I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because[redacted] is a Liar, I told him that the Town Of Hempstead had shut me down and put violation stickers on my windows. I told him that I have to cancel contract, he knew that this was a debit card from my checking account that is why I told him the [redacted] of the month.  he told me yes he will cancel contract. He never told me to read contract nor about non-cancellation policy in that case I would of told him to get out I don't sign non canceling contract. I have been to court for these violations and running around to get my business up to code. Furthermore he disrespected me why would I want to do any business with this company. [redacted] need to do the right thing and cancel this contract and refund me my money. he said that he would.  Putting my  business name on theirs ads without any approval from me  that is violating my rights. I will see him in court.

I met with [redacted] on two separate dates and presented her with the benefits of the advertising campaign that ADvantage Ads of New York makes available at the Western Beef supermarket in Elmont, NY. I first met with [redacted] on Sunday * March 2017, and presented my program over the...

course of approximately 30 minutes. She expressed interest in the program; however, she asked that I give her until the following day to make a decision. I agreed to let her sleep on it, and returned the following day. On the following day, [redacted] again expressed her desire to participate in our video advertising campaign; however, she expressed a concern over the payment plan. To accommodate her, I offered to split the payments for this 6-month program into 5 consecutive monthly payments, which we agreed would be charged to her credit card on the [redacted] of each month. The [redacted] was important to her because the first payment would fall on the next cycle date of her credit card. I am submitting a copy of the 6-Month Agreement Order Form that [redacted] signed authorizing ADvantage Ads of New York to charge her credit card and a separate signature on the bottom of the form authorizing her consent to proceed with the advertisement. Please note that the Agreement explicitly states under “Other Terms”, paragraph A that this Agreement is non-cancellable. [redacted] was given the opportunity to read over the contract before signing it.In reading over the complaint presented by [redacted], she overtly has misrepresented herself in her opening statement to the Revdex.com by implying that I charged her debit card and that caused her checks to bounce. I don’t have a debit card from [redacted]; she provided me with a credit card, and this would not have any effect on checks written by her. Also, the charge to her credit card would appear on her following statement since we were changing it after the cycle date of the [redacted] as she requested.At the end of business hours on * March 2017, [redacted] called and told me that the Town of Hempstead forced her out of business. She cried hysterically for 10 minutes and tried to have me side with her on how unfair the town is being with her. At the end of this hysteria, she asked if the contract could be cancelled. My response was that if she is out of business, she has nothing to worry about because there is no one to execute the contract against. However, I had suspicions that she was fibbing. I believe that she was issued citations, but her business is obviously open. Over the course of the next 1½ weeks I called Zen Retreat Spa on 3 separate occasions and asked the secretary if they are accepting patients. Each time she gave me a positive response. On my last call, I explicitly asked if Zen Spa Retreat is in business, and the secretary answered, “Yes”. Only after that call did I charge [redacted]’s credit card as agreed upon and auth orized by her.After I charged her credit card, I called [redacted] and stated to her that she misrepresented herself to me, and that we have a valid agreement. She hung up the phone on me. I gave her a couple of days before making several subsequent phone calls so that we can discuss the ad copy necessary to make a video ad for her business. My calls were never returned.ADvantage Ads of New York undisputedly has a valid contract with [redacted] of Zen Retreat Spa. [redacted] has misrepresented the facts on two separate occasions. At this point, ADvantage Ads of New York will create a video ad based on the Zen Retreat Spa website, and we will continue to charge the credit card as agreed upon and authorized by Cladia Morgan. Should she cancel the credit card, we will file a small claims court case against her business for payment in full plus legal fees as stated in the Agreement Form under “Force Majeure”.
