RE: *** ***,
Your File #***
Advanta
Business Card Ending In ***
Dear
***:
Thank you for your recent correspondence regarding the
above-referenced individual
It is unclear why *** would have been under
the impression that he had completely paid off the account at the end of July
2013, as his complaint suggests, when the last payment received prior to
charge-off was for $on May 14, 2013, leaving an unpaid balance of
$1,004.36. Enclosed please find a copy of his June statement, which
shows that payment as well as his outstanding account balance at that time. In accordance with the terms and conditions
of the account, late fees and finance charges continued to accrue until the
account ultimately charged off on January 31, with a total amount due of
$1,331.87. A copy of the charge-off
statement is also attached for reference. Subsequently, on February 14, 2014,
a payment in the amount of $1,was received, paying the account off in
full
It appears that *** changed his address
sometime after his last payment in May, which may be why he did not receive
subsequent statements that were mailed to him While our records show having received
returned mail in September 2013, no forwarding address was provided by the post
office Please refer to the Advanta
Business Card Agreement, section 20, titled ADDRESSES, which states, “you agree
to keep us informed of your address and how to contact you If you move, you will write your new address
and telephone number on the return stub of the periodic billing statement or
give us some other prompt notice so we may change our records You agree that whenever we are required to
give you notice, we may conclusively presume that we have given it to you if we
mail to you at the last address known to us as shown on our records, whether as
part of a periodic billing statement, or otherwise.” According to our records, *** did not
provide us with an updated address until February
In summary, the last pre-chargeoff payment for $
was received on May 14, The
account charged off on January 31, Payment in full was received on February 14,
This account is correctly
reporting as “Paid In Full” after charge-off Since the information reported is accurate, we
are unable to remove the charge-off status as requested
We will consider this matter resolved unless advised
otherwise
Sincerely,

Dear
**. [redacted]:

Thank you for your recent correspondence regarding the
above-referenced individual.

We are happy to provide **. [redacted] with the following
information to clarify the questions he raises in his complaint.  The correct URL for the Advanta website is
www.advantabankcorp.com.  The website is
fully functional.

Advanta Bank Corp., of Draper, UT, was closed on March
19, 2010, by the Utah Department of Financial Institutions.  Subsequently, the Federal Deposit Insurance
Corporation (FDIC) was appointed receiver. **. [redacted] is welcome to go to the
FDIC’s website at
http://www.fdic.gov/bank/individual/failed/advanta-ut_q_and_a.html to verify
this information.  If he reviews the
website, he will see that the account is still owned by Advanta, and no changes
have been made to its terms and conditions.  While **. [redacted]’s complaint suggests that
because Advanta is out of business, the account is no longer verifiable and
should therefore not be reported to the credit reporting agencies, this is not
actually the case.  The terms and conditions
of his account have not changed and, according to our records, all information
is being correctly reported.

Enclosed please find a copy of the electronic
representation of the Advanta Business Card application, which shows **. [redacted]
applied for this account as the Signing Individual.  The application was submitted via the Internet
on June 13, 2006 at 5:02PM EST from IP address [redacted].  We are also enclosing a copy of the Advanta
charge-off statement as validation of the account.  While the complainant states that he disputes
the account as being false, he does not specify what specific information he
believes to be incorrect and why.  If **.
[redacted] provides that information to us, we will be happy to investigate.

We trust this information has cleared up any questions
**. [redacted] may have had regarding this account and we will consider this matter
resolved unless notified otherwise.

Sincerely,

Review: No calls or statements sent in regards to an outstanding debt. Then no one was able to pull up my account info to give me any information.

After 6 months of charging me late fees with no calls, statements or information about the account being past due. I was under the impression that I had it completely paid off at the end of July 2013. Now I have received multiple late fees on my credit that has drastically reduced my score! When I called today to clear up and pay off the account I was connected to one women in "closed accounts" who then transferred me to another department, "regular collections", I believe. [redacted] was the person I worked with in regular collections. She was impressively rude. She told me after 7 minutes of trying to pull up my account that no one in the entire company of Advanta could access my information and that there was nothing else she could do. Then, she hung up. I was told that I had to call back on Friday and then maybe someone could help me. Nothing about my account could be accessed, which can not possibly be the case.Desired Settlement: removal of late fees and a letter of notice to the credit rating companies to remove the negative remarks and fees from my credit score

Review: I paid a settlement agreement to this company in December of 2010 for $1444.09. I have a copy of the EFT check from my bank. This payment was never posted or showed as paid, and has been subsequently sold to another collections agency. The record is hindering a job hiring process.Desired Settlement: Show the account as paid, paid as settlement, or at least paid for less than full balance on my credit record, and provide a zero-balance/settled letter that I can use as proof that this matter has been handled.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.

Review: This account has been paid in full over 18 years. This woman named B[redacted] calls me day and night threatening me to pay this card bill. This started last month around October 8, 2014. My husband is sick and I have had enough trying to keep sanity to take care of him and pay all his business bills when he retired over 20 years ago.All these charges are late fees. I've asked them to cancel the card when I paid them off.Desired Settlement: DesiredSettlementID: Other (requires explanation)

Review: Approximately five years ago Advanta closed my credit card account, I set up automatic payments to pay off the card above the minimum due. . At some point several years ago I quit receiving statements, I wasn't to concerned because I've had automatic payments being applied. On at least two occasions over the last four years I've contacted them about not getting statements, the last one being as recent as Feb of 2013. I called today to inform them that I still wasn't getting statements and confirm once again they have the correct address which they did, as well as my phone number. I've been at the same address for three years now. They stated they didn't know why there was a hold on my statements, that "maybe my letter carrier keeps messing up and it gets sent back." I've never had a problem with my letter carrier or receiving any of my other mail

The Customer Service representative ([redacted]) gave me web access to review my account, apparently over the last four years they have raised my interest rate to 32%, she said I was two days late twice. Apparently they changed my original due date and then failed to send me any statements to reflect that. I've had automatic payments come out of my bank account twice the amount due for the last three years.

This company is deliberately not sending out bills and then increasing interest rates to reflect their dishonest business practices.Desired Settlement: I want the interest incorrectly charged to my account over the last four years reversed, and to set my interest back to the original rate, and to start receiving statements.

Review: AVANTA falsely markets its product as a low interest balance transfer card. Than after a set period of time. Than they change the rates, DO NOT Notify, (I asked for proof, they do not have and do not care that they did not notify us as per the contract) of 5 times higher interest rates than advertised (from 4.5% to 27.18%). They are steeling our money at almost 30%. We have never been late, we always pay above our minimum. My Credit is higher today than when I signed up at the agreed 4.5%. They falsely and purposely extort small businesses with the promise of lower interest rates to pay of higher rate cards. So in essence the Card that I paid of at 11.9% with the initial ADVANTA card at 4.5% is now less than half the 27.18% ADVANTA is charging NOW. When I first found out about the increase I immediately called ADVANTA and stated I did not agree to the new terms and would pay the remainder at the agreed 4.5%. They said NO, we have the right to change the % at will to whatever we want. That statement was confirmed by multiple phone reps and managers. I have alerted them that I will pay for one more month just to keep current. And that after that if they do not lower my interest rate to the agreed 4.5% that I will stop making payments till they do. I also reminded them again each time that I was never late and that I always paid more than the minimum due and that this is wrong because the intent of the card was as advertised to pay off higher interest rates. Their reply was that I was higher risk now (yet my credit score is higher than when I got the card) Than he admitted that their requirements have changed since I joined. I told them that is not what I agreed to in the contract and they said that it does not matter because I was notified. I asked for proof of notification. They could not provide. I asked them for the date I had to reply, And found out that I had called by that date the first time and still no luck. Basically ADVANTA is Steeling from America's small businesses. No other word for it other than theft. Despicable. I intend to take this all the way to congress to have this Credit Card system changed once and for all. I truly hope that whoever reads this can do something about it ASAP. People who steal should go to Jail. They increased the rate from 4.5% to 27.18% without me ever being late and with my credit score higher than ever. THIS IS FRAUDDesired Settlement: For advanta to keep their part of the contract at the agreed 4.5% not their made up 27.18% of which I was never notified, and never agreed to pay. Review: Advanta Credit Cards erroneously reported information to my Equifax, Transunion and Experian credit reports. This is in regard to the account:

ADVANTA CREDIT CARDS

Account Number: [redacted]XXXX

I have tried unsuccessfully since Feburary 2013 to straighten out incorrect information about the above mentioned account reported on my credit files with your customer service.

Furthermore, in May 2013 I sent disputes letters again to the credit bureaus (Experian, Equifax, and TransUnion) advising them that they were inaccurately reporting and asking to update my files with the correct information. In June 2013 the credit bureaus verified the incorrect account information based on the inaccurately furnished information they received from Advanta Credit Cards. On June 03, 2013, I sent a dispute to Advanta requesting that they conduct a re-investigation of the account they are reporting and send me full documentation to verify the account details. I have received NO response from Advanta after more than 30 days as allowed by federal law. On July 20, 2013 I sent a gain a dispute letter to Advanta asking them to send full documentation or delete the account from my credit files. Again, up to this point No response from Advanta. I clearly asked Advanta to provide me with the followings:

- Original Signed Contract, Any and all statements,

-Any and all copies of checks or payments received,

-Any and all late notices regarding this alleged debt,

-and Copy / Accounting of the charges substantiating the alleged balance

- Charge-off statement

Advanta refused to send me these documentations as well as refused to correct or delete the negative account from my credit reports. Advanta has clearly violated (including but not limited to) the Consumer Credit Protection Act and the Fair Credit Reporting Act.Desired Settlement: 1- Immediate and complete deletion of the account

ADVANTA CREDIT CARDS

Account Number: [redacted]XXXX

from all credit reporting agencies(Equifax, Experian, and TransUnion).

2- pay $ 5000.00 for Compensatory damages.
