I told the individual to bring the car in to us so we could check it out for free, which we are NOT required to do, but that we would try to help them determine what was going on. The individual did not bring the car in then and has not to this date. The individual took it to a transmission repair shop and was told it would cost more to have it further examined, which the individual did not do. The shop gave the individual an amount to fix it although they had not examined it further. This individual is blaming me for the transmission problems and it is not my responsiblity. The vehicle was purchased AS IS(and I have all DMV forms signed to that affect) and they declined my offer to look at the vehicle or purchase a warranty. I am truly sorry that the purchaser had problems with the car, but while I had the vehicle for sale my experience showed no problems. It is a high performance car and was advised it might be wise to purchase a warranty, but declined. The statements in the complaint are not factual, may be based on buyer's remorse and as stated before I followed all the DMV rules and regulations and did nothing wrong. Review: Was promised a number of things when purchased a vehicle and a ton went wrong.

I purchased a 2005 Kia Sorento on May 15 2013 from a man that advertised this it on craigslist. When we met him he was very nice and seemed legit. he told us he was a small deal out of Sacramento, (Agent Auto) and that the car has a warranty. It was for a year or 12,000 miles. The car its self had of 160,000 miles on it. He told us that because we are buying the car here in Reno we don't need to pay the California sales tax. So we paid him $5500 in cash and he told us he would be back with the car two days later because he wanted to take it back to his shop in Sac and have it detailed and had to fix an a/c problem it had. He wrote up a purchase order and put down the miles it had on it before he left to go back to Sac in which I thought that was weird. So before he came back into Reno he called and said there was a problem with the warranty and that he could only do it for 6 months instead of a year. I told him to forget it then and which he changed his mind and gave us the full year. The only reason I bought the car in the first place is because of the warranty. So when I got the vehicle 2 days later, it hadn't been detailed and it smelled like smoke.

3 days later after I got the car the check engine light came on. I took it down to the auto store to have them run a test and they said it was the o2 censers. I had to take it to a mechanic to have it fixed and of course that wasn't on the warranty. It cost over $200 for parts and labor to fix it. I had to take it to a mechanic because it wouldn't pass smog to have it registered. So I then take it down finally 6 weeks after the purchase to register it and am told I have to pay NV and CA sales tax which is over $500. So in turn I have paid over $700 just to register this vehicle that has turned out to be a Lemon 5 days after purchase for a man who had promised us that he wouldn't screw us and did. Desired Settlement: I would like to get my money back from him and take him back the car. I am a student with two children living off one income, my husbands, and can not afford to keep fixing a car that was told was in good condition and ran like it did intill I was given it 3 days after the test drive.

The complaint filed against me is inaccurate, comprised of exaggerations and false statements intent to damage me as a person and my company as a longtime legitimate business. There is a good possibility that I am going to seek damages if this is not dropped.

I sold a 2005 Kia Sorento to [redacted] on X-XX-XX which I had advertised on Craigslist. The stock number was posted and when I was contacted I identified myself as a dealer. I told her the price included a 12,000 mile or 12 month warranty and furnished her with a brochure outlining what was covered. The vehicle needed to be detailed (cleaned) and I explained I would do that for her either at my shop or a detailer in Reno. It was also explained to her that the air conditioning was not blowing cold and I would fix that. I stated I could do that and we could complete the deal when I came back to Reno. They wanted to complete the deal right then, so I wrote up the contract, noted the mileage and accepted the money for the vehicle. I transported the vehicle on my trailer back to Sacramento and repaired the air conditioning. Unfortunately, my detail person had a family emergency and could not do the detail on the vehicle. I notified the buyer and asked what would be a convenient date to do the detail in Reno and we scheduled it for the following Friday in Reno. I also told her that I didn't think the warranty company was going to approve the 12,000 mile or 12 month warranty because of the mileage on the car, but I would do my best to get it approved. The company would do a 6,000 mile or 6 month warranty with no problem, but at this she said if she could not get the 12,000 mile or 12 month warranty she did not want the car. I called and had a conversation with the warranty company and they approved the 12,000 mile or 12 month warranty. After informing the buyer she stated she wanted the vehicle.

After delivering the vehicle to Ms. [redacted] in Reno we set at least 3 different dates to have the detailing done, all of which she called and cancelled for various reasons. I told her to just drop off the car at my detailer any day of the week except Wednesday and it would be done and I would pay for it. To date she has never done this.

A couple of weeks after she purchased the vehicle I received a call from her informing me that the check engine light had come on (this light had never come on prior to the sale) and she could not get it registered until it was smogged and needed to get it fixed. I told her where she could take the car and have it checked for free. I also met with her at my hotel later and scanned the vehicle for her to confirm the findings, which was that it needed a 02 Sensor. I told her to call the warranty company and see if it was covered under the warranty, which she did and was told it was not. I then told her I would make arrangements to get her the part at a discounted price and have my associate mechanic in Reno install it. If she used my sources I told her I would pay for half the cost, of which I had no legal obligation to do since the 02 sensor went bad after she had the car for 2-3 weeks. She chose not to take advantage of this and took it to a mechanic she selected which ended up costing her more than it would have had she followed my advice and taken it to my mechanic. She still has an open invitation to have the car detailed when she chooses; she just has to get the car to the detailer.

In regards to the taxes she is claiming she had to pay, you and I know you do not have to pay sales taxes on a vehicle in both states and I am sure they are either misinformed or lying. As far as I know Nevada does not collect California Sales Tax and send it to them.

As far as my phone being disconnected, either she was dialing incorrectly or is lying about trying to call me. My phone has been continually operational with the same number for the last 15 years and is on 24/7. I never received any messages from her.

Her claim that the car turned out to be a lemon (another false or exaggerated statement)

is ridiculous since she is still driving it. I'm sorry she did not utilize my expertise in fixing it, but spending $200.00 to fix a problem on a used car hardly qualifies for it to be a lemon. There is nothing wrong with the engine, transmission or rear drive which is all covered in the warranty. It is not my fault she has not kept the appointments I made for her car to be detailed in Reno and having to pay Nevada State Taxes also does not make the car a lemon.

Everything I did in this transaction was done in a professional courteous manner and at no time did I say I would not help her with any issues she had with the vehicle. I am a reputable, long time business man having sold over 5,000 cars to clients in 20 years of business. My offers to help were ignored and her complaints against me are unfounded and not justified.

In response to Agent Autos reply, these accusations are not true. Yes I did buy a car from this man, and yes I am still driving it because this is the only vehicle I have. When I bought this car from [redacted] I gave him a $500.00 down payment before he left and took it back to CA. The car was not put on a trailer and taken back to Sacramento because when he brought it back 3 days later it had over 200 miles on it, so him saying he took it on a trailer back is false. When we spoke to [redacted] before he came into town, he told us to meet him at the Sands Casino where he had another car to drive back to CA. Also it was actually 2 days after he had brought it back that the check engine light came on and my husband called him and told him that same day. I did then take it and had the oil checked and changed at [redacted] They showed me that the oil was black and that the air filter was very dirty.

We then told him the O2 censor was out and he said that was not a part of the warranty. He did tell us to call a guy that does his warranty work. We called the guy and he said he didn't do work for him anymore. The weird thing was that [redacted] called back a few min later and yeah the guy said he didn't want to do it and that he would give us a name and number of another guy. In regards to having the car detailed, we called him over and over and tried to get it to have it done and wouldn't hear back from him for a while.

My husband called and told him that the car would not pass smog till the O2 censor was fixed. Yes [redacted] did come down and put the car on his scanner to find that it was the O2 censor, and then reset it so that the check engine light would go off. We did find out that unless you are a mechanic, it is against the law to reset it unless the problem was fixed first. We took it to [redacted] auto parts store before that and asked them to do it and they said the same thing that they couldn't by law.

We did call the CA DMV and ask them if you could sell a vehicle there if it wouldn't pass smog and they told us no. Also asked them if this vehicle by vin # was ever smoged there and was told no. We were told by [redacted] that he had a smog certificate but that it would be no good here in NV anyway, so he never gave it to us. We did ask him to help pay for the expense of the of the O2 censor so it would pass smog so we could register it, he said that wasn't in the agreement and that he would think about it. A few days later said no I don't think I can do that since it's not covered by the warranty.

As to us being misinformed about the taxes we had to pay for both states. I have proof that we paid more taxes because the taxes in the state of CA were never paid on this car when I was informed that they were. On the sales paper he wrote no sales tax. When I took it to the DMV here in NV to have it registered the lady told me it was over $500. I then asked her why it was so high and she told me it was because that when you buy a car in another state you have to also pay their taxes to. So I ended up paying over $500 to register it. I have receipts for all of it.

I realize this man has a business to run and I don't want to ruin anybody's life, but I have bought many cars in the past and he has screwed us in this deal. You can't being a dealer sell a car that never went through inspection, and had the check engine light on. Like I said before, we are living on one income, I'm going to school, and we had to borrow money to buy the vehicle to begin with. With all the unexpected expenses we had to pay to even register this car and even have it run like it should. As far as lying about any of the things I said to begin with are also false actuations. I did try and call him on the phone number he has listed on line as a business number and it goes to a fax.

I would be happy to let this go if [redacted] would help pay for the things I asked for, having to pay the $200 for the mechanic and the $379 it was for the CA taxes that we had to pay.

I am writing you again to address the last response from Ms. [redacted]. Contrary to what she stated I did in fact transport the vehicle in question back to Sacramento on my car trailer and did not drive it. Had I driven the vehicle it would have had more than the extra 200 miles on it that she is claiming. It was driven in Sacramento to test the air conditioning which we were checking for her, but no where even close to 200 miles.

I scanned the vehicle in order to assist Ms. [redacted] to confirm that the problem was in fact an 02 Sensor. We agreed to reset it and see if it came back on or was a fluke. After scanning the vehicle I referred her to a mechanic that does work for me in Reno. He did not tell her that he didn't do work for me anymore, but did tell her that he did not do work on Kia Sorentos. He has and continues to do work for me and this is yet another example of how Ms. [redacted] is consistently misrepresenting statements thinking it will benefit her in some way. Once the mechanic told me he did not work on Kia Sorentos I contacted Ms. [redacted] and gave her the name of another mechanic in the area that would work on Kia Sorentos.

As far as her contacting the California DMV and being told this vehicle had never been smogged in California, I have no idea what she is talking about. The Kia Sorento was in fact smogged on 1/2/13 and passed. I am enclosing a copy of the smog certificate with a hard copy of this letter that I am mailing to Revdex.com.

Ms [redacted] is also claiming that she paid California AND Nevada taxes when she registered the vehicle. When she purchased the vehicle from me I told her she would not have to pay any California taxes, but would be responsible for any Nevada taxes. I contacted the Nevada Department of Motor Vehicles and they confirmed that they DO NOT collect another State's taxes when registering a vehicle and the taxes Ms. [redacted] paid were ONLY NEVADA TAXES.

When you register a vehicle in Nevada that has been purchased from a dealer you pay a Registration Fee, Governmental Services Tax and in some counties a Supplemental Governmental Service Tax. The representative at the Nevada Department of Motor Vehicles stated that these could amount to over $500.00 and the receipt Ms. [redacted] received would have a breakdown of these charges. I would like Ms. [redacted] to provide a copy of the receipt in order to see the breakdown.

In regards to her not being able to reach me, I provided her with a business card with my telephone number and fax number which she stated she lost and that "my website" had only a fax number. I do not have a website, never have and whatever is posted on the internet for my business number was posted wrong, which is not my doing or responsibility.

This is becoming a "he said/she said", but the facts don't lie. Again, once a problem was identified I offerred to get the part at a discounted price which would have been $70.00 and the installation would have been $30.00, but she elected to go another means which resulted in her paying full price. Payment of her registration fees and Nevada taxes is not and never would be my responsibility, but is the responsibility of the person who purchases the vehicle.

At this time if Ms. [redacted] is willing to withdraw her complaint I will send her a check for $100.00 which is what she would have paid for the part and installation had she followed my advice. I am in Reno on nearly a weekly basis and the offer to have the vehicle detailed is still open, all she has to do is contact me to set up a day and time.
