Aero Concrete LTD / Concrete Services Placing

Cracked retaining wall that they poured less than three years ago. Now, they refuse to answer/return calls about it.
Aero Concrete was hired to do my new home foundation in February of 2014. They started the foundation the last week of March that year and finished the work approximately mid June of that year. However, during construction, they repeatedly had to repair a leak in my basement. They repaired it 4 times before it quit leaking. *** the owner, even wanted payment BEFORE it quit leaking. I explained that when they ad finally fixed it correctly, I would pay them. I did not notice a crack in the retaining wall until May of 2015. At that point it was a minor crack and I figured that with the rebar support, there was nothing to be worried about. However, around June of 2016, I knew that something had to be done. I placed a call to Aero concrete around August of 2016 and *** the office manager, sent *** (the salesman) right out. I was shocked with the response. *** came to the house and took pictures of the crack. He said "Yes. This isn't right. We are going to have to see how *** wants to fix this. This shouldn't have cracked like this." After waiting for about a month with no correspondence from anyone. I called their office again at the later part of September. This time, *** answered the phone. She said she would have *** get back to me. Once again, nothing. So, October, I called again. *** answered this time as well. She again told me that she would have *** get in touch with me. Once again, nothing. I tried one more time in November and this time I asked ***, "when can I expect a phone call from ***?" She said, I will see if he can call you back by the end of the week. Once again, NOTHING! So, in March of 2017, I tried again. To my surprise, *** answered the phone. I explained to him that he was rather hard to get ahold of and he said that he has been "busy." I explained the situation to him and his response was: "***, you have to understand my position. I didn't back fill that." I said I know you didn't. You told me that you and the excavator had "worked it out" so you could get on to the next job because you were busy. You went on to explain that you would pay him back on the next job because you two worked together all the time. After I said that to *** on the phone, he was quiet for a moment. I went on to tell *** that I am a reasonable person and that I just want done what is right and fair. He said "I know. I am going to have to investigate this a little more and get back to you." I said when? And he said "Ill get back to you by the end of the week." As you can imagine, I have never heard back. He did go as far as calling in the locates after that phone call but that was as far as it went. I have since had other contractors come look at the crack and they have verified that there is no horizontal rebar in the wall as required by building codes. I reached out to Aero one more time via email in early May of this year and have still heard nothing back.
