Complaint: [redacted] I am rejecting this response because: This is a new excuse So now his claim is that he doesn't know who he was dealing with because HE failed to include the clients name on the proposal, is that correct? Why was this not his original claim to the Revdex.com? If an unknown client was making an unknown claim, why was he attempting to defend himself with his long response which confirmed that he knew the details of what has happened?The good thing is that he did not rebut or refute anything in the last response, which is big progress.This new excuse is rejected for many reasons.The proposal was written by John R [redacted] at Affordable Portable Housing, any such failure was his own, therefore any vague portions are decided in favor of the one who did not write the proposal/agreement/contract.He accepted money as a deposit and attempted to do work, and he claims that didn't know who he was dealing with?1-The proposal was sent to the indicated email address, [redacted] Showing knowledge of the email address.2-The proposal was for the project in Costa Rica Showing knowledge of the project location.3-The wire transfer was made to his account as a deposit Showing that he provided the account number.4-Over email's repeatedly asking/answering the same questions confirm that he was attempting to work on the indicated project.5-After failure to perform any work, a partial refund was returned to the correct address, to the one who originally initiated the wire transfer for the deposit, #3.If someone unknown wired money to his account and he failed to return the money, wouldn't that be theft? Should I be filing a police report? Why would he accept money that was not meant for him? Why would the proposal include the project location, Costa Rica? Was this a lucky guess? Why would he repeatedly send dozens of emails to the correct email address asking questions about a project of which he was unaware? Why would he argue about a refund? Why would he return only a partial refund? Why would he admit that his time is worth something(supposedly doing work)? How could he guess the correct address to where to send the refund? There are many other questions that could be asked, but John R [redacted] at Affordable Portable Housing the one who drafted the "Drafting etc Proposal for [redacted] *, Costa Rica" bears the responsibility for his own errors His actions show that he knew who we were, and the wire transfer shows who sent the money We made the deposit and acted in good faith and responded to all questions via emails This is nothing more that another attempt to avoid accepting responsibility for the failures of Affordable Portable Housing, specifically John R [redacted] with whom I was in communication Sincerely, [redacted]

every attempt to do the work, and am still willing to do it if the complainant

I am rejecting this response because:The reply claims that there are two issues which created this problem: 1. inability to provide a hand drawn sketch, and  2.  supposed failure to answer questions.1)  Poor sketching ability was admitted from the outset so a PROFESSIONAL floor plan was provided as a reference to modify.  Why sketch something new when we can use an existing professional floor plan.  Or is it being suggested that a hand drawn sketch is better than an existing professional floor plan?2)  Answers were provided to all questions were repeatedly answered.  How many times do we need to state the square footage?  So unless someone wants to claim that a Professional floor plan is inferior to a hand drawn sketch and that basic information needs to be repeated multiple times then the statement, "So his
complaint about how long the process took was completely driven by
these two issues that he failed to mention in his complaint." is now shown to be false.  Furthermore, the fact is that answers were repeated multiple times and the floor plan provided in lieu of a sketch was included in the original complaint.  3) A third reason is stated for the problems, supposed lack of communication.  How many times do we need to repeat the same communication, if one is in "a jungle" or on the moon, should one have to repeat the same information ad nausea?The information necessary to provide a basic floor plan was provided in the attached floorpan in one of the first emails dated 6 June, 2016.  That particular email detailed the general shape, size in square footage, and changes.  That attached floor plan was mostly correct.  With a provided floor plan, FROM ANOTHER ARCHITECT, size, shape, and modifications desired.  We believe there was more than enough information to do some work, since there was already a floor plan created that was provided!Most communications after that original email, regardless of my physical location or time lapse to respond, were answering questions to information that had already been provided months before.   Another example found during the writing of this email: a week after the email of 6 June, 2016, which specified the square footage with the floor plan attached, we were asked on 13 June for the square footage again.   We made no additional changes, except to eliminate the loft over the terrace since John could never comprehend the loft concept, and there is no proof to such a claim.  The majority of emails were requests to information already provided. The claim that I was "vague" is laughable since since my mother feels totally the opposite as I usually am overly specific.  Furthermore, she was unaware of these details to avoid upsetting her, until John took the time to look up her phone number and complain to her, so any claim of being "vague" was based on what John had said to her with her only hearing one side of the story.  She would feel quite different now that she knows what has happened.  The refund was demanded for two reasons, neither of which were time dependant,  1. the necessity to repeatedly convey the same information already provided, 2. and the inability to grasp concepts such as a "loft over the terrace".  After 6 months we said enough and asked for the refund.  We do not want John to do the work because we feel that he is unable to provide the service that we desire.  Conclusion:  The critical point that we want to emphasise is that we provided a professional grade floor plan to modify, which we claim is superior to a sketch.  From the outset the required information was provided.  Attachments APH-1 to APH-3 are included to show this.  Furthermore, attached is one of many emails, APH-4, in which we needed to repeat information.
