stand by my original complaint and will attach my communication with them and photos.
I was never offered additional photos as they claim was offered and in my oppinion just another attempt to justify their mie-representation of their part.
Kaci Smiths email is very clear that the part has very minor damage. She further states the cross members are rust free and solid. This is a part of one of her emails; "Attached are picture of the short beds we currently have in stock. Two pictures so the very minor damage. Both off southern trucks and are rust free with solid cross members."
You will see by the attached photos (hers and mine) that there was avery clear intent to deceive me.
I talked with my employee and he did not inspect the part top to bottom, inside and out as stated.
The truck bed liner was not removed until my employee arrived which further proves the less than truthful statement made to me by Kaci which was they removed the bedliner at my request and inspected the interior of the truck bed and it was perfect. If they removed the liner it would not have been re-installed prior to my employee arriving.
The truck bed was still on the truck so my employee could not have inspected the underside and see the rusted cross members.
I have given S & S the opportunity to come and pick up teir part but they have refused and went on to say they woulkd take the part back but I would have to bring it back. I have already lost just under $300.00 in expenses to pick up the part and am not willing to make another trip when this company from the beginnig mis-represented the part.
I also have been pondering filing a lawsuit but that generally is not my way of solving an issue but it may become necessary.
I am also looking into mail fraud as the emails show a very clear intent to defraud.
All I wanted from the beginning was for S & S Automotive to take ownership of their mis-representation, come and pick-up their part and move on.
I will share this response with my attorney and make preparation to file what ever legal action he advises me to do and if he feels there was criminal intent, I will pursue that also.
I see this file does not give me enough space to attach all the photos and email exchange so I will attempt to email that to you also.
