Mr***,Please find my itemized responses below to the company’s reply to my complaint:Item 1: It was in May (not June) that I began advising my sales rep Travis that the job had not been completed and no final inspection was scheduled That was also the time I originally made the complaint about the nails in the yard (which I found another one just yesterday), the spare shingles, the roof stack leaning, and none of them being painted. I had to make two other calls to Travis (at each call and text I was reassured he would take care of it) before I was told someone “would come out”No inspection was ever scheduled, Bruce showed up unannounced and half painted the roof stacks and leftI didn’t see or hear from anyone else until Dan emailed me on 6/4/requesting I contact him in regards to late payment. A meeting was scheduled for 6/8/at 4:30PM to resolve all outstanding issues (which both Dan and Bruce were over minutes late)I personally witnessed Dan and Bruce stand in my back yard and chat while claiming to sweep my yard for nails (for the second time)It was at this meeting that the payment agreement was established with the understanding that the first payment of $would not be taken until 7/10/The first payment was not taken from my bank account until 8/17/(again NOT 8/as agreed)Between this payment and the September payment my debit card was compromised and cancelled, which caused September’s payment to be denied. My card wasn’t even replaced until 9/18, which I had to go get from a local branch versus being mailed one as I was instructedBefore I could correct all of my payee information with multiple providers, I was contacted on 9/and told a lien had been placed on my home and further action would be taken if I didn’t give them $I feel I have been lied to and now being threatened by this businessI have also not been provided an explanation as to why I owe $when I was never even late per our agreementPayment was taken 8/17, a lien and a $debt materialized days after the next payment was to be taken.Item 2: if spare shingles aren’t left at a job site why did my neighbor get to keep his from this company? Why did Travis tell me repeatedly that he would get them for me? Why did his contractors leave them at my location per my request? I pay for that insurance policy monthly and have for almost years, that policy paid for the materials used on my roof therefore did I not pay for them?Item 3: No inspection was scheduledIf I had scheduled one; why would I miss it? I had been begging for someone to come out since a mere few days after they installed the new shingles. Item 4: The warranty paperwork was brought to the payment arrangement meetingThis is the only part of the response that holds any truth.Item 5: The credit of $was supposedly a “Marketing Discount” as they were going to put a sign in my yard, but failed to even complete that taskThey were going to charge me $in “finance charges” because of the payment arrangementPlus, their $per month processing feesAll of this wasn’t even mentioned until the payment agreement meetingI had made his people aware of my lack of understanding of the entire process before we began and was told not to worryI told them from day that I didn’t have the full deductible and was again told not to worry about it that the company “would work with me”No mention of finance charges, no mention of processing fees etc.Item 6: The payment arrangement I agreed to was never followed from the very beginning and it was not my faultI provided all information to the company on 6/8/and agreed to $on the 10th of every monthThey failed to take July’s payment for unknown reasons, they took August’s days after the agreed upon date, and before I could correct the debit card debacle they started bullying me with threats.Item 7: I have stood by my agreement and have given them all the information they requested for paymentShould they not process payment, I should not be held responsibleI have withheld providing the updated info because I do not want them trying to take the $they claim I owe.Item 8: I would LOVE for the insurance company to start a fraud investigationWhen Travis filed the claim with State Farm he used an old date of a storm that happened in I was told that when the adjuster contacted me to simply “play dumb” and claim I had no idea that the damage was there. Item 9: I did not “retaliate” as Dan accusedI simply look for fairness, honesty, and quality when handing over several thousand dollarsI feel that this company has failed to take ANY responsibility for THEIR shortcomings, and instead have put the blame solely on meDan himself even told me that Travis is one of their best employees but he has a habit of making promises he can’t deliverI wasn’t threatening the company; I was simply stating that I wouldn’t allow others in my circle to make the same mistake of trusting this company and I would do what was necessary to protect myselfIs that not one of the purposes of being a Revdex.com member? I am also filing a complaint with the State Attorney General’s Office and will be opening my own Small Claims case

This letter is in response to a complaint filed by a customer in retaliation of our Company trying to get paid 5months after the job was complete and the payment was due. We have been in business for almost a year andcompleted hundreds of roofing project and this is the first time anyone has filed a...

complaint with the Revdex.com.• Weeks after completing Mr. [redacted] roofing project and weeks after us trying to reach him for payment inJune, he advised us that all debris was not picked up and that some vents were not painted as promised.My partner and I promptly responded by personally visiting his home to take care of his concerns.• We do not leave extra packages of shingles because we purchase additional materials in case his insurancecompany measures the roof incorrect ly we are not holding up the crew while we pick up add itionalmaterials and we do leave behind open packages if there are any.• We did schedule a final inspection and no one was home when we arrived.• His warranty paper work was dropped off when we finally reached him when trying to collect the finalpayment. We have included a copy for your convenience.We have enclosed our contract and our email correspondence with Mr. [redacted] for your convenience. We interactwith many customers and over time we have learned by peoples' actions when they are not acting in good faith.• We negotiated a new roof for Mr. [redacted] with his insurance company which cost $5,953.22 of which his outof pocket cost was only hid deductible of $1,000. In an attempt to make him happy for the nails not pickedup and the spray paint not being completed we gave him a credit of $200. We also waived our monthlyprocessing fee of $25 per month for his payment arrangement.• Mr. [redacted] signed a recurring payment authorization (attached) and agreed to notify us 15 days prior to thepayment date if there were any changes to that account. We would have been satisfied with ANY noticeor communication.• Mr. [redacted] signed and dated a contract (attached) which includes very clear and simple language (highlightedfor your convenience) stating that "the homeowner agrees to pay the full amount allowed by theirinsurance including the deductible". We have also attached the insurance document showing what we
were to be paid. Mr. [redacted] may also be subject to a fraud charge initiated by the insurance company if weare not paid in full as the deductible is considered part of the payment by the insurance company. We willsend them a copy of our response to you as well.• We have been very patient evidenced by the timeline of our contact timeline with Mr. [redacted].• On 9/22/2016 at 12:02 I sent a very professional email to [redacted] because he was not returning our officescalls and considering it had been almost 5 months since we completed his project.• We have never threatened Mr. [redacted], on the contrary, his email dated 9/22/2016 at 12:31 (enclosed &highlighted portion) we took as a threat of harming our business if we continued collection activity. Aliisaid was that "negative publicity could go both ways and that we had been very patient".• The $500 we requested was for each monthly payment that should have been made under our paymentarrangementIn conclusion, we feel this homeowner has the money to pay us but chooses not to as evidenced by his statementin his email that his business is too busy to return our calls or contact us about a bad credit card. We will pursueall legal avenues including contacting him to collect the money he owes as we cannot work without a profit. Wewill try and only contact him in writing for our protection of his defamation and slander of what we may have said.We cannot remove the lien until we are paid in full. We will (or have by the time you receive this letter) file a smallclaims civil complaint to get a judgement and pursue a garnishment against him, his wife and his business. October 13, 2016Revdex.com Complaint ID#: [redacted] Date Filed 9/22/2016We will respond to Mr. [redacted] continued writing in order for ease of trying to follow:Item 1: The nail issues, leaning stack & painted metal on his roof was resolved in June.I appreciate that Mr. [redacted] has recollection of conversations that he had with the person that sold him the roof. But, the reason there are contracts especially for Companies with employees is so that all the parties are working with the same set of facts. We have provided the original contract signed by Mr. [redacted] and I have highlighted where it states that the homeowner agrees to pay the full amount of the Homeowners Insurance Estimate (which we previously attached) and the homeowners deductible. Whether Mr. [redacted] recalls the appointment or not Bruce K[redacted] did show up as Mr. [redacted] states to do a job inspection and attempted to resolve the unpainted stack.It is preponderous that we drove to his home to address his issues and only stood in his back yard to talk. We may have been talking while looking for nails but he still owes the deductible for the roof.We are not a bank or financing company., we are a small family owned business. We offered a payment plan to help Mr. [redacted]. We are sorry for processing his payment after the agreed date. Since then we have added procedures in our office in insure we run clients credit cards on time.Per Mr. [redacted], his card was replaced on 9/18/2016 and we have still not been called with the new information which simply shows that he has no plans of paying us for the work done.Mr. [redacted] violated our payment agreement (please see the terms at the bottom of the payment agreement) by not providing new payment information or by at least contacting us to make us aware of the situation. In addition, between 9/10 and 9/22 we made several attempts to contact Mr. [redacted] to find out why the card did not go through and he refused to return our calls or emails. This is why I sent the email 9/22/16 advising him of the lean and requesting $500 which represented the 5 months since we installed his roof without a payment.We used all the materials approved by the insurance company. And I have provided the approved insurance document in my previous response. Insurance companies measure these jobs very tight and do not provide money for us to buy extra materials to leave for the homeowners. We do leave any open or partial packages but it appears we had none on Mr. [redacted] project. A\n unopened package of shingles costs approximately $27 and we will be happy to provide a brand new bundle of shingles if he pays the entire deductible as required by law.The reason we did not put a sign in front of Mr. [redacted] home is that is the home and yard is run down and dirty and did not want a sign there. We had signs at other homes on that block.Item 5: Mr. [redacted] allegedly told our sales person day 1 that he did not have the full deductible but still signed a contract stating he would pay the full deductible. It has been almost 6 months and we have received $100. If Mr. [redacted] was operating in good faith I think we would have been paid by now. Instead he is trying to harm our flawless reputation by retaliating with this complaint.We have bullied or threated nobody. On the contrary we have been taken advantage of by a consumer, Mr. [redacted] that got a free roof from his insurance company and is trying to get away with not paying the deductible which is a crime. We have liened the home as provided by Idaho Statue, we have filed a civil complaint, we will seek a judgment and we will pursue garnishment against him, his wife and his bank account(s). We did not start any of this until 4 months of being subjects to Mr. [redacted] delays and deceptions. In summary, we are a small business that operate on small margins and cannot afford to let individuals like Mr. [redacted] take advantage of our hard working families. We offer to stand by our workmanship if there were any workmanship complaints. We offer a 5-year warranty which is one of the best warranties in our industry. We will also continue to exercise our legal rights to collect the money for materials and labor provided and completed as contracted. We really do not understand what the complaint is except that Mr. [redacted] does not want to pay. Mr. [redacted] signed a contract, the insurance company provided the scope of work, we did the work and Mr. [redacted] does not want to pay.
