Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appeaProvide details of why you are not satisfied with this resolution.] Regards, [redacted] I was contacted by [redacted] company about a GPS being installed after having the car about a week never signed anything about a GPS and I was told that I had to sign a blank contract due to having problems with the bankruptcy program and I have my husband and daughter that witnessed this and when I visited the car lot 8/18/my contract that I left in the vehicle was never returned and when I called Albany Mitsubishi the finance Manger advised this was the first time they have ever had put a GPS on car so how could I sign when they weren't even aware that the fiance company required a GPS and at first I was reluctant about having GPS installed but did call and schedule to have it put on but I am a nurse and my shift may not end until I get relief I did call the service department and reschedule but once I didn't get off in time on Thursday 8/13/was placed on hold for over minutes and I worked 8/14/and couldn't make it had no calls from Albany Mitsubishi on my cell which I advised was the best contact number never called my work number Friday because I worked and didn't call SaturdayI feel they took advantage of my situation because I needed a vehicle to commute back and forth to work and was desperateI have a copy of the contract from 7/17/and didn't actually get the car until 7/31/And I still don't have a vehicle and no money for a downpayment I'm having to pay to commute back n forth now I'm just in a bad situation

This letter and accompanying documents are in response to case ***This complaint is not legitimateVehicle described, with VIN#***, is a Mitsubishi Eclipse Spyder, Kalapana Black in colorThe vehicle was purchased on April 81", by *** ***Vehicle arrived at Albany Mitsubishi on December 2, with the LI-l window not operating properlyThe technician inspected the vehicle and concluded that the door panel had been previously removed and several fasteners and wedges For the door panel were missing or damagedFurther inspection of the vehicle determined that the left hand front door window regulator had failedIt was then determined that the regulator and motor assembly would need to be replaced to complete repairs on the vehicleThe parts were ordered same day, and arrived on December 3, Repairs were made to the vehicleThe window motor and regulator were replacedAll operation of all windows was then checked for operationIn addition to the replacement of the window regulator and motor assembly, several fasteners were replaced and/or repaired at no cost to the customer
The customer took possession of the vehicle after repairs on December 3, Approximately fifteen minutes after leaving the dealership, Albany Mitsubishi, the customer returned with an existing concernAt that time, the customer was assured that a small adjustment was possible, and that it would be done immediatelyA small adjustment was made to the windows alignment, and then verified on both sides of the vehicle as natural operationThe customers return also revealed that there was an adjustment that was not possible under warranty clue to the improper repair done by an unknown repair facility to the door panel assembly, parts were missing and/or brokenThis was all explained to the customerThe customer had another concern about the weather strip seals connected to the convertible top that met with the left hand front window glass when the window is in the closed positionThe customer failed to mention this concern during the write up process when discussing the windows open/close failureService Manager *** *** Went on a test drive with the customer and could not verify any wind noise or water leaks with the vehicleIt was verified that the gap between the weather strip seals and the window may be larger than the gap on the right hand side of the vehicleParts were ordered, but were unavailable for express shippingThe customer explained that her and her husband would be taking a trip soon, and would be out of town for an undetermined amount of time
The customer returned with the vehicle on December 27, for repairs to be made to the weather strip sealsThe vehicle was left for pick up at a later timeThe seals were replaced and the vehicle was test driven 'to inspect for wind leaks and/or water leaksAll operation at this time was normalService Manager contacted customer on December 27, to advise that the vehicle was ready for pick upCustomer advised that they would pick the vehicle up the following day
On December 28, 2013, the customer arrived to pick up the vehicle, and immediately entered the main showroom of Albany MitsubishiMrs*** was yelling and using profane language upon entering the buildingSales Manager *** *** asked Mrs*** to step outside and discuss the issue she was havingService Manager *** ***, explained to Mrand Mrs*** that the concern with the vehicle was not a warrantable condition due to prior ineffective repairs done by an undeterminable repair facilityMrs*** continued yelling at Sales Manager and Service Manager in the parking lot of Albany MitsubishiAfter repeated unsuccessful attempts to calm Mrs*** and explain the process for out of warranty repairs, no compromise was metAt this point Mrs*** insisted that the Mitsubishi Eclipse had water damage to the interior of the vehicle because the windows were left downService Manager took pictures of the vehicle in the area that was supposedly affectedUpon inspection of the vehicle, there Was no water anywhere in the interior of the vehicleAt this point Mrs*** left the dealership
Mrs*** *** has made a complaint stating,
“Until I took it to the dealership to get this window motor replaced the car did not have an air leak nor did the window leak when it rained.”
Prior to repairs performed at Albany Mitsubishi, the window would not move to the closed positionThe weather strip seals were replaced due to a sagging issue, not a leaking issueService Manager *** *** test drove the vehicle with Mrs*** present during a mild rain, and no water leak was present prior to the weather strip seals being replaced
Mrs*** *** also states,
“They have poor customer service poor workmanship and refuse to fix the vehicle correctly.”
This is falseSeveral attempts were made to repair the vehicle; however the customer did not want to pay for repairs

Customer applied for purchase of a vehicle on July 31, At the time of signing, customer was involved with every form with signature and dateBefore the customer signs any document, the entirety of the document is explained in great detail to the customerCustomer then signs and we
continue to the next documentA total of sixteen documents were signed and dated by the customer and then sent to the lending institutionDuring the signing process the customer agreed in writing to the installation of a GPS tracking unit to be installed on the vehicle being purchasedCustomer also signed a Bailment Agreement(attached)Albany Mitsubishi and the Finance Manager made several attempts to reach the customer by telephone to arrange for the GPS tracking Unit to be installedCustomer did not keep appointments made on two occasions and made no attempt to reschedule after the second missed appointment
On August 15, the collateral belonging to Albany Mitsubishi, was recovered and returned to Albany MitsubishiAt that time of the evening, the customer made contact with the Finance Manager at Albany MitsubisThe Finance Manager advised Ms*** that it is the policy of Albany Mitsubishi to have all paperwork signed and delivered with all stipulations from the lender to be met immediately or surrender the vehicle at that timeMs*** failed to comply with this Bailment Agreement and was charged adequately based on the signed Bailment Agreement

I am currently awaiting a check in the amount of $65.00, to reimburse Mrs. [redacted] for her fuel used to have the vehicle repaired.
I would also like for Mrs. [redacted] to accept our sincere apology for our inability to repair the vehicle at her local Mitsubishi dealership, Albany Mitsubishi. I will be sending out a formal apology via USPS today February 18, 2014 to Mrs. [redacted].

First, the vehicle was purchased by my husband for me as a present. Since we are not a his/her couple there is no issue with the vehicle being registered in his name as he is the one paying for it. But if you want to drag things into it, the vehicle was purchased using my (owned by me alone) former Mitsubishi Eclipse as a trade-in. 
Second, Mr. [redacted] stated during the intake that the window motor is a problem and has issues mostly in the rear window of the Galiant but there have been Eclipse issues as well. He went on to state that this is not an uncommon problem. The part that he "ordered that day" did not come in until 3 PM the next day as he told me that the truck was late. I picked the car up after 5 PM because I had a physical therapy appointment and could not make it before 5. I called corporate that night when I brought it home and noticed the window pushed up into the convertible top. I took the car back the next day and pointed out the problem after having a conversation with Mr. [redacted] telling me that bring it in because "he had a car the same year, and model as mine and it was even black" I told him I would be there in 15 minutes and to pull the other Eclipse around so we could compare. When I got there, Mr. [redacted] met me outside and there was no other Eclipse on the lot, in the bays or anywhere on the property. I showed him this issue, he told me it would be a quick adjustment and 2 hours later I left, to return in 5 minutes because there was a air leak and water coming in the window that was not present before the issue with the window not being able to roll up. He go in the car and stated that he did not hear anything but felt where the weather stripping had collapsed. This was not previously reported because it was not an issue before, it was not collapsed before so why would I bring it up. I know it was 5 minutes because the route that I drove and then returned is the exact same route that Mr. [redacted] drove when I asked him to get in the car and drive it. 
Mr. [redacted] is the one that told me that he would order the weather stripping and would call when it came in. I told him that I was leaving for North Caroling on the 14th of December to be an expert witness in a case there, but my husband would be here until the 21st of December then he would be meeting me in the Charlotte area for the holidays. Mr. [redacted] said he would call my husband as soon as the part came in. On December 13th, my husband reached out to Mr. [redacted] and Mr. [redacted] told my husband that the part had not come in yet, but he would be calling him sometime next week when it does come in. Now mind you that I took my car back into the dealership on December 5th to point out the continuing problems. All this can be verified via the Mitsubishi corporate office as to the phone calls.
On December 27th when we returned from North Carolina I called Mr. [redacted] and he stated that the part was in and to bring the car in at 2 PM, we took the car in and I offered to leave the car overnight so they could do all the repairs and adjustments. When we got there on December 28th the car was parked outside, with the passenger side window 4 inches down and it was raining. I walked in and asked "if they had mns working in the service department" I went outside with a gentleman who never identified himself because when I had called before and asked for the dealership manager I was told they did not have a general manager. I told him that I found it rude that they treat anyone's automobile like this and that I would be calling corporate and filing a complaint. My husband was present at this conversation and even told them that this was unsatisfactory. 
I was assigned a case manager by the name of [redacted] ( his last name was never disclosed "due to security reasons") His number was ###-###-####. I was called by someone in his office to tell me that the district manager would be getting in touch with me. A few days later, I was told that because the district manager had retired that it would be a few days before the "new" district manager would contact me. A few days later I was told that the district manager could not meet with me until February but I could take my car to another dealership to have my vehicle inspected and see if there the errors were caused by me or the Albany dealership. I stated that I would take my vehicle to Columbus Mitsubishi to have it inspected. I called [redacted] and told him the date and time I would be taking it in. I drove the vehicle to Columbus on January 10th and met with [redacted] the service manager of that dealership (###-###-####). He and his technician looked at the vehicle got on the phone with [redacted] and told him "that the issue was service department error, that the window had not been properly adjusted causing the additional damage."  My vehicle was then taken in on January 13th to the Columbus dealership where it was repaired and now works fine. [redacted] will verify my statements as to the improper installation of the window motor and adjustment. 
Mr. [redacted] does not know me nor can he make statement " the customer did not want to pay for repairs" as we spend money on our vehicles all the time and can prove it to make sure they are properly maintained. We were not in error and the vehicle was under proper warranty conditions for the window motor. Mr. [redacted] is not wanting to own up to his failure to properly repair the vehicle. 
I contacted Mitsubishi today to get a copy of the records and was told that they could not release them to me because of proprietary reasons. But they did tell me that my contact with them was December 4, 5, 27, 30, 2013; January 9, 10, 13, 2014. Representatives I have spoken with other than [redacted] are [redacted] and [redacted].  They are all at the same number listed above in this message.

 I would like an apology from Albany Mitsubishi as well as the reimbursement of the gas to back and forth twice to get the vehicle repaired this was 90 miles one way which is 380 miles round trip for both trips. One to get the vehicle inspected as per corporate office and the second to get the vehicle repaired. At today's gas market price that would be $63.40.
I am not asking for time off work, or anything other than the apology and gas reimbursement as Columbus Mitsubishi repaired the vehicle.
