I have reviewed the response made by the business in reference to complaint ID *** and have determined that this does not resolve my dispute
Please enter your reason(s) for rejecting the business response below
Response to *** *** with Air
April 3, 2014, I called him because my A/C was not working
He stated I needed an outside unitI agreed to purchase the entire outside
unit because it, according to him, needed itHe installed one outside unitOnce
completed, I had to call him out the same day because it was not coolingHe
stated something was wrong and not working correctlyThe next day he took the
1st outside system out and installed a 2nd outside unit
*** *** stated the cost from the 1st unit he placed and the 2nd
was the same and that he would suggest going with the 1st unit
instead of the 2nd unit (the Trane) because they are better with
their warranty if neededUnfortunately the unit did not work correctly and he
stated he told them “It is like buying a new car and before you drive off the
lot the car does not work. They wanted
to replace the part and I told them to give me a brand new unit and they did
not so I will return it for the other”.
I do not know exactly what he told them, but that is what he told me
I was NEVER asked to pay any cost for anything with the
transition from the 1st unit he placed to the 2nd unit he
placed
On April 11, I informed him that he had left a box of
tools at my house and that I did not have my warranty papers for my Trane
system
ON April 13, the 2nd unit I was having
problems with it as wellI called and asked if he could come out and lookHe
stated no problem and came out within the next 2-4hrI told him it is not cooling/blowing
like the unit I bought the house withHe said it could be due to the heat and
size of the house and I believe (not certain) he turned something up on the
outside unit, I thanked him for coming out again and informed him it was
working properly and the temp is coming down, he stated “ Call me anytime I got
you covered”
On April 22, I called/text and asked could he come out
because the unit was not turning out at all, I also stated If we cannot get it
working properly I would like the unit taken out and a refundHe called back promptly
and stated he can fix it and does not want to lose my businessI was at work
for a meeting and my girlfriend was at home Once he got there he looked at the unit and
stated it was not getting enough voltage to come on and he had to replace a
part on the systemHe stated (Im not real sure if this is correct on voltage) “it
needed volts and was only getting around 14volts”.Once again I am left in
the Texas heat twice without air by Airwith a brand new systemHe did fix
it temporarily by “***” for that moment
On May 7, he stated he took the part to get it changed
and they still did not have it until he returned with the pieceFrom April 22-
At least May10, I went without proper functioning equipmentI am not
certain on which day he came to replace it but I believe it was towards the end
of May
On June 31, My system still was not working as it
shouldAn employee of *** came out and stated now I need a new inside unit
By this point after coming to my house at least 6x before and my system still not
working, I became skeptical of Airand the services. The gentleman stated he could use a patch
work (some fluid to stop the leak) and see if that stops the leakI asked him
to do so put only put in half the FreonI know I need Freon to cool the house,
but I am not going to keep letting me nickel and dime meAs soon as they Left
I had a new AC company come out and they turned off the unit stating with a
brand new system the patch work fluid will destroy the unit and I would have
this same problem next yearThey also stated and took pictures of the outside
unit not being installed properly with wires not attachedThe next day the new
AC Company installed a new inside unit
This year April 2015, my system did not work againI called
the new company and they stated the outside unit is failing againI called 5-6x
*** *** numbers and left text messages for both and a voicemail, he was
unprofessional and did not respondAfter I told my girlfriend of all this, she
called multiple times from her house and got a hold of himHe stated to her he
was not coming out and refused to warranty the work he installed and he was
frustrated that a new company had installed a new systemHe also stated to her
if he came out to do the work he will charge me for every possible thing he can
think ofI have yet to speak with him because of his unprofessionalism, anger,
and jealously because I had a 2nd company second opinion service
With all that said
1.
I was never asked to pay anything/difference from
the 1st unit to the 2ndHe would never come over and
over again if I refused to payI was told they were the same price before installation
and those were the two choices I had in purchasing a new outside unit
2.
I know nothing of AC but when I became skeptical
of my system not working for months; I believe I was patient and gave him numerous
chancesI called for a 2nd opinion from a new companyI feel
because I was a young, 1st time home owner, he thought he could take
advantage of me and nickel and dime me until he was satisfied
3.
I have not talked to him nor did my girlfriend
state anything about notifying social media, the Revdex.com, or any financial gainI
did not know I could contact the Revdex.com about this until after the new company
came out and fixed *** *** failed system in April
4.
I believe strongly he has messed up and
misdiagnosed my system from the beginning and has major improper equipment and
installation issuesI still have not received any warranty papers from my
Trane system from him, I do not know if it is new or where it has come from
5.
The Licensing for Air Conditioning in Texas has
been in contact with me and have notified me of him not following multiple
regulations and not getting the city to inspect his work after it was done,
which I had to do May
Regards,
*** ***

The following is our response to the complaint of Mr. [redacted] dated 4/10/15, which seems to be part of a campaign of libel by a customer who has made false statements in attempts to gain a financial advantage without taking responsibility for his own actions, which are the cause of his distress. ...

Air 817, Inc. strives to provide excellent service and backs its installations with priority call-out if any follow-up is is necessary. For Mr. [redacted] who was not a prior customer and had a burned out condenser in his air conditioner, we installed a new 3.0 ton heat-pump condenser on 4/3/2014. The customer’s inoperative unit was replaced with a ICP 3.0 ton 230-volt heat pump condenser. Shortly after installation, we received a call stating the unit wasn't cooling. We promptly returned to the customer’s site and found the unit’s reversing valve malfunctioned. We had never installed or maintained the customer’s system, other than replacing the condenser, so the problem with the reversing valve was not our responsibility except to the extent that any warranty for something Air 817 installs extends to the parts installed only. Rather than just replace the part, however, we went "above and beyond the call of duty” and replaced the entire condensing unit with a "top of the line” unit made by Trane. The customer refused to pay any costs. On 5/31/14, we received another call that the unit was not cooling. We promptly returned and found the system to be completely out of freon (the refrigerant gas). We inspected the system, located the leak in the evaporator and informed the customer; the customer did not want to replace the evaporator per our recommendation.  Later, the customer had another company replace the evaporator. (The HVAC system is comprised of two parts that work together, the condensing unit and the evaporator coil. We were contracted to replace only the condensing unit.) The customer was informed that his system would require around 10lbs of refrigerant gas; we informed him that replacement of the evaporator was necessary, but we we could try to temporarily stop the leak, basically by patching the area. The customer refused the required 10 lbs of refrigerant gas and dictated that we install only 5 lbs. We advised the customer that failing to put in the appropriate amount would likely cause compressor failure and shorten the lift cycle of the unit. The customer said that was all he could afford and would not pay for 10 lbs. of freon. About a month later we received another call from customer stating the unit wasn't working. We went to the site and found that a new air handler had been installed (by someone else or another company). The air handler was not installed correctly; only 2 of the 5 control wires were connected. We told the customer the company that installed the air-handler should be called and that they should return and wire their installation properly. (Notably, this confirmed our earlier diagnosis that the evaporator was bad and needed replacing).  To replace the evaporator,  all of the refrigerant has to be recovered and then the system would have had to be recharged, but we do know know whether those procedures were followed by the company which installed the air handler. Basically, we had nothing to do with this and referred the Customer back to whomever he hired and whomever installed the air handler. Unfortunately, the customer ignored our advice, refused to make proper repairs, and opted to have installations made by other companies, but demands that we service their (not our) work. Since our last visit to the Customer’s site, wherein we referred him back to whomever he hired for the air handler installation, we have received numerous calls wherein the customer demands free service and threatens to impugn us on social media, “take us to the Revdex.com,” etc. We have made every effort to assist the Customer, have provided service calls without charge, and provided work in excess of the warranty, but his claim is just part of the campaign of threats he has used in attempts to cause us to fix work done by other people. We simply are not responsible for the Customer’s refusal to properly charge the system with refrigerant or the problems which resulted from that refusal, or for the work he had done by another company. Sadly, his blame is misplaced.
