Ala Wai Yacht Brokerage LLC (AWYB) has high standards of doing business. Our goal is to end up with a win/win situation. We are honest people.
We realize we are "in the middle". What does that mean. Well, the nature of our business allows us to attract buyers and sellers of boats and...

yachts, and, by staying in the middle during negotiations, our goal is to present the products given us to market, and sell to buyers we find through our sales efforts and word of mouth, and past relationships.
There can be substantial emotion during the selling process from buyers and sellers. We understand this. Again, we are in the middle and should not judge.
Once buyer and seller agrees on a sales price we step out of the right side of the brain to the left ie. the inspection phase. During this period
we step back and let the experts enter the equation to provide survey, rigging, and mechanical inspections for the buyer. Things are almost never as they seem...we understand this. We approach the business based on information from all the players, and, in good Faith, hope to achieve that win/win scenerio again between buyers and sellers.
Am I over simplifying? I do not think so. Our AWYB team seeks to manuver through sometimes "clear and present danger". Remember, we are in the middle. Our task is to be honest, intelligent, hard-working, and bipartisan working towards the utimate sale of a vessel.
Was this sale handled any differently....nope! We had some experience with the seller because we brokered the sale to him, and, we tried to understand the buyers wants and needs by finding him the right boat, at the right price, and enabled him to pursue any and all forms of inspections before he agreed to purchase the vessel. 58 page survey! Yep, a comprehensive survey was performed by the surveyor of his choice totally 58 pages. Seller was there to offer his knowledge and experience with this vessel. Mechanic was called in that worked on the vessel to speak directly to the surveyor and buyer. Haul out? You betcha! Bottom inspection was part and parcel of the final survey.
We do not run and hide when the going gets tough. When we heard about the buyers concerns I went to the boat twice and was turned away. The later excuse was that "I did not make an appointment". I tried to set up an appointment between buyer, seller, surveyor, and myself and was told by the buyer that he did not want to be involved in an adversarial meeting. Buyer and myself have yet to be invited to observe the "damage". Buyer sent me a text asking for the sellers contact information and I replied "it is on the sales contract and bill of sale". Seems the buyer thought that answer was a personal attack on his integrity.
The seller disclosed during the very first viewing of the vessel to the buyer that he wanted to go to sea one more time for a special occassion. There is nothing in the sale agreement that prohibits an owner from using his/her vessel until buyer takes physical custody. The seller however, concerned about any potential problems during the short trip hired a professional captain to run the boat. All stated there were no mishaps.
We are not perfect, however, our goal is to be perfect. We are honest and hard working. AWYB accepts no liability, expressed or otherwise, unless we were negligent. We were not. We do find it an unfortunate turn of events that seems to have led to [redacted] being upset and disappointed. BTW we have never met "[redacted]" as we were dealing with "[redacted]". To our knowledge [redacted] lives in Guam.
We are willing to meet with [redacted], since he is the complainant here. We have never met him.

I am rejecting this response because:[redacted] is missing the point.
I am not asking for legal advise.  I am asking for compensation for damage.  The boat should not have been moved after final inspections and prior to me taking possession of the boat.  The boat was moved and damage occurred.  This is the only issue, which [redacted] is avoiding any responsibility for, as the broker he should have told the seller not to move the boat or advised me of my right to another inspection prior to acceptance.  This is the basis for my complaint. 
As for showing up without an appointment, expecting me to drop what I was doing is unprofessional, regardless of what I was doing.  MAKE AN APPOINTMENT, DON'T JUST SHOW UP!  Its rude.
