Complaint: [redacted] I am rejecting this response because:The purpose of filing our complaint with the Revdex.com was not to negotiate a settlement with [redacted] and his companies [redacted] and Affordable Tree Care There are other legal means to address that issue However, $is more in line with what we expect [redacted] given his representations on the day of the spraying The purpose of filing this complaint with the Revdex.com is to makes other consumers aware of the unethical and potentially illegal way in which [redacted] conducts his tree spraying business(s) Since we have already address [redacted] many of our concerns in previous communications with the Revdex.com, we will confine this response to his latest comments Here are the facts:· Colorado Pesticide Applicators Act (Title Article 10) requires Pesticide Applicators to be licens [redacted] by the State and provide property owners specific information regarding the pesticides appli [redacted] on their property To date, [redacted] has not compli [redacted] with the law He claims he left a warning sign, as requir [redacted] by law, on our property, which is simply false We have talk [redacted] with other neighbors who also us [redacted] his service and none of them receiv [redacted] this information Some didn’t even get bill, they simply paid him on the spot.· He claims to charge by the tree However, he charg [redacted] us and our neighbors $each Are we to believe that we all have the same number of trees? This is in addition to the fact that he misrepresent [redacted] that he would charge $for the smaller trees and $for the larger trees.· After receiving the bill, we left a voicemail with [redacted] to discuss the surprising fee and determine what pesticides were us** He did not return our call.· On December 9, [redacted] drove to our home in a blatant attempt to intimidate and threaten my wife He has multiple phone numbers to reach us, our email address, and obviously our home address We have a P.OBox, as do many people in Larkspur Mail is often sent mail to our property address and the local post office for***s the mail to our P.OBox There was no reason to show up at our home, unannounc**, other than to intimidate and threaten · I call [redacted] on December and to discuss our questions and concerns He did not return my call, although, he did text me “you are pathetic” He also recently left a message simply stating, “are you going to pay me or do I have file a lien on your property?” Obviously, he has my phone number· He did inde [redacted] file a spurious Intent to File a Lien which we disregard**· I have attach [redacted] photos of the ruts he left in our yard, damaging our lawn and potentially the sprinkler system· He claims he never post [redacted] anything on social m**ia Another blatant lie We have a copy of the post in our possession To support our claim of intimidation and threats, he post [redacted] the following, in part: “Would you like to me to share the video I have from my GoPro of you ” Only an unscrupulous and unethical business person goes to a client’s home unannounc**, secretly video tapes them and then attempts to blackmail them by threatening to post the video on social m**ia In that same post he said that he will contact the husband, who lives in Virginia Posting that a woman’s husband lives in another state is another clear attempt to scare her Fortunately, this is another lieHowever, it was concerning enough to file a report with the Sherriff’s Deptand consider a protective order In conclusion, he continues to libel my wife, lie about the circumstances surrounding his service, and attempt to bully us into paying an outrageous fee for a few minutes work Throughout this ordeal he has repeat**ly tri [redacted] to deflect the real issue which is his deceptive approach to business At this point the fee is secondary to the unethical tactics he has us** Originally, we ask [redacted] for an apology, which frankly might end this However, I doubt he has the integrity to issue such an apology Consumers deserve to be protect [redacted] from unethical businesses people such as [redacted] and his companies [redacted] and Affordable Tree Care We still don’t know what he put on our property or how much For all we know, it was water Sincerely, [redacted] ***

We invoice monthlyThe first invoice we mail** as she request** was return** as undeliverableThe second attempt to mail the invoice was sent to a previous address we had for their invoices to go to VirginiaThat too was return** as undeliverableAt that point after no return** phone call I had to not once but twice drive to the property to hand deliver or drop of* call** and again ask** for the invoice to be r**uc**I told her it had already been discount** and she may want to count her trees to confirm. Please show me one single post to social m**iaThat never happen** and doesn't exist any more than I have intimidat** you in any way in my response here on the Revdex.com forum. I believe any reasonable person can see thru this complaint for what it is regardless of your intentions?That said we will accept $and write of the remaining balance of $320. Thank you

I told you I don't even know how many douglas firs I had but the ones I do have are small, some are also bunch** together. I said you can come by the house and give us a bid, see the property, see the trees, talk to my wife, she is home during the day, I am not. I told you my wife is against spraying, we have kids and animals, she had a bunch of questions first before even considering it. You agre**!! I also had calls out to other companies. Yes [redacted] call** the sherrifs office to say I perform** work on his property without his authorization. That's what the officer said on my voicemail when she left a message. I call** back 3 times with no success thus I never spoke with any sherrif live so I was never warn** of anything. This fact can be confirm** with the Douglas Co. Sherrifs office at ###-###-####. Please do call.It is extremely hard to believe that any company would spray your trees without being contract** to do so. Furthermore it's equally hard to believe the Pike National forest f**eral land was being spray** that any entity f**eral or otherwise would come unannounc** and spray chemical on a residential property. Especially since we didn't spray any other trees on either house next door. We don't force anyone to employ us. That's a ridiculous and untrue statement. We have been turning down work for 9 years due to the volume of calls versus the desir** size of our company.I can assure anyone that our 13+ years in business in the same county and our revenues clearly prove there's no "con artist" here.Yes I did speak with [redacted] briefly once to give a exact price per tree which he admitt** and he said please go ahead and spray. We sav** 1000's of trees during this epidemic. I never go out on consultations after being hir**. It's not a sales job. I **ucate with facts from CSU and let clients make a inform** decision. We are talking about a $280 invoice for 20 trees. We have a $150 minimum. I don't think anyone would last a year in business if they truly practic** the methods we are being falsely accus** of. Common sense. The bright yellow flag left in the yard per Co. Dept. of Agriculture list** the chemicals us** and were told on the live phone call when I spoke with [redacted]. There was no reason for a written bid which was never ask** for and which we don't ever do for pesticide application. We don't spray trees with poison. That would kill the tree. We spray pesticides to trees FYI.   We have been successful at doing business by phone with no issue. A verbal contract is enforceable in the state of Colorado. That said We will accept the r**iculous offer of $50 for the $280 invoice and will write off the other $230 thank you

Hello [redacted],
There were no deceptive sales tactics and I never li** about anything. [redacted] stopp** us by standing in the middle of [redacted] and ask** me to spray all of her trees. I respond** with the price of $14.00 per tree and she said "that sounds great." I have no idea how...

that was taking advantage of anyone for anything. There was no bait switch of anything. She also ask** if I would give her a break on the total price because she had so many trees and that some were smaller than others. I told her that I wouldn't charge her for the full number of trees which I didn't. There are over 80 trees on the property for which she has liv** in for 13 years. Hard to imagine a reasonably intelligent person wouldn't have any idea of approximately how many trees they have on their property. [redacted] was sent a invoice for a total of 55 trees @$14.00 per tree as discuss** which we can provide at any time. As to when I drove to her house and hand deliver** the invoice she was completely intoxicat** at 3:00 in the afternoon. I crept my 3/4 ton truck to accomplish a 6 point turn around on her short driveway and there was a imprint of my tire about 12" into her snow cover** grass just off her driveway which didn't dig up anything. [redacted] was spilling wine all over, she couldn't help slurring her words and spitting while attempting to talk to me repeating the same thing over and over. At that point I excus** myself politely and told her I was going to leave to which she grabb** me and tri** to pull me out of my truck. She then threat** to "trash me" on social m**ia. She tri** putting a negative post about me on Larkspur neighbor to neighbor which was remov** by the administrator due to the nasty nature of her post clearly violating the rules of the site. She then proce[redacted] to call my cell and my home phone 23 times in less than one hour of time after I left her house. I simply respond** in a professional manner on ** with the truth to which she call** libel. She post** another negative message two minutes after the original post thanking the many who had call** and spoken to her regarding the negative post. How could she have had several conversations and make the post within two minutes. Really?
The tree removal we did for [redacted] & [redacted] as it was approv** by [redacted] & [redacted] in 2006. This is the first we have ever heard of any issue with that job. If she had issues with my company than why would she stop us in the street and ask for service yet again? It was a 83 foot Douglas Fir tree we fell**, cut up and remov** for around $300 which is about 25% of industry average in Larkspur, Co.
