Our company has a contract for pest control services at the apartment community Mrs [redacted] lives/lived inMrs [redacted] is not a customer of ours, the apartment community has a contract with our companyAn agent of ours did service the apartment unit and did treat the bed frame, floor mirror and dresser along with all other items in the unitThe target pest was mites which has a treatment of crack and crevice and a broadcast spray to any affected areasWe used chemicals labeled for the target pest and applied it according to the label which is the lawI have to mention that the furniture was made of particle board and not real wood which any water would have left a water stainWe checked with the manufacture of the chemical to make sure that we treated correctly and we didA rep from the manufacturer was contacted to come see the stains and was sent out to inspectAfter cleaning the furniture, it was decided that the stains are very light but can be seen with a flashlightAfter several calls from Mrs [redacted] to our field manager, the incident was escalated to my officeI am the Business Manager for the companyThe day that I was told of this incident, I called Mrs [redacted] and talked to her about her issueShe was extremely upset about the whole issue and made me aware that she was upsetAfter apologizing for the mishap, we scheduled a meeting for the next morning at her work place so she would not have to miss workI offered what I thought would be a valid solution for everyone involvedThe “offer” Mrs [redacted] is talking about in her complaint was to buy her all “new furniture”My offer was to remove the stained items and replace them with brand new itemsI think that is a very reasonable offerAfter I told her what our offer was, she raised her voice, which in turn I raised my voiceI was not going to let someone talk trash about a company I am representingI eventually walked outWhat Mrs [redacted] would like is to keep the slightly damaged furniture and the money to replace itOur company is willing and would like to make it rightOur offer is still available, we are still willing to replace the stained furniture with brand new furnitureI can be reached at my office if Mrs [redacted] would like to take the offer

1) TECH WENT OUT ON JULY 21ST AT 1:45PM TO DO A 1XR FOR FLEAS ON INTERIOR AND EXTERIORCUSTOMER WAS GIVEN A “FLEA PREERATION SHEET”, WHICH COVERS WHAT TO EXPECT (ACTIVITY FOR WEEKS AFTER TREATMENT) AND THEIR DUTIES AS THE HOMEOWNER(OUR CUSTOMER MUST VACUUM EVERY DAY, WHICH WILL MAKE THE DORMENT EGGS HATCH, EXPOSING THEM TO THE CHEMICAL).2) MRS [redacted] LEFT A VOICE MAIL VERY UPSET STATING TREATMENT WASN’T EFFECTIVE ON 07/25/FOLLOWED UP WITH MRS [redacted] THE SAME DAY.3) TECH WENT BACK OUT TO RESERVICE FOR FLEAS ON JULY 28TH @ 11AM AND SERVICED FOR FLEAS ON INTERIOR AND EXTERIOR.4) FOLLOWED UP WITH MRS [redacted] ON 08/17/TO ASKED HOW FLEA TREATMENT IS WORKING, SHE SAID FLEA TREATMENT IS STARTING TO TAKE EFFECT BUT STARTING TO HAVE BABY FLEAS NOW.5) SENT TECH FOR A FINAL FOLLOW UP WITH MRS [redacted] ON AUGUST 22ND @ 9:30AM & TREATED FOR FLEAS ON INTERIOR DUE TO ONLY HAVING A SMALL ISSUE ON INTERIOR AT THIS TIME.6) WORLDWIDE PEST CONTROL,INCHAS TREATED THIS ACCOUNT IN ACCORDENCE TO STATE LAW, WHICH IS THE LABELOUR CUSTOMER MUST VACUUM EVERY DAY, WHICH WILL MAKE THE DORMENT EGGS HATCH, EXPOSING THEM TO THE CHEMICAL

Worldwide Pest Control, Inchas a contract with [redacted] do service the complex for pest controlOn 3-1-17, a tech of ours entered the unit to preform a Bed Bug treatment which involves a crack and crevice application of an aerosol spraythis application would be in cracks and crevices of all furnitureWe would not have treated the entire area of the furnitureOn 3-15-17, and 3-28-were follappointments to check on bed bug activityWe did follspot treatments on the unit on these daysOn 4-3-our Austin Manager went out to take a look at the spots that the tenant complained to the complex aboutHe did inspect the furniture but the spots where only noticeable if you would shine a flashlight directly on what appears to be water stainsHe did try to remove the stains only because we where accused of causing themWe contacted the manufactures rep to come take a look as wellHe did, and he even sent a few pictures of the stains to his corporate office for a technical assessmentThe manufactures rep sent us an e-mail about their conclusion I have attached that e-mailIf we truly caused this damage, we would be obligated to replace the furniturePlease feel free to contact me with any questions

I am rejecting this response because: The company is lying. The entire bed frame and furniture was sprayed with the chemicals. Not just in the cracks and crevices. I have pictures showing where the spray was sprayed on my furniture and I highly doubt the same spots would be on every single item I own in my apartment if it wasn't your spray that damaged it. If you didn't believe that the staining was your doing you should of never took responsibility and tried to clean it off also the Paul even stated oh this staining, no problem a little elbow grease and it will come right off. He acknowledge the staining if it wasn't the chemical why say oh this can come off and try to clean it. The main manager even stated he did not know why the employee sprayed all of the bed frame when the product was only meant for cracks and crevices. Paul you can tell all the lies you want but I have proof showing otherwise and I am not going to push this under the rug. I have two years to file a law suit against the company and I am not going to drop this until I get resolution. I am expecting payment for replacement otherwise if we cant reach an agreement I will file a civil suit against the company and request court cost, legal representation reimbursement,   lost wages from work due to the time I had to take off to be there for them to come and look at their damages, plus cost to replace my furniture.  I am trying to mediate and work a deal out to get my furniture replaced that was not damaged upon being sprayed. I also have pictures of the said damages and have lawyered up. My lawyer said I have a strong case with proof to show that they are accountable. We can go two ways handle among each other or go to civil court and pay more. I have plenty of photos of my furniture before you came in to my apartment and sprayed.

I am rejecting this response because:The furniture is not particle board. It is cherry wood with a veneer cover. The stains are not light and are very visible in normal daylight.I am, indeed, upset because I have been proacative about coming to a solution since May of 2016 and have been repeatedly given the brush-off until it was escalated to the Business Mangers office to be unethically and unprofessionally "handled" in January 2017. This specific furniture has sentimental value to me and I have paid for it. There is no restoration or cleaning solution. World Wide Pest control ruined it by allowing the pesticide to sit for hours on the wood. I do not want new furniture. They should pay for what they ruined. Futher, I have photos of the significant puddles that were left after treatment, the condition of the funiture, email correspondence, and video of the encounter at my work.

He did, and he even sent a few pictures of the stains to his corporate office for a technical assessment. The manufactures rep sent us an e-mail about their conclusion.  I have attached that e-mail. If we truly caused this damage, we would be obligated to replace the furniture. Please feel free to contact me with any questions.
