I am in receipt of your letter dated October 27,Ms*** has signed a Residential Lease Agreement dated August 11,(attached)
This year lease started August and will terminate on August 13,
I will address each
complaint in the order that the tenant wrote in her complaint
Claim: Tenant states that she was given a verbal day notice (by phone) on October 20,
Response: There is no such thing as a verbal day noticeAll notices are executed in writingA Three Day Notice To Cure Breach or Quit was posted and mailed on October 21,(attached)
Claim: Tenant claims that the washing machine broke (would not drain)
Response: The owner of the property, who lives in Northern California, states that the washer and dryer aren't that oldBoth the washer and dryer are listed on page section 1c described as personal property and were left for the tenant to use at no charge
Claim: Tenant claims that the carpet in the master bedroom smells of cigarettes
Response: Property has been owned by the same family since it was built in Per the owner, no one was allowed to smoke in the houseMs*** is the first renter this property had had
Claim: Tenant states that the front shower hook broke
Response: Page section 4B states that the security deposit may be used to (ii) repair damage caused by Tenant or by a guest or licensee of TenantLandlord expects hook to be repaired/replaced by Tenant prior to the Tenant vacating
Claim: No screens on the sliding glass doors
Response: There are no screens on the sliding glass doors and haven't been for yearsThere were no screens when the Tenant moved in and the owner is not required to provide them
6: Claim: Tenant calls Landlord to inform him that the owner's washer and dryer are being left in front of the garage
Response: I reminded Tenant that per the Lease Agreement that she is responsible to safeguard the appliances (Page 11A)I asked the Tenant politely numerous times to put the appliances in the garage and that the owner of the property would move them to his side of the garage the next time he was in TehachapiI told her that if stolen she would be financially responsible for them
Claim: Tenant states that she and her son had to pick up dead tree branches, weed the yard and picked up dog droppings
Response: Page section 11C and D states that Tenant shall maintain the garden, landscaping, trees and shrubs and maintain a 100' weed clearance from the home per fire department requirements
Resolution: Owner is aware of this situation and will be moving the appliances within the next to days to his side of the garage

I humble disagree to Steves response from thru

Response: I agree there is no such thing as a verbal day notice:(by phone nor face to face)But the fact remains the same on Oct 20, *** gave me a verbal day notice, as written beforeThen the next day he gives me a day noticeWhich he would send a negative credit report (Enclose copies)Thats why I contact the Revdex.com

Response: I agree thats on the leaseI disagree I called any person to come in house to make any repairs or remove washer & dryerAs written before(Enclosed, copies) Also its Steves responsibility to storage his clients broken appliancesBut he abused his authority on me to remove my car from my garageTo storage his washer and dryer and lawn mowerAs a renter I'm entitled to get what I pay for

Response: I agreeI will fix that

Response: I disagreeAs I said before, I rented from ***So when I gave him the move in inspection listI believed these things were going to get fixLike at *** S *** StI just moved out ofAs for the screens on sliding doors, door, windowsThey are very important here for health issues I cant open up no windows or door because flies , mosquitos that have malaria, yellow fever, larvaeAl theirs horses, deers and squirrels that have fleas, moths(Enclosed photos, copies, move in list)

Response: Yes, I called *** that owners broke washer & dryer is in from of garage, that I covered themOnce again I did not hired any one to remove owner broken washer out*** *** did, he is at fault, not informing his worker where to take his clients broken washer & DryerI've complied to the lease i've sign (page 2-8)I've ask to be reimburse of storage cost, owner leaving garage light onHe did not answer that questionI'm a renter not a storage business or nor should I pay for owners and Steves bills

Response: I agree that the lease says thatI disagree that I had to pay $1,for cleaning deposit, yard (land) not being clean before coming in*** informed me when I was at *** S *** Person that seen that place had no place to go, had wanted to move inHe had allowed me to move things in garage, my son, I wanted to moveSo to help we moved out of *** S *** St to have this person in, us into XXXXX *** *** RdOn Aug 16,(Enclosed photos of us cleaningwhich *** had time to hire someone to have cleanBut he did notThat when he aid we could use his lawn mowerCame home, his lawn mower in yard(As of today Nov 15,garage spells of gasoline) I thought when he let us use his lawn mower that was niceBecause I have my own lawn mower, weed wackerAs of today he has not removed these thingsI'm doing my best to be responsibleEnclosing photos how yard, land is today
