Dear ***: We have read and reviewed the complaint from *** *** regarding the go cart track and his son’s removal from the track We understand his and his son’s disappointment to be removed from the track due to what we determined to be unsafe driving Our number one goal, above all else, is the safety of all of the riders and our employees on any of our attractionsStatistically speaking, go cart tracks nationally suffer from the highest incident rates of any attraction in Family Entertainment Centers In twenty years of operation, we have continually updated our equipment and review our operational and training procedures to continue to ensure the safety of everyoneThis includes a staffed trained to recognize and remove individuals whose driving may create a hazard Obviously, the definition of a hazard includes bumping, whether accidental or deliberateIt also includes younger drivers who may make the minimum height requirement but yet may not be in full control of the carAdditionally, unsafe practices include very slow driving, or those that may be weaving or swerving On the day in question, there were a total of four different attendants on the trackAgain, their primary duty is to watch and recognize any drivers who may warrant removal for safety reasonsIt is never a “one man decision”The crew chief, who is stationed at the “kill switch” for the go carts, must observe the action or actions along with one or more of the other three members of the track crew The crew is in touch with each other via radio and hand signals, and once confirmation is made the individual or individuals are removed from the track Obviously, the individual or other members of the group are not happy with losing a portion of their rideAs owners and managers, we must take the word of the track crew over customers*** *** did ask “who are you going to believe- me or these kids”Our response is “we have to trust our crew’s judgment” At no time did anyone call him a liar*** ***’s stated “My family members that was riding with him and I did not see him riding erratically or bumping cars.” Frankly, it is nearly impossible to see unsafe driving as a rider on the trackHowever, it is very easy to see the situation from the higher positions of the track crew There is no incentive for the crew to remove anyone “on a whim”It is hard work, and the crew inevitably takes heat from the family as in this caseIt would be an easier job for them to simply ignore bumping and other unsafe practices than enforce these important rulesThis is precisely why we choose the best and the most safety conscious of our coworkers for the go cart track I do want to apologize if *** *** felt that he was not treated with respectDefending the proper actions of the track crew, even if unpopular, is never an easy jobAnd we rightfully defend the proper actions of our employees, as in this case In all sincerity, we would rather field a complaint like this rather than field one about an injury we could have prevented Although *** *** strenuously disagreed with our decision to remove his son from the track, the crew and supervisor did carry out the safety policies as trained In accordance with our printed and posted policies, we cannot offer any refunds or other compensation for this situation Sincerely, Don *** W***, Safety Director Cc: *** *** *** ***

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.I reject the response because  they believe my son who was driving and bumping others and causing a danger to others or himself.   I'm confuse what they meant about weaving and swerving.  Is this not a Go-Cart or a children play ground where they just chase each other around in a motor go cart.  If what he or she meant was passing another go cart is swerving then they should state that no one is to pass another go cart on the course. If anybody who drove go-cart at anytime in their lives, know that there are more aggressive drivers and swerving (passing) another rider.  As the person who responded stated, I do love my son and I don't wish no harms comes to him or others.  If I thought my son was doing a dangerous act I would have stopped him and and corrected him my-self. We have been coming to Geneva on the Lake since the 70'S.  Geneva had a Go cart place at another spot where we enjoyed coming here every summer.  Again I understand safety is the priority but unfortunately it was incorrectly enforce on my son.  I understand that is always going to be a two sided issue with no means.  I still feel we should be reimburse for the monetary loss.
