The carpet in question was a "Supply Only" order based off of the customer's request for After Eight to order 1600 square yards of carpet. The carpet was ordered and received as requested. After the carpet was received the customer requested...

the carpet be cut into 12'x 24' pieces which were cut at no additional charge. Further the customer requested the carpet be delivered, however he did not feel he should have to pay for delivery. After Eight delivered all 1600 yards to the customer with After Eight paying for the delivery. The carpet was ordered as 1600 yards of the same dyelot, and the rolls of carpet are provided by the mill based off of the rolls in stock at the mill at time the order is placed. The roll sizes provided by the mill are not all one specific size nor are they all equally divisible by 24 and this was explained to the customer when he requested the roll be cut into 12'x24' pieces. The customer did receive 1600 square yards as shown on the attached invoice however it appears the customer either ordered an insufficient amount of carpet or chose not to seam the roll balances for completion of his project.

I do not accept the response because I still think that I have the right to chalenge the shortage. Once again, they came and mesured how much carpet we would need and that would be enough for 50 rooms. The pieces they send covered only 48 rooms and yes we seamed the pieces that were smaller than 24 x 12 ft. and still we came short 2 rooms. Acording to the manufacture it was 1600 yards, [redacted] but still the supplier should have counted better before they deliver it to us.
[redacted] it is the supplier's obligation to figure it out and refund us for the shortage. Now if they still do not want to refund us, we are willing to take it further.

There were some issues with the first installer, which were generously financially compensated for. The representative from [redacted] was present on site and a sample of the carpet was submitted for testing and the claim submittal and findings...

are attached within. We have spent a large amount of time trying to arrive at a resolution for the dissatisfaction of the colour chosen, even after the claim and dye-lot submission was clearly denied. The offering of an equivalent valued [redacted] carpet for replacement (excluding labour/removal) at no charge is not related to warranty, it is solely goodwill. We will uphold the current offer for the interim, however not indefinitely. After Eight does not manufacturer the carpeting, and the offer has no cash value nor is it transferrable. We have exhausted the avenues in this instance and believe After Eight and [redacted] have gone above and beyond to find a fair and equitable solution.
