Holding Security Deposit and Won't Return Calls
I gave my 30-day notice on October 16, 2024. I should have received a return of my security deposit on November 16, 2024 along with an itemized list of damages (if any). When I inquired after that date, I was told by Byway in Fairview, OR that the list was in my resident portal and that a check was sent. However, I no longer had access to the resident portal after I moved. We determined the check was sent to the wrong address. I was told I had to wait another 30 days for accounting to reissue a check. Here we are on 1/6/25 and I contacted Byway again and was told the check was sent back again. We confirmed the address is correct and I know now that they are lying. They will not allow me to pick up the check and I am being told I have to wait ANOTHER 30-days to get my check back. When I went above Byway and reached out to Affinity Property Management, LLC they will not return my calls/messages. I called them today and they hung up on me before I could even say "Hello". This is a SHADY company. I do not even know how much of my deposit they kept, because I still have not received an itemized list. How can this be legal? What is my recourse other than small claims court. I do not have the money nor the time to file.
