We are actively working with the customer to resolve this issueThe remainder of his funds which we did not immediately refund were used to purchase a Sonnen 10kWh backup battery system, solar panels, inverter and optimizers and rackingWe have all of this material on hand in our warehouse
After we had purchased the Sonnen system the customer decided not to go ahead with that part of the installationSubsequently he decided not to go ahead with the solar installation eitherWe tried to work with him on possible revisions to the plans for the solar installation that would have met his issues, but in the end he decided to cancelWe are a small companyWe do not have the cash reserves to immediately refund the money that is tied up in the equipment he asked us to orderWe have even offered to take out a loan to refund his money by Friday, OctHowever, we have not received a clear answer from the customer on whether this is satisfactory

I am rejecting this response because:Unfortunately, although Ailey Solar committed to returning the substantial amount of our funds that they are withholding (nearly $24,000), they have not done so and they have failed to provied a date when the funds will be returned An update has not been provided by Ailey Solar in nearly one full week.It appears that Ailey Solar may have chosen to retain nearly $24,of our funds without cause which leaves us with limited opportunities for settlement We hope that Ailey Solar doesn't force us to initiate an expensive lawsuit in the very near future, although it appears as if the situation is headed in that direction.Also note that we have been placed in an awkward situation, as potential customers of Ailey Solar have reached out to us to provide references regarding our experience with Ailey Solar We haven't replied to those requests so far, in hopes that Ailey Solar will elect to immediately return our funds.We would appreciate an update from Ailey Solar concerning our nearly $24,as soon as possible

Mr[redacted] received all the money and more than he was due last week. Why he has not responded that his demands are satisfied is not clear. We have yet to tell our side of the story except to note that Mr[redacted] is misrepresenting the facts.

I have not and would not misrepresent the facts.  We have now received the full return of our deposit from Ailey Solar.  Although it is not true that they retured "all the money and more", we find that this resolution is satisfactory to me.
