Without heat x 8 days. Service call and tech keptcoming back after I would call AND NEVER FIXED THE PROBLEM
service rep showed up and tested all components and stated he could not find the problem, and would come back the next day. I had to call him and he was at another job, every day same thing. He kept testing and one day he said I'll try the igniter and he left and came back the next day and installed and said that was not it and kept testing same components and kept saying dont know what it is. He called his boss and asked him to come look and his boss said no. he came back the last time and closed up t unit and said my bass told me to go to other jobs. I followed him to his truck and he said I will tell the office there will be no charge because I dont know what it is and and there will be no charge. I asked him what I am supposed to do and he said I guess you need to call another contractor to try to fix it.
I called another company and they sent someone out and it took him approximately 15 minutes to replace a transformer (?). My bill was $40 and I got a bill from Air-Tech for $135.00

Desired Outcome

I am not paying for a repair service that did not happen, and was left with 8 days of no heat.

This was an older Heil unit and our technician worked with the technical representative from Heil over several days to restore operation of the unit. We replaced an igniter control board ($274.32), a gas valve ($289.13) and had at least 5 1/2 hours of labor ($540.00) invested at this location. We are sorry all that did not totally fix the problem. We have apologized to the customer and mailed refund check #XXXXX for the $135.00 he was charged.

Last correspondence on this issue. Air-Tech now claims they replaced 2 parts on my unit for $563.45and $540.00 worth of labor; which both statements are absolutely false. The repair tech would put a new part in/on and it did not start the unit and he would remove the part and he tried another part and it did not work either and he removed it and put the original parts back on. The $540.00 claimed as labor is also false as he was only here 3 times for 1 hour and 45 minutes total.
I received a letter from Air-Tech with a check for $135.00, stating they were returning my money. That is confusing since I did not pay a $135.00 service as I refused in my original grievance due to no service provided. Their letter also stated "$1000.00 worth of retail parts", also false.
I have returned their #135.00 check and want no further correspondence from them. I found a reputable service company now and they fixed my problem correctly and timely and charged me $40.00.
This issue is resolved.

MAINTENANCE DONE UNSATISFACTORY

1.1st week Oct 2018 moved a box on top of walk in closet top shelf & noticed mold from ceiling to shelf

2.I called plumber *** (XXX-XXXX) to take a look in attic and see if pipe is leaking- He came & said I didn't have a plumbing problem but an A/C condensation problem & pan is spilling over into the top of my closet
Causing the mold- Pan was rusty & commented I had a mess up there. This was A/C problem.

3.I called my home warranty "Choice Warranty" 10-16-18 and was covered. They gave me the number of LEGIT Heating & Cooling, ***, owner at XXX-XXX-XXXX or XXX-XXX- . *** is NATE certified which is one step above being a regular certified technician.

4.*** of LEGIT Cooling came out Oct. 19th at 1:00 pm to inspect the cooling system in attic. *** was in attic for an hour video all that was bad, rusted, holes, and many other issues gone wrong. *** owns LEGIT.
*** put video & transferred photos onto my computer for me to make copies. Under each photo *** had list the problem.

5.On Oct 19th, same day *** inspected damage, and I immediately went to Air Tech Cooling on Hill St & asked for the manager which the lady said was ***. Do not have last name. He directed me to his office & I showed *** the photos/video & told him I was unhappy with their Maintenance. We had Air Tech since 1997 when we built our patio home, *** We installed an electronic filter in our home and the maintenance included a new filter yearly & checking all maintenance at $350 yearly. They come in October & April to install filter & check maintenance yearly.

*** didn't have much to say about the photos & I told him his maintenance people were not checking maintenance of the A/C & only installing filter & I knew they installed filter because I saw the box it came in. I told *** I wanted this fixed right & the mold taken care of and if he didn't I'd take him to court as I had all the problems in video & photos to show.

6. *** of Air Tech said he would fix it but they don't do mold & have to hire someone to do that which was Anthony Raborn Construction Co.

7. I started calling Air Tech about every 2 days to see when they are coming out to start fixing the leak & many other things that were bad. I have a bad shoulder from a fall & Dr. Cooke sent me after 2 surgeries to a shoulder specialist
In Ft. Worth so I had appt Oct 25th and Air Tech didn't come out until 11-08 to repair the above. I did call just about every 2 days.

8.*** & 3 of his crew came Oct 25th to repair A/C and was in attic for 3 1/2 hrs. Now *** was with the men & he never came down from attic so he knew exactly what & how they repaired that was wrong. I did tell *** I was going to get a certified inspector to check & see if all was complete & done right.

9.November 8, 2018 I called *** of LEGIT A/C and said come over & inspect what Air Tech did & see if they did all they were supposed to. The *** Raborn Construction had already came & fix the mold after Air Tech finished their job.

10.*** came out NOVEMBER 16th for inspection & found unbelievable ways they repaired the cooling system with chicken wire (see photo) duct tape that is melting (see photo) & many more issues that is hard to believe when you know the owner is up there with his crew & he knew he wasn't doing it right.

I have signed a contract $144 with *** at LEGIT Cooling and breaking contract with Air Tech. On September 24th, 2018 I paid Air Tech $300 for yearly maintenance.

NOVEMBER 20THM 2018 I WANT AIR TECH TO PAY LEGIT A/C & HEATING TO REPAIR WHAT THEY DIDN'T DO RIGHT & NOT A FIRE HAZARD WITH DUCT TAPE (THAT IS WRONG) AND IS MELTING ON PIPES. I WANT THEM TO PAY MY LEGAL FEES ALSO. NOW I'M HAVING SURGERY ON SHOULDER DEC. 10TH AT HARRIS HOSP., FT. WORTH & WANTED THIS ALL DONE BEFORE THEN & WOULD HAVE IF AIR TECH DID THEIR JOB.

Complainant has been a customer of Air-Tech for many years and we installed her HVAC system in 1997. This is now a 21-year old system and over the years it is understandable that deterioration would occur. We provided twice a year planned maintenance (PM) for complainant since October 2014. This PM covers basic checkups of the heating or cooling system depending on the time of year. It does not cover normal deterioration such as a rusting drain pan, mechanical breakdowns, repair parts or any other labor or material for additional service calls. It also does not cover water damage, mold or any other type of damage to the home. It is a maintenance plan only.
Complainant has had several different people and companies involved in all this and it makes it difficult to determine who did what. We have not charged complainant for a single service call since 2016. She repeatedly cancels appointments and cancels her scheduled maintenance, which makes it pretty difficult for us to do our job.
She paid for her previous PM sometime in the fall of 2017. She was scheduled for her spring check up on April 11, 2018. On March 28th, she called and said she had a problem and asked if we could come out and fix the problem during the PM. We explained that repair service is not factored into our time schedule for planned maintenance nor included in the PM checkup and we would need to schedule a separate service call, and charge her for any repair labor or parts. At that time, she canceled the PM and called another company to do the repair. Had we been allowed to do the PM in April before the cooling season, we most likely would have discovered the drain pan problem at that time and prevented the water damage and hence the mold issue.
After finding the mold and having a plumber come out to check things, the plumber told her she needed to call her air conditioning company. Again, she called another company, not Air-Tech. Upon his inspection, he found the mold and some air leakage problems on the system in the attic, but did not find or mention the broken drain pan. After complainant came to Air-Tech with the findings of Legit A/C, the owner and general manager of Air-Tech went to her house and found the drain pan cracked. We also looked at the items Legit had described in his report. As soon as we could get it worked into our schedule we went back with a crew and replaced the drain pan and repaired all the air leaks. The drain pan was not a warranty item and we would have normally charged about $350 to replace it. We did not charge complainant anything. The water damage is also not something we would have repaired because the pan was not a warranty item and was the cause of the water damage. This would fall under the responsibility of the home owner. We paid Anthony Raborn Construction $295.78 to repair the ceiling and did not charge Mrs. anything for this.
Then Mrs. had Legit come out again to check our work. On his second inspection he criticized the top of the line Lennox Pure-Air Filter as causing high static pressure. This filter retails for about $200, hence the reason her PM agreement costs more than our usual. We assume the engineers at Lennox who manufacture and sell this product have worked out any static pressure issues. He also showed dust in the ductwork. Again, it needs to be noted that this is a 21-year old system and any system of that age will have some dust. Cleaning ducts is not part of planned maintenance. Complainant could have chosen to have her ductwork cleaned at any time during those 21 years, but she did not. Air-Tech does not provide this service, but there are several companies in town that provide ductwork cleaning. The next item Legit shows in the photos is the clothes dryer vent which is not included in the PM for the air conditioning system. This is where the melted duct tape and so called "chicken wire" are attached. Legit should know that the clothes dryer vent is not a part of the air conditioning system. At this point, he seems to be trying to find anything he can to discredit Air-Tech and scare complainant into spending money with Legit. We do not know who put up the masking tape and baling wire, but it could have been anyone, maybe even the husband or another repairman if the dryer vent got clogged at some time.
We will return the $300 complainant paid in September 2018 for her yearly maintenance agreement. That $300 plus the money we have spent to repair the ceiling and drain pan is all we will pay. We reject complainant's claims that improper maintenance has been done, and will not pay anything to Legit AC. We feel we have gone above and beyond in our attempt to make complainant happy.

In today's mail, December 7, 2018, I received the enclosed check from Air Tech for $300 for maintenance. I'm refusing that check. That will not covered the damage plus I do not want Air Tech's air filter as it has never been up to standards and more expensive to change every year. Air Tech's electronic filter I want out of my house. I wan the "Germicidal High Efficient Air Cleaner" that LEGIT will install for $1035 and take out Air Tech's filter. See attached Invoice.

Enclosed is a copy of LEGIT Heating and Air Condition Co. who is certified and is the one that found all the damages that Air Tech did by not fixing the problem in the attic. The damages were caused for years because the technicians who come twice a year to install a new filter and supposed to check everything and see that all is intact did not do any maintenance and just installed the filter.

I want what the invoice LEGIT A/C submitted of $2,754.00 to repair the damages that they had a chance to fix twice and failed to meet the standards even 2nd time around.

I will not negotiate any lower then $2754.00 and if Air Tech refuses to do so I will take them to civil court and I'll have the certified technician/owner go with me to court to explain to the judge all the technologies of what is wrong.

My A/C in attic is done with duct tape and is melting & we have videos and photos to show the judge and this is the 2nd trying to make it right & they didn't do it. All they did with owner up with his technicians, was put together with the duct tape and chicken wire around metal rods there which should have steel brackets around them & so many other things that is unbelieveable that they did.

I go Monday, December 10th, Ft. Worth at Harris Hospital to have my 3rd surgery on right shoulder & should be home by Friday the 14th. I'm not asking money for stress they put me in for months but only to repair it right & get their electronic filter out & put one in that will be better & repair the old damages that Air Tech caused.
