I would like to begin by stating that I have attached the written correspondences that I have exchanged with Alamo Apts as it will be necessary to refer to them during this rebuttal It is clearly obvious that instead of accepting responsibility for their shortcomings and properly compensating me, Alamo Apts would rather attempt to place blame with me.1.) If you refer to both of my letters, I clearly identify that the problem with my dryer was not dealt with promptly I provided the timeline that the repairs took, or lack thereof, and the lackluster response by the Alamo Apts staff The bottom line is, it took over a month (close to a month a half) for Alamo Apts to seek an alternative to leaving me without a dryer (a service that I am paying for) Also, this is the first time I’ve been notified that there was an issue with zippers in the dryer (another attempt by the Alamo Apts staff at placing the blame with me and I challenge Alamo Apts to provide accurate maintenance records that substantiate this claim) The fact remains that for over a month I had a non-operational dryer and not until I continued to complain did the staff seek to rectify it As far me referring to the offer of $in gift cards as insult, I did say this and I stand by my remarks.2) Once again, I urge you to refer to my attached letters My heater went out times within a day period! I was forced to go without heat day in and day out and I find it nothing short of bizarre that Alamo Apts refuses to acknowledge that there is a problem with that As I stated in my correspondence dated Jan 15, other solutions could have been sought! The fact remains that maintenance had to respond to my apartment time and time again and the staff never sought another reasonable solution Even in the last instance, the staff failed to respond immediately and I had to call again on the following day to get the problem “fixed”. 3) As far as my refrigerator is concerned; Alamo Apts flat out refuses to acknowledge that THEIR EMPLOYEE responded to my house and found it to be non-operational and PROMISED me that a new one would be delivered the following day I would like to know why this occurred if my refrigerator was fully operational I’m not concerned with any “third party test”; I want the issue at hand to be addressed The fact is that “Laser” came to my apartment, inspected the equipment and found it to be in disrepair Period To suggest that anything other than this occurred is a direct attack to my integrity Further, if “Laser” states that this did not occur, I suggest Alamo Apts look into hiring more trustworthy employees. Furthermore, Alamo Apts’ response that “We believe that the tenant was under the impression he was obligated to an annual lease and was looking for ways to terminate his contract without penalty” just underlines the fact that no one is taking a serious look into the matter If you refer to my letter dated Jan 15, in paragraph I state, “While I do plan on remaining a tenant at Alamo Apartments, I request that Alamo Apartments rectify these issues and duly compensate me for both financial damages incurred and failing to hon mentioned above.” I am leaving Alamo Apts because I have realized that they intend to support their deplorable business practices and I refuse to live somewhere in which this behavior is tolerated To suggest that I somehow fabricated this incident so that I could get out of a contract (I was already aware I didn’t have an annual lease obligation) is absolutely absurd Finally, as we continue down this path it is becoming increasingly obvious that Alamo Apts will continue to refuse to take responsibility for its shortcomings and legal action will most likely be appropriate Note: I would like the Revdex.com to review their A+ rating of Alamo Apts, Incas I don’t feel their actions warrant the prestige

Dear Revdex.com Representative:As stated in our previous response, the appliance has been replaced. The tenant has since received a cleaning list via hand delivery as well as being emailed on April 15, 2015 as Mr. [redacted] requested. The military clause is as follows. "After the minimum term of this lease either party may terminate this lease by giving the other party a minimum of 30-day prior written notice. The minimum term of this lease is stated in Section 1 of this lease agreement. The Lessee(s) deposit is refundable subject to any claims Lessor may have against the Lessee(s) for any sums due hereunder. It is understood that any active duty member of the United States military service may vacate the premises during the term of this lease agreement by submitting a copy of Permanent Change of Station orders and a written 30-day notice. Active duty personnel are released from lease obligations for TDY and Deployment duties for 90 days or more in conjunction with military duty by submitting a copy of orders and a written 30-day notice. Rent is due and payable through the 30-day period whether active duty personnel received 30-day prior notice of assignment or not." Mr. [redacted] has failed to submit a written 30-day Notice of Intent to Vacate as well as proper documentation. The orders Mr. [redacted] has provided state his effective date for the assignment as August 23, 2015. This does not justify Mr. [redacted] terminating the agreement in May 2015- 3 months before the assignment. Also in the agreement, it states orders are needed. Mr. [redacted] provided a letter from a TSgt [redacted]. [redacted]; however, this is unacceptable as it is not orders as the lease specifies. Mr. [redacted] has also submitted a copy of "Application for Shipment and/or Storage of Personal Property"- again this document is not sufficient to terminate the agreement. Mr. [redacted] may submit a written notice in July 2015 to vacate in August 2015 when his orders are effective unless satisfactory documents are provided for Mr. [redacted] to vacate in May 2015. We are more than willing to work with Mr. [redacted] about his vacation, but he must produce the correct paperwork required by the agreement.

it was otherwise in working order. Mr. A should not have any more issues in his apartment; however, we have a prompt, reliable and professional management and maintenance team that would be happy to help him with any other issues. Following is additional information regarding issues from Mr. [redacted] original complaint: The apartment complex is master metered. In the winter of 2015 New Mexico Gas Company changed the meter, which in turn lowered the gas pressure serving the building Mr. [redacted] apartment is located. The low gas pressure caused problems in the building. When the source of them problem was determined, new regulators were installed serving the building, which remedied the problem. The higher demand of gas in the evening caused the pilot light to go out. We have a 24/7 answering service for heater issues in the winter and air conditioner issues in the summer, which all tenants are advised to contact. All maintenance is completed in-house and we strive to complete tasks on a timely basis. The light pull chain and bathtub drain were fixed on or about April 23, 2016.  We appreciate Mr. [redacted] business and genuinely apologize for any issues he’s experienced in the past. If he has any questions or concerns regarding this letter or any problems please advise him to contact the Leasing Office. Sincerely,Alamo Apartments, Inc.

military clause. The property manager advised him of the requirements, which Mr. [redacted] did not meet. It is believed that this complaint transpired in an attempt to break the lease prematurely after Mr. [redacted] learned he did not meet the requirements under the agreement. Since the issues were resolved, Mr. [redacted] will not be refunded any monies and he will be held to the term of the lease unless he meets the criteria per the lease. Sincerely,Alamo Apartments, Inc.

I am rejecting this response because I am fully aware of how a military clause works. Besides the fact that I have evidence showing that on the 29 April the dryer machine in the apartment is not operational. That the issue is not resolve because parts were ordered it is still unacceptable. I was told numerous times that the parts were ordered and the machine was to be fixed. I have to continuously ask for a cleaning list but the business as yet to provide one whether through email or pickup when paying rent or stating the issues. It is easy to assume that this complaint came from an early termination but I assure you that it is distasteful and unsatisfying to put out with the lack of responsibility of the business. Early termination was a good thing compare to taking the business to court for such dysfunctional and unreliable service.
I do not deny that I ask about the military clause or getting out of the contract earlier. Due to the fact of the living conditions and the lack of customer satisfaction I am not settling or please with the management and failed requirements to find a solution. It was an easier way to resolve the issues at hand that have been going on for more than several months. I have received orders and will be leaving on May 15, 2015, but reimbursements are now what I require because of the hindrance of this business. I also have pictures and videos to ensure that there have been lies about the inoperable dryer being fix as statement in the response from the business. I also trying to empathize with the fact the manager was pregnant and that is the reason why the issue wasn’t taken this far but after meeting April 13, 2015 to speak about early termination and service, I realize this business doesn’t care about the customers or issues presented. I also had to use my own money to use other establishments numerous times, or hold the bag in my mouth while being on crutches and recovering from surgery to use the complex dryers when the opportunity present itself.

about Mr. [redacted]' dryer. It was found that zippers from clothing had gotten caught in the appliance and caused it to stop rotating, generating the "abnormal grinding sound" described. Repair parts are not available for purchase locally and have to be special ordered. There was a mistake made while ordering the parts which caused a delay in the correct parts being received. Instead of waiting for the repair parts, Mr. [redacted] was provided with a brand new washer and dryer. Alamo Apartments, Inc. gave Mr. [redacted] $50 in gift cards for this inconvenience, which he stated was an insult and returned the cards to management. 2. Maintenance staff also responded promptly when Mr. [redacted] called about his heater. The unit was inspected each time and no issues were ever found. This lead staff to believe that the pilot was going out due to an operational error, which sometimes happens. The heater was most recently re-lit on February 1, 2015. The unit has been working properly since then to our knowledge.3. When Mr. [redacted] called about his refrigerator, staff responded promptly to assess the problem. The appliance was found to be in working order. Mr. [redacted] still insisted the appliance was broken, so he was provided another refrigerator and the "broken" one was relocated to be inspected. A third-party appliance repair shop inspected the refrigerator taken from Mr. [redacted]' apartment and reported it to be working properly with no issues. The appliance is in use elsewhere and has had no issues whatsoever. As you can see, all issues have been resolved. Alamo Apartments, Inc. is unaware of any "on-going problem" as stated in the initial complaint. We believe that the tenant was under the impression he was obligated to an annual lease and was looking for ways to terminate his contract without penalty. However, the agreement renews on a month-to-month basis after the first year (which Mr. [redacted] has completed) so all that would be needed was a 30-day Notice of Intent to Vacate. The tenant has since provided his notice to management and is scheduled to vacate mid-March 2015. Sincerely,Alamo Apartments, Inc.

I am rejecting this response because: There's pictures I have taken 10 minutes before writing this response. Validating that this dryer has not been fixed. I have all proper documentation for leaving these apartments because stating in the AFI, terminal leave is another form of TDY attached to Military orders. I will not be in the local area because of separating, job hunting, and finding another place to stay while living in a permanent area after leaving the military. This is beyond unacceptable and it's shameful that this company would lie on a official complain or try to scam an individual for rent money. Poor costumer service and false details concerning military clauses. I have five other individuals who can account for such an act and also who have taken pictures today seeing that the issues are not solved. This issue is getting out of handle whether there's some animosity towards the complaint makes against the company. I am being scammed and taking advantage of from this company and would like to see successful resolves from this awful dilemma. A refund of the amount of not having a dryer and the additional refund concerning using other facilities and use of gas. This company have created numerous issues and stress from this ongoing situation.

Dear Revdex.com Representative:We are sorry Mr. [redacted] feels this way about our business; however, we stand by our initial statement that our staff responded promptly and appropriately to Mr. [redacted]' complaints. Alamo Apartments, Inc. would be happy to grant a tenant compensation if, in fact, issues were not addressed in a timely and appropriate manner; however, this is not the case with Mr. [redacted]. As previously stated, Mr. [redacted] received a brand new washer and dryer set. It was never implied or stated the tenant intentionally caused the zippers to become caught in the appliance. Wrong parts were ordered which caused a delay, so the set was replaced to avoid causing the tenant further inconvenience. Mr. [redacted] was satisfied with this solution upon installation of the new appliances. Again, reiterating our last response, staff responded promptly when Mr. [redacted] called about his heater and each time did not find any default in the furnace besides the pilot light. Operator error (not using the thermostat correctly) is known to cause the pilot light to go out. The heater is in working order, as it has been since the beginning of February 2015. The refrigerator was also responded to in a timely manner and, again, found to be working by our staff. After further complaint by Mr. [redacted], the refrigerator was removed and replaced so that it could be inspected more thoroughly. Please see the attached report from the third party inspector deeming the appliance as working. The appliance is being used and has not had any problems whatsoever. Alamo Apartments, Inc. has made every effort to appease Mr. [redacted], besides issue compensation for problems that were promptly and appropriately tended to. Alamo Apartments, Inc. understands its responsibility as a landlord and its obligation to its tenants.
