transmission service will not fix the preexisting transmission issue, however, Mr. [redacted] still Insisted on proceeding with the transmission service. We informed Mr. [redacted] that the transmission service cost is $295, out the door including parts and materials, Mr. [redacted] agreed and signed the invoice. For your records we are also enclosing the invoice from December 17,2014. Mr. [redacted] paid for the service on his debit card a transaction which he attempted to dispute with the merchant shortly after the service was provided. We submitted all of the documentation regarding the service which is why Mr. [redacted] lost the dispute.It is really strange that Mr. [redacted] is just now after seven months attempting to coliect the $295 for a service that has been completed as agreed. We are not under any obligations to give Mr. [redacted] a refund as the issue was preexisting, he was well aware of the issue, and the transmission service we performed was done with the upmost care and correctness. We do feel for Mr. [redacted], however, we are not at fault and will not give Mr. [redacted] a refund for a transmission service that we performed over seven months ago.Should you need any additional information regarding the above-referenced matter, please do not hesitate to contact us.

The purpose of this letter is to respond to the complaint filed by Mr. Richard [redacted] on August 6th, 2014. Mr. [redacted] purchased a 2003 BMW 530i Sedan VIN # [redacted] on March 25th, 2014 for $7,400.14 after taxes. The mileage on the vehicle at the time of...

purchase was 124,560. Prior to purchasing the vehicle Mr. [redacted] wanted to inspect the vehicle at an independent auto shop of his choice; we of course honored his decision. Mr. [redacted] chose to inspect the vehicle at [redacted] located on [redacted] Drive in Tempe, AZ. [redacted] performed a complete inspection of the vehicle including engine, transmission, interior, exterior, suspension, cooling system, brakes and a test drive. After a complete and very throughout inspection [redacted] found that the tires needed to be changed in the near future and the windshield wipers needed to be replaced. Besides the tired and winshield wipers [redacted] determined that the car was in perfect condition. Mr. [redacted] subsequently purchased the vehicle from us since the shop of his choice confirmed that there was nothign wrong with the vehicle besides needing tires and windshield wipers. We pride ourselves in quality, customer service and meticulous work. When Mr. [redacted] purchased the vehicle from us it was in perfect condition.Mr. [redacted]'s complaint has many inaccuracies. The first, and most obvious one, is that in the complaint filed with the Attorney General office, Mr. [redacted] states that the vehicle overheated three days after the date of purchase. This is completely inaccurate. In the Revdex.com Complaint that Mr. [redacted] filed he stated that the overheating began two weeks after purchase. For your reference we are enclosing a copy of the Revdex.com as well. Mr. [redacted] called us to inform us that the vehicle was overheating. We immediately told Mr. [redacted] to stop driving the car and have it dropped off with us so we can inspect it and correct the issue. While on the phone Mr. [redacted] acknowledged that after noticing the overheating he continued to drive the car for at least ten minutes since he wasn't too far from his house. Driving a vehicle when the engine is overheated is completely reckless and could cause extreme damages beyond repair. Knowingly driving the vehicle while the engine is overheated voids our limited 30 day warranty. On the following day Mr. [redacted] dropped the vehicle off to us for an inspection. After we performed a complete inspection we found that the cause of the problem was a plastic drain plug on the radiator. The loose plug caused the anti-freeze to leak which in turn causes the engine to overheat. Even though the limited 30 day warranty was voided, we decided to replace the radiator instead at absolutely no cost to Mr. [redacted] just because we care about our customers and we wanted to help Mr. [redacted]. As an additional precaution we also installed a brand new radiator at no cost to Mr. [redacted]. After we replaced the radiator we inspected the vehicle and found no additional issues. Before we released the vehicle to Mr. [redacted] we informed him that if he ever experienced overheating issues in the future to stop driving the car immediately as it can cause serious damage and is also unsafe. Choosing to drive while the vehicle is overhearing is driver negligence and will voice the limited 30 day warranty that we extended to Mr. [redacted].
Since we corrected the overheating issue Mr. [redacted] continued to service the vehicle with us for issues that were completely unrelated to the overheating. We have replaced the lower control arms, front right window regulator, fuel filter and engine mounts. We extended deeply discounted prices on parts and labor when performing these services. When we replaced the fuel filter filter the date was June 2nd, 2014 which is nearly two months days after the overheating was resolved. For your reference we are enclosing the service receipts not only to show that the work was completely but to clearly indicate  the dates. Advantage Imports is not responsible for the claims made by Mr. [redacted]. We would be happy to resolve this complaint with Mr. [redacted] directly by extending a discounted rate on parts and labor for any issues that Mr. [redacted] is experiencing. We look forward to hearing from Mr. [redacted] so we can resolve any auto related issues that he is facing.

The purpose of this letter is to respond to the complaint ID # [redacted] from Ms. [redacted].  Ms. [redacted] purchased a 200 I Volvo S80 VfN # [redacted] on March 29, 2014 in AS-IS WHERE-IS condition with no warranty said or implied.  Ms. [redacted] purchased the vehicle from a private...

party individual [redacted].  The following is a statement of facts in chronological  order:• Vehicle was purchased on March 29, 2014.  Ms. [redacted] inspected and test drove the vehicle and it was in perfect condition.  Ms. [redacted] test drove the vehicle several times, including bringing her own mechanic who she knew and trusted.  When Ms. [redacted]  purchased the vehicle on March 29,2014 it was after a period of several weeks and at least four separate test drives.• Ms. [redacted] went to [redacted] located on [redacted] for an oil change and tire rotation on March 30, 2014.  Immediately after the visit at [redacted] Ms. [redacted]  experienced grinding noise and vibration in the wheels.• On March 31, 2014 came back to Advantage Imports to inform us ofthe problems she was experiencing. We immediately saw that the wheels were not tightened properly and they were missing lug nuts.  The front left wheel was only being held by two lug nuts that were not properly tightened.   Ms. [redacted] acknowledged the fact and stated that she would go back to [redacted] in attempt for them to pay for any damages caused.• On April2, 2014 Ms. [redacted] came back to Advantage Imports and left the vehicle for an inspection.  After our inspection we found the following problems:   - Loose and damaged front end wheel bearing.   - Damaged main transmission  wiring harness caused from the extensive vibration on the loose wheels.   - We replaced the front left wheel bearing assembly and repaired the transmission main wiring harness.  The total invoice was $432.45 (Parts $150, Labor $297 and Sales Tax $12.45, please see enclosed invoice). Ms. [redacted] never paid for this invoice and still owes us $432.45.All of the damages we found were caused are due to excessive vibrations caused by driving on not properly tightened wheels. This is gross negligence on Ms. [redacted]'s part. We still have an outstanding invoice of $432.45 from Ms. [redacted] which needs to be paid in full as soon as possible.In conclusion, the claims for refund made by Ms. [redacted] are unacceptable because the damage was caused by gross negligence on Ms. [redacted]'s part and the vehicle was purchased in AS-IS WHERE-IS condition with no warranty said or implied. Additionally, when the vehicle was purchased there no mechanical issues of any kind were present.Please feel free to contact us if you have any additional questions regarding this matter.Sincerely, [redacted], Manager

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

I am not satisfied with this resolution because, I still have a non working, LEMON on my hands. The gentleman that came with me to test drive the Volvo is someone I trust, and that recommended, Advantage Imports but because he is not a certified mechanic was not able to detect the major catastrophic issues the car had been experiencing. [redacted] took full responsibility for their negligence, on March 30th for not tightening ALL lug nuts, as well as not having the proper tools to give a sufficient oil change, which have ABSOLUTELY NOTHING  to do with whats really wrong with the car. On April 1,2014, three(3) days after purchasing the Volvo the, "TRANSMISSION SERVICE NEEDED IMMEDIATELY" light came on. I called the co-owner, that sold the car to me, [redacted], who told me to bring it in as soon as possible, which I did the very next morning. That Volvo stayed at, Advantage Imports for two and a half days! I live less than eight(8) miles from, Advantage Imports, but on Friday after 3 pm, when I picked the Volvo up, within that eight(8) miles, after they had supposedly fixed the car and come up with a bill of $432.45, the same "TRANSMISSION SERVICE NEEDED IMMEDIATELY" light came on as well as the "SERVICE ENGINE SOON" light. I ended up having to call my insurance provider and have the car towed home.        

I know I bought the car AS-IS and realized at that point, I wasn't  getting anywhere with, Advantage Imports, as far as getting this car properly fixed. So, I called a, certified transmission specialist, which informed me, as the light indicated, the Volvo had been experiencing major catastrophic transmission issues way before it was sold to me. The invoice is attached to my original complaint. According to the, Arizona Used Car Lemon Law, I am not obligated to pay the $432.45, and because a major component needed to be replaced three(3) days, well within the 15 days or 500 miles, I am entitled to a full refund of $3000.
