We are in receipt of your undated letter with attachments
With respect to the hot water tank, every conversation we’ve had with you only discussed the potential energy savings it might produce. We were never told that it would serve as a pre-heated water tank for use by the tankless hot water heaters. *** specifically asked you about the hot water storage and your response was that it was only for energy savings. Additionally, when the tubing in the water tank started to corrode, it caused the sulfur dioxide smell in our water. The corroding of that tube and its subsequent reaction with our water treatment system was never discussed or explained to us. The plumber you reference was not a plumber but rather the technician for the water treatment system whom, among others that we talked to about the tank, also advised its removal. We were sold the tankless hot water system as a means of providing an endless source of hot water, once the water is heated. However, we are experiencing loss of hot water when only one shower is running. If that system is designed to provide an endless source of hot water, why is not functioning properly? Additionally, the time it takes for the hot water to reach the upstairs showers has not changed since we removed the tank, indicating that it was not serving as a pre-heated water source. As stated in letter of June 20, 2014, “At the time the system designed by you was installed it was to provide hot water for two showers on the upper level. At no time since installation has that usage changed, yet a complete lack of hot water occurred on the 7th of June, resulting in the emergency service call.”
With respect to the geo-thermal system functioning with the Blue Canyons, if as you say, “the Blue Canyon system is at best a huge waste of energy, and at worst harmful to your health due to the dirty attic air being drawn into your living space,” why did you sell us a system that you knew was not going to function with the Blue Canyons? Prior to receipt of your certified letter, you had never mentioned the dirty air being drawn from the attic. You did however recommend we spend an additional $3,plus dollars to add more attic insulation. Also, from reading your letter concerning the sizing of the system, it appears you oversized the system to accommodate for the Blue Canyons, knowing they were not compatible with a correctly sized geo-thermal system for this home. Additionally, we set up a meeting with the Blue Canyon engineers to discuss the system, which you attendedYou cite the Comfort Institute as a source of information to “find out the truth.” We contacted them for the support you mentioned, but no one from that organization ever replied. We told you about the non-contact, and you said you would follwith them, but you did absolutely nothing to try and get them to review our system. Finally, we’ve been asking for over two years for the data and calculations used to size our system. You have said on more than one occasion that you would come to the house and conduct the tests to re-collect the data and provide us with the calculations on the systems size; however, you have never come by to re-collect the data despite our calls to your office. Your first excuse for not providing the data was that it was lost due to a computer failure. You don’t have bafor data of that nature? Now you have the unmitigated gall to tell us that the “data you use to calculate heat load and system sizing is proprietary, and I do not release that information.” It is obvious that you oversized the system to make a sale vice sit and honestly discuss the problems you saw with the Blue Canyons
One of the selling points of the system was energy savings we would realize. While our gas bill has gone down, our electric bill has increased tremendously. Based on your recent letter, it would indicate to us that you knew we would not achieve the savings touted as the system was oversized for this house. Additionally, we constantly reminded you of ***’s need for low humidity because of her medical condition. You had to know that over sizing the system would cool the house, but not get it to the humidity level desired, especially on very hot and humid days
The final two sentences of your letter indicate to us that you did not care that there was a potential conflict with the Blue Canyons, but rather chose to make a $60,sale. We submit that you are responsible for installing a system that functions within the parameters of this house, and as the reputable business man you portray in your sales pitch, to be honest and up front with customers, especially if you think the system may not function properly. The data you provided in your letter is meaningless as that type of data should have been provided prior to selling us a system that is not compatible with our home, something you had to know to size the system as you did
Finally, the overall tone of your letter, with its underlined words is offensive as it implies we are responsible for the situation as you were only providing a system that, “you insisted”. What type of reputable businessman installs a system that he knows won’t function properly?
As we ended our letter of June 2012, “We ask that you provide the answers to the question about the tankless water heaters; provide the data requested about the sizing of the system; and finally, provide your plan to get the Blue Canyon systems working effectively with the system you installed.”
Your response in the undated letter is not acceptable, and we will continue to seek resolution of this situation.
Thank you for time and consideration to this most serious situation
Respectfully,

Dear [redacted],

We did respond to Mr. [redacted]’s certified letter with a certified (tracking number: [redacted] response letter on July 18, 2014 which was received by them on July 19, 2014. I have attached a scan of his original letter to us and the response we sent to...

him. Page 1 is his letter, the rest is our response.

In short, Mr [redacted]s contracted with Air Doctorx to install a geothermal HVAC system in his home. He had previously installed a Blue Canyon system that is designed to reduce humidity in his basement by evacuating the air in the basement to the outside, replacing it with the conditioned air from his living space, which is then in turn replaced by the air from his attic or from the outside air. Mr. Sabean advised Mr. [redacted]s that it is not efficient to remove the air conditioned air from your home, and he should not use that system. To dehumidify the home Air Doctrox recommended he install dehumidifiers in the basement. Mr. [redacted]s insisted that [redacted] size the system to allow use of the Blue Canyon system, which he did. The attached graphs to the letter was a 2-week study through digital temperature and humidity recorders recording the temperature and humidity levels of the home during the test period with the Blue Canyon system running. These graphs clearly show the system is functioning as designed, maintaining excellent temperature and humidity levels.

There really is nothing wrong with his system, it is not oversized, it is sized for him to run the Blue Canyons as requested by Mr. [redacted]s. All he has to do is turn them on. We notified him that he can expect his energy costs will be substantially higher due to the HVAC system having to cool and dehumidify the attic air replacing the conditioned air that the Blue Canyon system is evacuating from the home, and we are not responsible for those costs.

In conclusion, we installed a system that performs properly and to Mr. [redacted]s requirement to operate with the Blue Canyon system he had previously installed operating. We do not recommend that he use that system, but it is his choice. We recommend that he re-install one of the dehumidifiers we installed in his basement that he had us remove. He has not responded to our letter or our recommendations.

Sincerely,

Review: We contracted for a geo-thermal system that has not functioned as Mr. [redacted] (Air DoctorX Owner) marketed the product to us. We began having problems with the system immediately after installation in April 2011. After installation a major part of the system was taken off line and it was determined that electronic dampers were required in order to function effectively with the system. We also had system interaction problems with the B-Dry Blue Canyon systems installed prior to the geo-thermals. The Blue Canyons were discussed with Mr. [redacted] prior to installation of the system, and their engineer also discussed the system with him. To this date, the Blue Canyon interaction has not been solved and we've had to turn them off. Their installation was $7.000. We also experienced, and continue to experience, humidiity problems. We have had other HVAC experts tell us that the 4 ton system was too large for the downstairs and while it will cool the house, it does not adequately dehumiditiy the house. We have been trying since the systems' installation to get resolution of these problems, and have repeatedly asked Mr. [redacted] to provide the data used in his design of the system, but that data has not been provided. We have sent numerous emails and letters to him, but he has yet to respond. We sent the last letter, certified mail, on June 20, 2014.Desired Settlement: We want the system specifications, resolution to the humidity problems, and resolution to the Blue Canyon inertaction problems.

Note that I only included 3 complaint dates as there are only three possibilities. There are also complaint dates of: 7/8/2012, 9/4/2012, 7/1/2013, 9/20/2013, 10/27/2013. There is also a letter of 6/18/2013, personally handed to Mr. [redacted], and 9/24/2013 phone call never returned.
