paste" of their reply to my [redacted] review online. Their response in no way relates to the specific stated basis of my complaint with the Revdex.com, pertaining to the business owner's unethical attempts to threaten and bully me in an effort to manipulate his online reputation. The response by the business attempts to defend, ex-post-facto, their product and advertised service. They claim, truthfully, that I signed a completion certificate admitting satisfaction to the completed service. This is correct. Their response mentions some truths, and some fallacies, however, it is grossly irrelevant to my complaint. My complaint with the company is wholly unrelated to the final product. My initial dissatisfaction with the business, and the basis for my original online testimonial (posted only after being solicited by the business to share my experience), was a gross disparity between their advertised practices, and my perceived value of their actual practices in relation to the very high cost. In simple terms, they oversold and under-delivered, and it took active participation on my part to correct their mistakes and ensure that the final product was to my satisfaction. This is not a high-value service, and was not worth the premium I paid per their bid.
Dissatisfaction with their process aside, the entire basis of my complaint is related to the events occurring on February 3rd, when the owner of the business, [redacted], came into my place of work, demanded that I remove my subjective online testimonial, and then proceeded to curse at me and threaten me with litigation. Mr. [redacted] followed through with these baseless threats when his attorney sent me a Cease and Desist Letter on February 18th, accusing me of defamatory libel. An independent legal review of my online testimonial and Mr. [redacted]'s cease and desist letter found the accusations of defamatory libel with actual malice to be baseless and unfounded. My online testimonial was not written with malice, considering it was only written when requested by the business to share my experience online. It was not defamatory nor did it contain libel, considering every factual statement was true and accurate, and all other comments were subjective opinions - defensible by the 1st Amendment of the Constitution of the United States of America.
The completely inappropriate reaction to a poor online review by the owner of this company, and his subsequent assault, harassment, and misuse of legal resources with intent to threaten, shows that he is culpable for this complaint. His response, which completely excludes mention of his legal harassment or verbal assault, and mentions only irrelevant excuses related to his original service, is not satisfactory to me. Let it be known, the response by this business does not satisfy a single desired outcome as originally included with my complaint:
- Removal of "Cease and Desist" order issued to me
- Formal statement that the owner/business will not pursue litigation against me
- Formal statement that the business will continue to honor my warranty against defects for the stated warranty period, if I determine that I have a warranty claim (request to work with someone other than the owner)
- Formal complaint filed against their Revdex.com record
- Removal of Revdex.com accreditation if harassment or litigation threats persists
- Access to 3rd party mediation if harassment or litigation threats persists
- Full refund if they refuse to honor stated warranty (or issue written statement as mentioned above)
- Formal apology in writing by the owner, [redacted]
- Formal statement that no representative from their company will approach my home or business again, unless requested by me for warranty workFor all the reasons mentioned above, and because of the clear inability of this business to understand the very simple and clearly explained nature of my complaint, I am rejecting this response. My desired outcomes remain outstanding and unfulfilled.

I just returned to town and this is my response to Mr. [redacted]’s second statement.  Advanced Exteriors will be filing a court action on August 19, 2014 for non payment of services rendered and will be filing a second action in Superior Court for damages to reputation. Our attorneys have advised us to wait to see what damages occur from his defamatory statements. We will be sending copies of the first court action to the Revdex.com on Wednesday, August 20, 2014.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
Mr. [redacted] has repeatedly blurred the truth in his
reporting of the incident resulting in my complaint, and continues to place
emphasis on the actual work performed at my home, instead of taking
accountability for his unprofessional and inappropriate actions in response to
my online testimonial. I am still willing and hopeful to resolve this issue
amicably, and outside of the courtroom, even while [redacted] continues to threaten
me with a lawsuit.
Many of the comments contained in Mr. [redacted]’s last response
via the Revdex.com forum can be construed as insignificant details, the actual truth
of which we could argue back and forth forever. Rather, I am going to summarize
the incident and nature of my complaint in broader terms:
I contracted Advanced Exteriors to perform work at my home.
I was unhappy with the progression and process of the actual
work, directly as it pertains to the quality and value perceived, given a very
high price tag (my dissatisfaction being well documented in several emails
between myself and Advanced Exteriors).
After much interaction and correction on my part, the work
was completed to my satisfaction. I signed a completion certificate.
Approximately 5 months later, I received an unsolicited
email request by Advanced Exteriors to write a positive review online about my
experience.
As a courtesy, I emailed Mr. [redacted] that I was not happy
with the process and value of his company’s work at my home,
and that I could not write a positive review. Even though the final work was
satisfactory, I felt that the customer service and overall job quality were not
as advertised.
Mr. [redacted] emailed me back, offering warranty work.
I replied, stating that my complaint was not related to the
final, and therefore warrantied work, but rather related to the process it took
to get to the final product. I informed him there was nothing to speak about.
I then wrote a completely subjective online testimonial on
[redacted] and [redacted], giving a summary of the work and my opinion that I did
not perceive good value. All facts given were accurate and truthful. The stated
dissatisfaction was my subjective opinion.
The same day that the review was posted, Mr. [redacted] called
my office. I had left for the day (I was notified by another employee that Mr.
[redacted] had called). I did not call him back, since I had already left for the
day. I did not receive any other calls
or text messages (I am happy to procure [redacted] documents if subpoenaed).
The next day (Feb 3), I received a text message from my wife
that Mr. [redacted] had just shown up at the house. I was very concerned, as this
seemed incredibly inappropriate and aggressive. Mr. [redacted] asked to inspect
the outside of the home, which she granted. When asked if he could speak with
me, she informed him I was at work. My work address was not given.
I did not receive any
texts or calls or messages from Mr. [redacted] prior to his unannounced
arrival at my office approximately 30 minutes later (once again, check my phone
records). Mr. [redacted] came into the lobby of my office and asked if he could
speak with me. I told him I was busy, but he assured me it would be brief.
During the conversation at my office, Mr. [redacted] made many
assertions that I was unfounded in my dissatisfaction with his company’s
service. Many things were said (amicably) back and forth, but it was clear to
me that he was not taking full accountability for a misleading sales pitch and
correlated underperformance.
Mr. [redacted] eventually asked me to remove my review, stating
that it was “hurting his business”. I said no, stating that I am within my
rights to inform others of my experience. He asked again. I said no. He became
agitated and increasingly animated. He began to raise his voice. At some point
he began to mention lawyers and made claims that “he would win in court”. I
asked him if he was threatening me. He said “no, but I’ve already spoken with
the lawyers, and I would win in court”. Finally, at some point Mr. [redacted]
interrupted a statement I was making, and said [verbatim] “this is bt!”.
I immediately stopped speaking, and said “Get out of my office”. He continued
speaking in raised tones, so I turned around, and said “Get out of my office”
one last time as I closed my interior office door. At that time Mr. [redacted]
left.
I emailed Mr. [redacted] with a request to cease and desist any
further harassment of me. I told him any further harassment would be met with
complaints to the Revdex.com and other consumer agencies. I told him any threat to sue
would be considered additional harassment.
Approximately one month later I received a Cease and Desist
Letter from Mr. [redacted]’s attorney. I replied, stating that my subjective
review could not be construed as libel or defamation. I then filed complaints
with the Revdex.com, CSLB, and called [redacted] corporate.
Approximately 45 days later, Mr. [redacted] has claimed that he
will indeed pursue litigation against me in the amount of $100,000, for alleged
libel and defamation.
Those are the facts, and I will swear in court to their
accuracy and truthfulness. Now, please allow me to make a few important
observations or comments on Mr. [redacted]’s last correspondence:
-
Mr. [redacted] did not make multiple attempts to
contact me before showing up to my home and office. Exactly one phone call was
made to my office line, which I did not receive right away.
-
Mr. [redacted] did indeed curse in my presence when
I refused to remove my review. He said “This is bt”, at which time I told
him to leave.
-
I have never threatened Mr. [redacted]. In response
to his aggressive intimidation of me, I gave him one last opportunity to cease
his harassment, or I would file rightful consumer complaints related to his
threats. In fact, one should consider that every one of my actions has been
defensive in nature, with ample opportunity given for Mr. [redacted] to cease and
desist:
o
I did not post any public review of his service
until after being solicited for one by Mr. [redacted] nearly 5 months after the
work was complete. How is this malicious intent?
o
Even before posting the public review, I sent
Mr. [redacted] a courtesy email informing him of my intent to post my honest
opinion.
o
After Mr. [redacted] came to my house, frightened
my wife, and then came to my office and verbally assaulted me, I STILL did not
make any malicious attempts to hurt him or his business. I warned him to cease
and desist his threatening actions or I would indeed file complaints.
o
Mr. [redacted] then continued to attack me, in the
form of a legal cease and desist letter. At this time I did file a Revdex.com
complaint due to his actions.
o
Mr. [redacted] has chosen not to resolve this
matter with the Revdex.com, but rather, take me to court with an unfounded defamation
case. At any time, this matter could have been resolved amicably, but Mr.
[redacted] continues to press litigious action.
Who has been the malicious aggressor in this
instance? Surely not myself, when every action of mine has been responsive and
defensive in nature.
-
Mr. [redacted]’s vague and puzzling assertion (in
bold), that I solicited him for a discount and was basing my satisfaction off
budget and expense is baffling. I am not sure what he means by that. As with
all homeowners, I base my satisfaction on the combined value of price, quality
of work during the process, customer service, and final product. Had this
company met or exceeded my expectations as set forth by Mr. [redacted] during his
initial presentation, I likely would have posted a positive review.
I am confident in my standing in this matter, and would
certainly prevail in court, given the legal precedence by the Code of Civil
Procedure (Section 425.16), protecting consumers against frivolous S.L.A.P.P.
lawsuits. However, I would still prefer to resolve this matter with Mr. [redacted]
outside of the courtroom. I am confident that we could come to agreeable terms
via 3rd party arbitration, which I am requesting via the Revdex.com. Litigation
only hurts both parties in this case.
I am very regretful that this simple case of consumer public
participation has escalated unnecessarily. I have offered Mr. [redacted] multiple
chances to simply let this go, and he has repeatedly chosen to escalate. There
are many acceptable and professional ways to handle a poor online testimonial
by a customer, and Mr. [redacted] has chosen threats and intimidation.
Nevertheless, I am hopeful that arbitration may decide a reasonable resolution
to this case.
Regards,
[redacted]

I am currently in the process of having work done by these guys and they are nothing short of exceptional! From the very first time Martin came out to give me a quote I could tell I could trust these guys. They've been around for a long time and have quite the good reviews. Not only that, their price was very fair and Martin was very low pressure, which is so rare these days. Most companies want to wear you down and close you on the spot. Then, Mike and his crew came out to do the job and they have been awesome! They take the time to learn what I want and to do the job right. Every day they clean up every little mess and make sure my house/yard is exactly as it was before they got there. So far I am absolutely impressed with their work and customer service. Such a rarity these days! Very pleased with my choice to do business with them.

Took time off work since Advanced Exteriors requires both husband and wife be present. The day of the appointment, the owner called and said he was running late. Later when he was going to be so late that my wife had to leave he used a variety of reasons to cancel the appointment. Now they say they will not come to our neighborhood because it is unsafe. This was with approval with the Rhino Shield product maker. They have decided which neighborhoods to chose and which to discriminate. I later found that the secretly record their conversations with customers in violation of California criminal law. Read their Yelp reviews, many bad reviews with the same themes. Not sure why the Revdex.com would support them.

Mr. [redacted] sent us an email on February 2nd, 2016 notifying us that he was
going to write a negative complaint. I immediately looked up his complaint and
was baffled and concerned about his negative reaction.  I immediately followed up with an email to
[redacted] stating:
[redacted] your email and
any additional thoughts you have are of great concern to me. The company honors
and values its warranty. Anything that affects that is of concern to me. For 50
years this company has managed to honor its warranty to all its customers. And
I intend to do the same with you and your home. I think it would be important
for us to meet at your home to address any of the concerns you have. Appreciate
your consideration and time.
Thank you
[redacted]
Again, I was baffled when [redacted] followed up with an email stating:
[redacted],
Did
you even read my email? Everything you say is a robotic automatic reply, like
it has been pre-recorded. My concerns are in the past, specifically regarding
my disappointment with the process, and the price, not necessarily the final
product. That ship has sailed and there is nothing to be done about it now. At
this time I do not have a warranty claim. You were the one who solicited me for
a “good” review, so I gave you an honest one instead. There is no need to meet
at the house or to speak on the phone, I simply do not have time.
Sincerely,
[redacted]
After receiving no responses from text messages or
emails, I went by his home to see if there was anything unusual going on in
regards to the application of the coating. From the street, the home looked
gorgeous, except a section where whomever installed the driveway pavers damaged
the coating. I then proceeded to walk to the front door and rang the doorbell.
[redacted]’s wife answered the door with their child. I
requested her permission to walk around the home so I could inspect the work
that we did. She granted permission. After I walked around the home, I then
rang the doorbell again and informed the wife that the home looked great and
she agreed. I then asked her if I could speak to [redacted] and she told me that he
was not home, but at work.
I then called and sent text messages to [redacted] because
it didn’t make sense to me that his home looked great and he would write a
negative response and go so far as libeling and defaming my business and my
good name. He went as far to say he was “ripped off” and that we “oversold and
under delivered”. He had stated to my crew, half way through the job, that he
had a friend who could do the same job, at half the price. This again, is a
false statement, because his friend would not have been trained to apply the
[redacted] product to factory specification, nor have access to a proprietary
ceramic product [redacted], with a 25 year warranty, which is exclusive to
Advanced Exteriors, Inc. In addition, his friend does not have 50 years of
reputation of satisfactory work, happy customers and warranties that have been
honored.
Because [redacted] and his wife are valued customers whom
are important to us; just as important as our business, I thought it was
important enough to go to his workplace to discuss this situation further.  After arriving at his business, I asked [redacted]
permission to communicate with him in regards to his review. He granted me
permission
In that discussion, I told [redacted] that I was stunned
by his negative review as I thought he was totally satisfied when his job was
complete! [redacted] signed four separate times, for each step of our process, that
he was a satisfied customer and that all “work
for each step was completed satisfactorily according to the terms and
conditions of my contract”.
In this discussion, because of his damaging
language, I wanted to give [redacted] an opportunity to explain and retract before I
took legal action. During this conversation I also offered him our services to
do whatever he may have concern about in regards to the coating of his home. I
also stated to him that I wish to resolve this matter to his satisfaction.
After I left, [redacted] wrote to the Revdex.com, that I cursed,
which wasn’t true, which makes me suspicious of his true motives. He also
threatened me in an email on February 3rd, 2016 which states if I
and Advanced Exteriors, Inc. were to protect my good name and reputation that
he would file complaints with “every
business regulatory agency in existence”.
On February 3, 2016 [redacted] wrote:
“…As
it is, should you attempt to contact me again, harass me or my family in any
way, or attempt to take unfounded legal action, you can rest assured that I
will file formal complaints with every business regulatory agency in existence,
and will also contact the [redacted] corporate office which holds your
license, to let them know they have a licensee threatening customers. “
Mr. [redacted] will be receiving a lawsuit shortly for all
damages that have resulted from his libel, slander and defamation. On February
18, 2016, our attorney sent him a demand to cease and desist letter. After that
notice period of February 26, 2016, Mr. [redacted] will be receiving a lawsuit for
damages of over $100,000 so far.
[redacted] was sent this demand to cease and desist letter
from [redacted]:
Dear
Mr. [redacted],
Mr.
[redacted] and Advanced Exteriors, Inc., retained me in connection with you
knowingly false, defamatory [redacted] “review posted about my client and his company
on February 2, 2016.
From
now on, please communicate with my clients through my office only.
You
stated Mr. [redacted] and Advanced Exteriors, Inc. incompetent. You wrote that you
signed a contract for the ceramic coating (as an industry professional
yourself, you know Advanced Exteriors’ product is not only not mere paint, and
at least 8 times thicker, extremely durable over the years, and a carefully
conceived, proprietary product) – while fully informed of the price beforehand.
You
posted you signed the contract because it was shoved in your face. The clear
implication is you did not read it and later decided to allege you were tricked
by my clients. Since you also stated you have a friend who, for half the price,
would have prepped your home for [redacted] Installation and application of
[redacted] Coating, we would like to talk to that person for several reasons.
You
also accused my clients of over-selling to deceive you. You referred to a “big
sales pitch” they did not intend to follow through on, and yet, as an industry
professional yourself, you further defamed my clients by stating online the
cost of work was “a complete rip off.”
It
appears you are familiar with a “Completion Certificate.” You fully executed
one, checking each box as a happy customer. Your online libel is thus even more
absurd.
Each
of your statements constitutes libel per se. (See Civil Code § 45a.) They are
provably true or false. They are not privileged. (See Civil Code § 47(c)). Your
statements spill over with actual malice – you knew they were false when you
posted them and lacked any good faith belief your libelous statements were
true. (See Civil Code § 48a4(d)).
PLEASE
BE ADVISED: We demand you cease libeling Mr. [redacted] and Advanced Exteriors,
Inc. Remove your [redacted] posts. Kindly do so by Friday, February 26, 2016. If you
refuse, my clients are prepared to sue you for money damages and a retraction
in pursuing their rights and remedies at law and equity.
Please
give this letter your immediate attention.
An email was sent to Advanced Exteriors on June 10, 2015 from [redacted]:
“Our
budget for paint and stucco work going into your inspection was $8000-$10000
(excluding my painter friend who quoted me $4000), and your estimate as of
right now stands at $11,654. If you can sympathize with my concerns (at least
in part), and can find any more room to come down, we would both be very
grateful. If I can make this work and we move forward, I’m sure we will be very
satisfied with the final product and I will be very happy to write a great
review on the Revdex.com website or [redacted] or [redacted] to add to your list of
testimonials.
Please
let me know what you can do.”
As
you can see in the above email from [redacted], he was willing to solicit us for a
discount and in return, give us positive reviews to multiple business
regulatory agencies. He was basing his satisfaction off the budget and expense,
not the product or workmanship.
The average painting company will take anywhere from
one to six days to paint a home, We spent 3 weeks of labor, with the highest
quality product available and final results that even Mr. [redacted] says he is happy
with. I would have left his office at any time, if he had requested it, which I
did at the end of our 20 minute or so conversation. I wanted to give [redacted] the
opportunity to limit his monetary damages before I went to an attorney.
For the first time, since 1959, Advanced
Exteriors will be filing a libel and defamation lawsuit. This lawsuit will be
against Mr. [redacted] with the Superior Court of California for slander, libel
and defamation. There, the Superior Court will determine the final decision for
the remedy of this problem.
As the Revdex.com knows, in our long history of
over 50 years, since 1959, we have had less than a handful of complaints. 99.5%
of all our customers have expressed great satisfaction with our work and the
value of our services. At our office we have thousands of letters from
satisfied customers. We take great pride in maintaining this high standard.
