On the 2nd of may our service deptleft a message with the customerno responseOn the 8th of may I left a message with the customer after I received the complaint from the Revdex.com no response The customer called me on June informed me that he took it to another Polaris dealer and they were not able to fix itSo Fort Collins Motorsports has agreed to attempt to find the problem and fix it again

[redacted] , 10/23/2015My name is Adam N***, I am the parts and service manager for Fort Collins motorsports On 6/21/a ticket was created for the customer to service his motorcycle’s tire and sprockets During this repair the engine was damaged The service manager at the time, agreed to replace the engine at the cost of Fort Collins Motorsports.Note: Factory replacement engines are not available for the motorcycle industry unlike found in the automotive industry Thus the engine either needs to be rebuilt or replaced with a used engine Based on the records I have in our service computer, the engine was rebuilt to replace the damaged parts.Records show work was cashiered on 11/7/2014.On 7/28/the bike was brought back into our shop for a charging system issue We tested the battery and stator We found melted/ damaged wiring in the system Our technician did fix this issue.During this visit the technician noted on the service invoice that the bike seems to be burning oil and has possible motor problems.This repair order was completed on 8/5/and the bike was returned to the customer.After this repair the customer complained about the motor being new and should not have any issues since it was just replaced the previous year I reminded the customer that our labor has a day warranty This is stated at the bottom in print of every invoice The bike had miles on the odometer since it was last in months prior I told [redacted] that I was willing to contribute to the cost of diagnosing his problem.We waved the inspection fee for looking at the bike and diagnosing the problem This fee is normally $charge.What we found out with our preliminary investigations, was internal motor noises The only way to diagnose these problems 100% is to have the motor removed and completely disassembled.I told the customer that I would be willing to cover the labor portion of tearing down the motor, and reassemble as long as he would cover the parts portion I explained to him that this would be very costly even for just parts This is a year old sport motorcycle A brand new Yamaha Ronly comes with a year factory warranty against defects I advised him at this point the value of the bike as is with poor running verses the amount of money put in would not make senseHe told me at this point he would need to think about the situation.I have never heard back from [redacted] until this Revdex.com complaint I have copies of all invoices that state what I have stated above.Current Nada Value for his bike in great condition is $2725.00, the bike sold new in for $ The customers values stated on complaint seem to be off.Thank youAdam N***

Complaint: [redacted] I am rejecting this response because: This resolution does not cover the expense of instillation labor, taxes, and provided repair part upcharge.Because of Fort Collins Motorsports misleading sale, I refuse to have to pay any additional expense that was NOT part of the pre-sale agreement.My estimated cost due to Fort Collins Motorsports conduct is expected to be at a MINIMUM of $500.$is the least I will accept I cannot continue to deal with the stress of this issue due to health reasons from military combat related injuries as well as my Federally recognize disabilities If this dispute persists further than within reason, I will have to seek council for representation and compensation for further expenses I will pursue reimbursement in all expenses and the return of the motorcycle that was fraudulently represented by Fort Collins Motorsports Regards, [redacted]

Complaint: [redacted] I am rejecting this response because:Even though I appreciate the partial offer to mail the headlight assembly that was knowingly misrepresented in the provided inspection report to sway me that no repairs would be needed.I am also now more concerned with the fact that the model of motorcycle received is NOT the model on any of the paperwork, advertisement, or even the model associated with the VIN(photos attached)I agreed to buy, and paid for, a [redacted] The motorcycle I received is the cheaper sub-model called a [redacted] This was discovered within seconds of my local motorcycle repair shop providing a quote for the repair of the cracked headlight assembly The concerning thing is that when discussing this motorcycle with the Fort Collins Motorsports sales associate Josh, I asked him about the Title and if it was clear of any accidents His reply was that they run the VIN and double-check the ownership and repair history He assured me that this " [redacted] " had a clean Title I accepted that since this was a dealership that has a service department and can access the VIN database This process of checking the VIN for the model, paint code, year, etcetera takes literally SECONDS and costs nothing if you have a repair part database.However, [redacted] s are not as sought after I am unsure why they would fraudulently misrepresent this motorcycle as a [redacted] , other then to gain a higher asking price.If Fort Collins Motorsports would have been more professional in the beginning in regards to the cracked headlight, and disclosed the excessive damage of the bike; and in doing the RIGHT THING by offering to cover the total cost of the repair, I may consider this to be a significant error.However, since Fort Collins Motorsports' staff has been deceptive and has provided lies I believe this action of knowingly and willingly to misrepresent the vehicle in order to "make a sale" to be criminal fraud.The response from Fort Collins Motorsports about not wanting to pay the additional $for the labor, tax and "bring your own part" upcharge, is that the Motorcycle was sold "AS IS".Correct, it was And as the regulations state; "AS IS" means AS IS described in the sale paperwork AS IS described in the advertisement AS IS represented by the seller Fort Collins Motorsports knowingly and willingly misleads it's customers by providing a 16-point inspection report that promises a certain grade of condition, and a certain Make, Model, and Year.Fort Collins Motorsports seems to tout "AS IS" once they have your money, but ignorantly does not seem to understand where the "AS IS" concept is based from.Another shocking issue is that Fort Collins Motorsports replied that a broken headlight is not a concern for a safety inspection!Besides the obvious that a crack is over one inch (this one exceeds THREE inches on the lens!) and/or exposes the internal components to the elements by extending through the glass or acrylic When moisture or rain are able to enter the halogen housing, the bulb cracks and can no longer function.Neither my council on this matter, nor did Fort Collins Motorsports cite ANY regulation that states a damaged/cracked headlight assembly would NOT be an issue for the state safety inspection, let alone regular operation of a vehicle Unless, this was yet another deceptive lie by the staff of Fort Collins Motorsports.I have incurred an expense due to the fraudulent actions of Fort Collins Motorsports' employees acting within the scope of their employment Fort Collins Motorsports knowingly and willingly misrepresented a vehicle by not only the condition in its inspection report, but also the actual model of the motorcycle on all provided documentation.I did not agree to buy a [redacted] with a crack headlight, and was deceived about the other damage that exceeds "road wear" for a used vehicle(Such as the gash on the painted saddle bag and the dented front turn signal)Fort Collins Motorsports knowingly and willingly conducted criminal fraud to sell a sub-par vehicle and make a profit.I am seeking further damages and reimbursement for all expenses in this matterA full investigation by the Colorado Department of Revenue - Auto Industry Division will be conducted if this matter is not resolved I will be requesting a suspension of Fort Collins Motorsports dealership license.The OWNER Brian H [redacted] may call me or email me via his identified email to discuss a resolution before I escalate this matter to the State authorities.I have given Fort Collins Motorsports numerous chances to do the right thing, now I have lost patience Regards, [redacted]
