I have attached a copy of my New Home Warranty for your information and reviewGrout and caulking are the responsibility of the homeowners after occupancyExpansion and contraction of building materials will occurIt is the owner's responsibility to maintain their house in a reasonable manner.To give you a little background about this case: [redacted] and [redacted] constantly made changes to the house plans; finish choices, etc throughout the building processWe signed a contract at the start of the house; I don't even think a week went by without [redacted] trying to change something and get it for freeHe would try to directly deal with my subcontractors and suppliers as if he was in charge of building this house [redacted] used to build houses, and thinks himself as a master builderSo you can only image what I had to put up with through this processTo make a long story short, at settlement they refused to pay for extras, changes and additional cost that occurred along the wayTheir daughter had married my cousin, which puts me in hard place on taking legal action against themI tried to be the better person and let it go, took the loss and marked it up as a lesson learnedI refuse to go and do anything else for free for them as they wouldn't appreciate it anywayNone of their complaints are covered under my warranty (which is standard among all builders).In response to ***'s treated 2xdeck boards, they are for some special finishing touch that he wants to add to his deck and have me pay for itHis deck is complete to the standard we build all of our decks and has passed all inspectionsGrout will expand and contract, so will siliconeAll electrical outlets were tested and passed the electrical inspection by [redacted] building code inspector from ***They were all in good working condition at time of occupancyThere is no warrant in any claim by the customer in this matter.Regards,Justin A***

Complaint: ***
I am rejecting this response because:Our builder was hired to do a job and that was to build our house correctly. I even told Justin I am detailed and will be a hard client for I know what needs to be done and how. He replied he has had worse clients. With that in mind we set off the wrong foot within weeks for he stopped communicating with me for there were too many mistakes starting to occur. I had to show up almost everyday to help with the process that was taking place for example: The concrete walls were being formed for the front porch and entrance. When I showed up they were the wrong size and Justin was nowhere to be found. I left a message for him so did the sub contractor and that day he had the excavator come back out and fix correctly before the framed and pour. If I did not show up Justin would have had the contractors pour the wrong size which would have led to a major cost for him to replace. Second, framers framed the first floor windows inches off the deck which means the glass would have to be temper glass for code, the framers did not know this information and Justin did not know to tell them according to them. Another example is the stone masons arrive on a Saturday and asked me where is Justin and where is my water. I had to go over to neighbors and ask to use their water so they could work that day. I could go on and on with just the building part and the sub contractors upset with Justin for lack of communication and the work that was being done.Next is the extras: Justin and I agreed to pay as we go on the extras for example: The well was done and Justin sends me a bill over $dollars more than the agreed terms which is fine however he never let me know the extra and just paid the well drillers and then sent me a bill without telling me the extras or asking why or talking to the well drillers to understand why. I paid it anyway to keep things moving forward. It wasn't before long that the changes we were making which we agreed on price and how the work would be completed, the changes just did not appearI had to sit with his truss company in their office to help make sure the trusses would work for they had issues making it work. When the extras started adding up, I asked Justin to settle up for he owed me money for changes and I owed him. He said wait till the end and that concerned me so I tried consistently to get caught up and he would not do so. Now we know why for at the end of the job he compiled extras of his own which were not in any discussions or agreed upon. He owed us thousands of dollars that we paid out of our pocket according to his allowances as wellDue to the nature of him being the cousin of my son in law we settled on a price to resolve and move on with us loosing thousands of dollars. His major statement to me was sue me, get in line I'm use to it. We agreed upon a price which was in his favor so we could move in. Water under the bridge lets move on.His warranty that appears is not signed by us for we never have seen this warranty!! If we did why would he not show our signatures? Justin did send men out to take care of our concerns which we appreciated however they messed it up even worse and said they had to come back and never returnedThey left their bucket of grout and tube of calk which is still where they left it. Justin was fortunate enough to sell another house beside us while building ours. Our neighbors had issues as well. He also returned to our neighbors house to fix caulking issues and nail pops which Justin states he does not cover. He also brought them a color pallet to match their grout. We were not that lucky. He made mistakes on their siding which had to be tore down for he did the wrong color and material according to homeowner. With all that said, if Justin wishes to send a contractor to correct our issues outlined in our email, it does not have to be him, he can send another professional to complete; that will be fine
