First all you assumed I placed the property marker there which I did not It has been there since I brought the property over a year ago For over a year Top Notch yard service mowed the yard and never hit the marker which was flagged with a neon green tie. Secondly damage to your mower is your fault as well as damage to my property That is what people have what is called property damage liability insurance coverageWhether it was a rock, stick or rod is irrelevant and since I have no contract with you, no have ever seen one, I am not responsible for what you run overConsidering the rudeness of your employees, it is surprising you have any business at all I will make sure that the BCA in Brandermill in aware of your actions so neighbors in this area do not support a business that cares nothing about customer service or doing the right thing

A contract in which the customer was giving a estimate for non contract prices for services which customer would not be obligated for 1 year. He was been giving a estimate for mowing which included 30 mows a year. He...

was also giving a estimate for a basic contract which is mimial lawn should get which includes the 30 mows,4 weed controls, 3 fertilizings, 1aeration, and 1 seeding. And he was also giving a deluxe contract which is highly recommended for best results of lawn which includes 30 mows, 7 weed controls, 6 fertilizings, 2 aeration, 2seedings. Customer decided to go with basic contract. Customer was not obligated to sign contract he made a the choice to. And is obligated to pay $93.75 month for services. We only take on a certain amount of customers per year so we hold all customers to there commitment. To the allegations of missed service we are a small business and there are times where weather or equipment failure may cause us a delay of mowing couple days. It is not true that there was any delay of week or more. Lawn would not go 14 days between mows unless needing to be due to dry weather or slow growth. As far as customer statement that we damaged his lawn the week of 8/8. Customer was notified 8/15 after mowing to turn his irragation back because his lawn  had puddles in spots where customer had been over watering lawn. It had not rained since 8/7.  Customer complained about spots a week later and states he is aware lawn was to wet and stated he wanted to cancel his contract. At this time we let customer   no that spots in his lawn were caused by over watering. And that when we do aeration and seeding in september that any spots in lawn will be fixed. Customer also stated his dis satisfaction with weeds in his lawn. We let customer no that with his contract he choose mimial treatments to do for his lawn for best results we would recommend deluxe contract which would give customer even better results. We also made customer aware we will be doing his next weed control treatment in the upcoming weeks to prep his lawn for his upcoming aeration and seed. What we would like is to honor our contract which we have. Review: I am in a lawn care contract with Affordable Lawn Care and I believe they have breached the contract with multiple non-performance instances and damaged my yard. Given the inconsistency in performance and my dissatisfaction with their service, I asked to severe the contract and pay for their services performed to date on a pro-rated basis. They are claiming I signed a contract and will not release me from it even though I offered a fair settlement. In fact, they immediately threaten to take me to court and tried to intimidate me rather than work out an amicable solution. It has become evident to me this is their standard of practice and their treatment of customers.

Prior to executing the contract, I specifically asked for a cancellation clause in their contract if I was unhappy with the service. They assured that it will not be an issue that if I communicate with them they will resolve the issues. I have communicated my dis-satisfaction and the response from the company has been excuses and explanations (and accusations of my fault) that did not cure the breaches. In almost all instances, I had to live with their non-performance. I have all the emails and texts to prove these discussions. I realize they have a contract, but emailing or texting with excuses and explanations and blaming me does not constitute curing their non-performance and, as such, I have a right to severe arrangement because of that. The bottom line is they have not performed.

My issues:

1) Wk of 4/6 -Did not mow that week because the mower was down

2) Wk of 5/30 – Did not mow that week because the truck was down

2) Wk of 7/4 – Did not mow b/c they were in the emergency room due to heat

3) Wk of 8/8 – severely damaged my yard with mower track marks accused me of over-watering when it had rain twice that week.

4) 8/22 – I was extremely unhappy with the amount of weeds in my yard. I sought to cancel the contract and move forward. They’re telling me I didn't buy the delux pkDesired Settlement: Severe the contract due to their non-performance. I am fair and am willing to pay them for their services to date on pro-rata basis as I proposed. They can keep the payments through August and the last months of payment (which I made upfront for their mows and 2 fertilization/weed control sessions). I am not seeking damages to the yard even though I firmly believe it's their route schedule that has them mowing my yard right after it rains.

They are threaten to sue me for the $562.50 remaining under the contract (work that they have not yet performed). I do not wish to do business with people that have been extremely rude and tries to intimidate me. I just want to move on.

Review: I contacted them to mow the yard on May 11th and when they arrived, the guy mowing hit a marked IP pin (property marker) with his mower which flew through my front window. This is a 10" long steel rod that had a lime green tie on it which made it very visible. When I went out to tell him he broke my front window, his comment was"I knew I hit something with my mower. I'm sorry you're upset." He then proceeded to load his riding mower back on the trailer and drove off. When I tried to contact the office, no one would pick up the phone. My window costs [redacted] to be replaced by Budget Glass on 5609 Hull Street. I am glad no one got hurt by the steel rod.Desired Settlement: I would like to have their insurance cover the cost of my window replacement.

I expressed that I was not happy with the work done. The owner proceeded to site things that were untrue on a public forum with the intent to humiliate me. Buyer beware of this owner. He has no common decency.
