First and foremost, the tenant is correct in that this matter has taken longer to resolve than was necessary.Second, as per the attached Tenant Close-Out Statement, $was withheld from their deposits and not "...over $1,100" as stated in the complaint.As regards the background of this
complaint, the tenant broke their lease and, per the terms of the rental agreement, were held responsible for up to two additional month's rent, utilities and any out-of-cycle expenses that may be incurred during that two month periodAs it turns out, a new tenant was placed in the home on December 26, resulting in a pro-rated refund of the December rent that tenant was responsible for.The two charges for which the tenant would like a full refund are the charge for painting and the charged for the credit to the new tenant for cleaning the appliances.Normally, wear and tear on the home, including paint "damage," is considered wear and tearDuring the post move out inspection of the home, several areas were noted that would require paint touch-upTo that end, a sample was taken from an inconspicuous area and analyzed by one of the local paint company to determine the colorAs it turned out, though a very close match, the touchareas were obvious due to a slight shading variation that could not be correctedThe interior of the home, by the way, had been painted by the former owner immediately prior to the purchase of the home by the existing ownerThe existing had no knowledge of the manufacturer of the paint or the paint codeThe former owner could not be contacted for this information.The only way in which to correct the obvious difference in the paint shading was to perform what is referred to as a "corner-to-corner" painting of the wall needing repair and this was done at a greater cost than would have been necessary had the correct match been possibleInterior paint is judged by the Department of Housing and Urban Development (HUD) to have a service life of yearsTherefore, we have taken the cost of the painting ($293.25) divided by (service life of paint) and multiplied that by for the number of additional years service life consumed by the tenant beyond the term of tenancy (year)Gross Receipts Tax was added to that amount and deducted from the original charge with the difference ($94.38) to be refunded to the tenant.The charge for the credit to the incoming tenant's account ($150) for cleaning of the appliances (see attached photos) was based on a hour cleaning at $35/hour plus tax provided by our house cleaner after having seen the photosAs the need for this cleaning was not noted until a pre move in inspection, we will refund half of this charge as compensation for our oversight
