Complaint: [redacted] I am rejecting this response because: It was not just an email conversation, but also a phone conversation I have attached my phone record so you can see this as well The email is to show you proof that we started the conversation of selling the home because when I first discovered the lease was renewed against my will in August you told me that you had no records in my file This issue here is your employee who is acting as our agent has not been documenting conversations and updating the file as promised and instructed After the email three days later we had a phone conversation where she said she would have the real estate agent reach out to us to see our options before the next lease renewal which at the time I believed was October not August As you can see in the email I thought the home was supposed to be leased until October which is why I was very shocked to see the renewal in the August bill for you acting as my agents for my property.Your very own real estate agent advised against selling the property because the fact that it is leased and would only appeal to investors at this point and it would cost us at least 15k to sell it now as opposed to sell itnow with out a lease on it This is not an issue of goodwill this is an issue of damages Regards, [redacted] ***

Complaint: [redacted] I am rejecting this response because: That is just a copy of a reply the company has already sent us The company knows we sent an email on 4/but we had a follow up phone call that the company has yet to acknowledge and admit we had on 4/ During that phone call we discussed with the companies agent that we wanted to have the real estate agent contact us prior to renewing the lease so we could see our options for selling the property but this was never done Regards, [redacted] ***

***-You are correct, it was largely the same response you had already been provided The reason for that is because it is our response The written instruction we were given was that you would consider selling if the current tenant did not renew "Assuming the [tenant] does not want to renew are you all able to sell the house?” In no way was this an instruction not to offer the tenant a renewal, which is what we do at the end of a lease absent a contravening instruction There was no written instruction from you, at any time, not to renew the tenant’s lease Therefore, the request to “eat” an additional sum of money for an action that was not a “mistake” is outrageous.You have been provided with waived management and renewal fees on your home until February, We did that as a gesture to you for being a client of ours I have also consulted some tax folks regarding the tax liability issue you mentioned (and provided you their contact information) in a further attempt to assist you We even offered to help you sell the house. We have exhausted all possible remedies of goodwill.Respectfully,*** ***

***-The waived management & lease renewal fees were a gesture of gratitude for the years you have been a client with Pyramis I don’t like the fact that you’re in a situation making you unhappy with Pyramis We do a great job a managing property for our clients and I felt like
it was the right thing to do Your April 11th email to us gave us no instruction not to renew the lease What it said was “assuming the [tenant] does not want to renew are you able to sell the house?” We offered the tenant a renewal, and they took it Had they not accepted the renewal, we would have contacted you regarding a sale listing There is no “correction” we can do at this time An option you do have is to offer to let the tenant out of their lease so you can sell it There’s no guarantee they’ll agree to it, but it doesn’t hurt to ask Even if they do leave, this is not a great time to list for sale With school starting, the market is already slowing down and not only will selling be difficult, there won’t be any cash flow Your opportunities for selling in the spring are likely much better That being said, I did confer with a tax professional regarding the capital gains situation and any options you may have You would have had to completely liquidated the property prior to July 31st of this year to take the exemption But, you do still have the like-kind exchange (exchange) available to avoid capital gains taxes If this is something you wish to explore further, I encourage you to speak with your trusted tax professional If desired, you can reach out to mine.Any large requests, such as a desire to sell, really should be put in writing in order to avoid confusion and remove any possibility for ambiguity Had such a request have been put to us in writing from you, your property would have immediately been flagged for non-renewal Instead, the April 11th email mentions the consideration of a sale, if the tenant didn’t renew That is what we acted upon
