*** ***, 10/23/2015My name is Adam N***, I am the parts and service manager for Fort Collins motorsports On 6/21/a ticket was created for the customer to service his motorcycle’s tire and sprockets During this repair the
engine was damaged The service manager at the time, agreed to replace the engine at the cost of Fort Collins Motorsports.Note: Factory replacement engines are not available for the motorcycle industry unlike found in the automotive industry Thus the engine either needs to be rebuilt or replaced with a used engine Based on the records I have in our service computer, the engine was rebuilt to replace the damaged partsRecords show work was cashiered on 11/7/On 7/28/the bike was brought back into our shop for a charging system issue We tested the battery and stator We found melted/ damaged wiring in the system Our technician did fix this issueDuring this visit the technician noted on the service invoice that the bike seems to be burning oil and has possible motor problemsThis repair order was completed on 8/5/and the bike was returned to the customerAfter this repair the customer complained about the motor being new and should not have any issues since it was just replaced the previous year I reminded the customer that our labor has a day warranty This is stated at the bottom in print of every invoice The bike had miles on the odometer since it was last in months prior I told *** that I was willing to contribute to the cost of diagnosing his problemWe waved the inspection fee for looking at the bike and diagnosing the problem This fee is normally $chargeWhat we found out with our preliminary investigations, was internal motor noises The only way to diagnose these problems 100% is to have the motor removed and completely disassembledI told the customer that I would be willing to cover the labor portion of tearing down the motor, and reassemble as long as he would cover the parts portion I explained to him that this would be very costly even for just parts This is a year old sport motorcycle A brand new Yamaha Ronly comes with a year factory warranty against defects I advised him at this point the value of the bike as is with poor running verses the amount of money put in would not make senseHe told me at this point he would need to think about the situationI have never heard back from *** *** until this Revdex.com complaint I have copies of all invoices that state what I have stated above.Current Nada Value for his bike in great condition is $2725.00, the bike sold new in for $ The customers values stated on complaint seem to be off.Thank youAdam N***

Complaint: ***I partially accept the offer of $for compensation for the expense of having to replace the headlight assembly due to it being severely cracked and not disclosed on the inspection report, rather as represented as no fault.Furthermore, the vehicle is NOT a *** as it was represented as, advertised as, and paid for. The vehicle clearly states *** on the side (photos attached). The manufacturer made it as a ***, the VIN is for a ***, it must be registered as a ***. The dealership has NO right to claim or alter the vehicle in order to claim it as a different model, such as a ***. This is blatant misrepresentation and criminal fraud to obtain money or items of value from another. However, I have REPETITIVELY requested to be contacted by Brian H*** who is the owner and active manager of the business. I have received nothing but neglect to this request. I directly contacted Josh in sales and received a "Not my problem" attitudeI asked if he had received my two previous emails requesting a call from the owner Brian H***, in which Josh said he was unsure and would check if he did.I was put on hold, in which he eventually came back on and then he had the answer that he had be receiving them, he stated that he had printed them and had been giving them to the General Manager. I explained I needed a call back within the next 24hours and he didn't care, explaining that "his hands were tied" then rudely hung up on me (by slamming the phone down).I called back requesting to speak to the General Manager - Jane P***, but was met with resistance, I clarified that I will be filing a formal complaint with the Colorado Department of Revenue because of the fraudulent conduct of Fort Collins Motorsports.The girl on the phone laughed and hung up.I expect an email from Brian H*** so we can discuss a course of action.Genuinely,*** *** *** ***

When the customer called today he repeated three times to me that he knew it was an older machine and was sold to him as is with no warrantyI understood he was upset and offered him a dollar gift card to pay for the oil change he had already done himself, that was not to his satisfactorySo I
then offered him a dollar gift card which is % of the original purchase price which I thought was fair on a machine that was sold as is with no warrantyWe had sent the machine through our service department and had an oil change done on it alreadyAlso the customer has had the machine for days, maybe not along time and I am not implying but I don't know what could have happened to it in that timeWe are always striving to satisfy our customers however we have to draw the line on somethings

Just a heafor any of my fellow riders looking for service or a new/used bike, avoid these people like the plagueCaveat emptorColorado law says they have 30-days to get a title to you when you buy somethingI bought a used bike with cast's been over 30-days and they KEEP coming up with excusesFiled a formal complaint with the state dept of revenue, auto industry division (it's law here to get a title to someone within 30-days)I've repeatedly called them and either get, "Someone will call you back" (they never do), or I get someone who's annoyed that I'd even bother them and it's always the same thing, "We'll send it out today/tomorrow, etc." and it never comesThey will cash your check, or take your cash, but good luck with actually getting a title showing you own it (you don't until you have a title, even though you might have possession of said vehicle)Again, unless you want the headaches, go somewhere, anywhere elseNOT to these peopleOh, and I'm not the first filing complaints against them with the state, on investigation, they appear to be borderline fraudulent sellers (at least for their used bikes)

In response to this complaintWe received an e-mail on January the 3rd 2018, explaining to us that the headlight lens was cracked and noted on the shipping documentWe e-mailed the customer on January the 4th with the response that we would order and send to the customer a factory *** Lens

I have attached a copy of the repair order where the unit went through our service department where we put on new brake pads did an oil change, and put a new seat cover on the machineAs well a safety check was performedThe customer has made it clear that the $gift card I offered not because we did not do what we said we did but because he was unhappy with his purchase and Fort Collins Motorsports wanted to keep him happy if possibleIt doesn't sound like that is going to happenAs far as the title work goes we have days to get the customer his paperwork which we have already processed

I am rejecting this response because: the dealership I feel knew that there were issues with the machine and instead of being honest with me, chose to sell a vehicle that was in poor condition by trying to make me believe that it was something that it wasn't. In order to make more money. I am just completely disappointed with them, in the respect that they were not honest, but instead tried to make me feel stupid. Did I have to buy it no, but I really didn't think that they would blatantly lie to me and try to make me think that it went through their shop and all was well. As to the remark that "they don't know what we may have done to it is bogus, and of course, they don't want to take any responsibility for selling me a piece of junk so of course they would put the blame on us. I will never do business with them again, and will never recommend their business to anyone. Also, I did not receive any OHV paperwork to register the vehicle with the parks department, which as a licensed dealer, they are required to do, But all things considered and the way they do business, why would I

The bike was sold as is. Also the headlight is in working order and passed the safety inspection, the fact that the outer lens is cracked is neither a safety issue nor a functionality issue. We have agreed to pay the retail price of the part and send it to him at no cost. Also you will find a attached signed we owe form by our representative as well as [redacted]'s signature stating the bike is SOLD AS IS and nothing else was promised.

On the 2nd of may 2014 our service dept. left a message with the customer... no response. On the 8th of may 2014 I left a message with the customer after I received the complaint from the Revdex.com ... no response.  The customer called me on June 3 2014 informed me that he took it to another Polaris...

dealer and they were not able to fix it. So Fort Collins Motorsports has agreed to attempt to find the problem and fix it again.

I am rejecting this response because:Even though I appreciate the partial offer to mail the headlight assembly that was knowingly misrepresented in the provided inspection report to sway me that no repairs would be needed.I am also now more concerned with the fact that the model of motorcycle received is NOT the model on any of the paperwork,  advertisement, or even the model associated with the VIN. (photos attached)I agreed to buy, and paid for, a [redacted].  The motorcycle I received is the cheaper sub-model called a [redacted].  This was discovered within seconds of my local motorcycle repair shop providing a quote for the repair of the cracked headlight assembly.  The concerning thing is that when discussing this motorcycle with the Fort Collins Motorsports sales associate Josh, I asked him about the Title and if it was clear of any accidents.  His reply was that they run the VIN and double-check the ownership and repair history.  He assured me that this "[redacted]" had a clean Title.  I accepted that since this was a dealership that has a service department and can access the VIN database.  This process of checking the VIN for the model, paint code, year, etcetera takes literally SECONDS and costs nothing if you have a repair part database.However, [redacted]s are not as sought after.  I am unsure why they would fraudulently misrepresent this motorcycle as a [redacted], other then to gain a higher asking price.If Fort Collins Motorsports would have been more professional in the beginning in regards to the cracked headlight, and disclosed the excessive damage of the bike; and in doing the RIGHT THING by offering to cover the total cost of the repair, I may consider this to be a significant error.However, since Fort Collins Motorsports' staff has been deceptive and has provided lies.  I believe this action of knowingly and willingly to misrepresent the vehicle in order to "make a sale" to be criminal fraud.The response from Fort Collins Motorsports about not wanting to pay the additional $200 for the labor, tax and "bring your own part" upcharge, is that the Motorcycle was sold "AS IS".Correct, it was.  And as the regulations state; "AS IS" means AS IS described in the sale paperwork.  AS IS described in the advertisement.  AS IS represented by the seller.  Fort Collins Motorsports knowingly and willingly misleads it's customers by providing a 16-point inspection report that promises a certain grade of condition, and a certain Make, Model, and Year.Fort Collins Motorsports seems to tout "AS IS" once they have your money, but ignorantly does not seem to understand where the "AS IS" concept is based from.Another shocking issue is that Fort Collins Motorsports replied that a broken headlight is not a concern for a safety inspection!Besides the obvious that a crack is over one inch (this one exceeds THREE inches on the lens!) and/or exposes the internal components to the elements by extending through the glass or acrylic.  When moisture or rain are able to enter the halogen housing, the bulb cracks and can no longer function.Neither my council on this matter, nor did Fort Collins Motorsports cite ANY regulation that states a damaged/cracked headlight assembly would NOT be an issue for the state safety inspection, let alone regular operation of a vehicle.  Unless, this was yet another deceptive lie by the staff of Fort Collins Motorsports.I have incurred an expense due to the fraudulent actions of Fort Collins Motorsports' employees acting within the scope of their employment.  Fort Collins Motorsports knowingly and willingly misrepresented a vehicle by not only the condition in its inspection report, but also the actual model of the motorcycle on all provided documentation.I did not agree to buy a [redacted] with a crack headlight, and was deceived about the other damage that exceeds normal "road wear" for a used vehicle. (Such as the gash on the painted saddle bag and the dented front turn signal)Fort Collins Motorsports knowingly and willingly conducted criminal fraud to sell a sub-par vehicle and make a profit.I am seeking further damages and reimbursement for all expenses in this matter. A full investigation by the Colorado Department of Revenue - Auto Industry Division will be conducted if this matter is not resolved.  I will be requesting a suspension of Fort Collins Motorsports dealership license.The OWNER Brian H[redacted] may call me or email me via his identified email to discuss a resolution before I escalate this matter to the State authorities.I have given Fort Collins Motorsports numerous chances to do the right thing, now I have lost patience.

We have read your response and being a [redacted] dealer the motorcycle you purchased has the windshield bags and backrest which is the difference between a [redacted] and a [redacted]. At this point we are willing to refund you five hundred dollars as per your original request.

No the issue was not resolved because Fort Collins motor sports refused to repair the machine they sold us.  The offer of a gift cert for 250.00 wouldn't even begin to repair the issues. So there is no resolution and I am very unhappy customer because they flat lied to me

This resolution does not cover the expense of instillation labor, taxes, and provided repair part upcharge.Because of Fort Collins Motorsports misleading sale, I refuse to have to pay any additional expense that was NOT part of the pre-sale agreement.My estimated cost due to Fort Collins Motorsports conduct is expected to be at a MINIMUM of $500.$500 is the least I will accept.  I cannot continue to deal with the stress of this issue due to health reasons from military combat related injuries as well as my Federally recognize disabilities.  If this dispute persists further than within reason, I will have to seek council for representation and compensation for further expenses.  I will pursue reimbursement in all expenses and the return of the motorcycle that was fraudulently represented by Fort Collins Motorsports.
