When the HOA gives you a notice it is sent to the tenant as well as the owner of the house. Again the living conditions are not right. They also know my husband has just had a major heart attack and we where unable to locate a place while he was in the hospital. He has just now gotten back to work and we are moving. I have no wish to live in this house when they can't fix the problems or fix them illegally. I will be reporting them to the Code Enforcement and the Fair Housing Authority and have retained an attorney to pursue this.

We have contacted Mr*** today to ask if they are ready to schedule a move out walk thru since this was to be their last day of occupancy. Again we are more than willing to complete a walk thru with this tenant on their move out to evaluate the status of their security deposit. If they move out soon and leave the property in good condition, there will be security deposit available for refund. If the tenants move out peacefully and leave the property in good condition soon, we will drop the eviction suit. As Mrs*** has requested a copy of the HOA letters and pictures, I have attached separate letters sent by the HOA directly to the tenants via regular mail and certified mail including pictures of the HOA violations. Letters were dated 9/30/2013, 10/1/2013, and 6/26/2014. In reviewing our recent correspondence on this property, there are no repair requests that I show as still open. The complaints started when we had to file for eviction due to non-payment of rent. I am hoping the tenants reconsider and work with us for a peaceful move out quickly so there will be security deposit available for refund. Sincerely, *** ***, Peabody Holdings, LLC

This complaint is from a tenant leasing from Peabody Holdings, LLC. They have violated the terms of their lease and have violated the HOA guidelines for over a year. The HOA has notified the owner of a pending lawsuit if this tenant is not evicted for the numerous violations. Repeated...

attempts for the last year to obtain compliance from the tenants has failed. The tenants have denied the allegations of the HOA, but the HOA has provided multiple pictures of the issues the tenant causes. The tenants received a 30 day move out notice in mid August to find a property to move to by September 30.  There is a security deposit and I had made arrangements with Mr. [redacted] early in September to facilitate a walk thru to process the move out and appropriate security deposit refund. Mr. [redacted] had assured me earlier in the month of September they would be out by September 30 and the property would be left in good condition. In a conversation the property manager had with Mr. [redacted] on or around 9/27/2014, Mr. [redacted] gave no indication that a new rental property had been located yet.  Rent for September was due September 1 due to the terms of the lease.  The tenant is past due on their September Rent of $1750, October rent of $1750 is due in 2 days, and no indication has been given that they are moving out.  Proper legal 3 day notice of past due rent was given earlier in September and we have been left with no option but to proceed with eviction.  I would prefer for the tenants to move out peacefully, schedule a walk-thru, and if the property is left in satisfactory condition and this is done soon, we would be able to refund a portion of their security deposit and drop the eviction suit.  I am more than willing to work with the tenant on a peaceful move out.
